DANIA BEACH CITY COMMISSION
TUESDAY, AUGUST 13, 2013 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor Duke called the meeting to order at 7:00 p.m.

2. Invocation and Pledge of Allegiance
Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 Certificates of Completion for the Florida League of Cities Institute for Elected
Municipal Officials
Mayor Duke presented the certificates to Commissioner Brandimarte and Vice-Mayor Jones.
3.2 Special Event request from Miami Dolphins Cycling Challenge, Inc., for the
"Dolphins Cycling Challenge" participants to use the City of Dania Beach as a pass-
through on November 2-3, 2013. This is a tri-county event to benefit the Sylvester
Comprehensive Cancer Center.
Commissioner Grace motioned to approve the Special Event request for the Miami
Dolphins Cycling Challenge; seconded by Vice-Mayor Jones. The motion carried on the
following 4-0 Roll Call vote:

4. Proclamations

5. Citizen Comments
Pat Wright, 4391 SW 34 Lane, spoke in support of appointing Paul Fetscher to fill the vacancy
on the Commission.
Teddy Bohanan, 312 SW 15U' Street, suggested each Commissioner put two applicants' names in
a hat from which someone would draw a name to fill the vacant seat, and she spoke in support of
Bryan Cowart.
Betty Sokol, 609 NW I Street, addressed the lack of a shelter at the bus stop along US-1 that
is used by the Melaleuca Gardens community. Mayor Duke asked the City Manager to follow
up to see what can be done.
Charles Camacho, 121 NE 3rd Street, expressed his interest in serving on an advisory board,
noting he submitted paperwork to the City Clerk. He added he had not met any Commissioners
before the process to fill the Commission vacancy started, and he is on the side of the residents
of Dania Beach.
George Jason, 4549 SW 37 h Avenue, commented he respects all of the Commissioners and
considers them friends. He said he hopes they know who he is and what he stands for, and noted
he would like to be considered for the vacant Commission seat.
Ann Page, 38 SW 5d' Street, addressed Vice-Mayor Jones' comments about her at the special
meeting last Friday and stated she has no intention of running in the next election or thereafter.
She asked Vice-Mayor Jones for his vote and said she would do a wonderful job.
Veronica Larkins, 211 NW 12d' Avenue, commented about her embarrassment for the City
caused from co-workers questioning why the Commissioners cannot get along; she loves Dania
Beach and asked that we act like sisters and brothers.
Tamara James, 255 NW Tamara James Avenue, thanked those who attended the health fair and
basketball clinic event held on August 3rd. She expressed concerns regarding policing in Dania
Beach, insofar as black people feel like they are being profiled, and the behavior of the
Commission in filling the vacant seat.
6. Public Safety Reports
Captain Kevin Granville, BSO Chief of Police, thanked residents who came out last week for
National Night Out. He noted BSO and the CRA will conduct a crime symposium on September
14d' at I.T. Parker Center, and on October 26d', Operation Medicine Cabinet& Shred-a-Thon will
be held at the Bass Pro Shop for disposal of old prescription drugs and documents containing

identifying information. Lastly, he advised that BSO conducted a search and arrest of a Dania
Beach resident who had a large amount of weapons and ammunition. He asked residents to be
aware of things that are happening around them and unusual comments being made, and call
BSO with such information.
Chief Keefe, BSO Fire Rescue, thanked the Commission for supporting last weekend's Dania
Beach Pier Relay for Life event.

7.3 RESOLUTION#2013-083
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING
RESOLUTION NO. 2011-082, RELATING TO A STATE REVOLVING FUND ("SRF") LOAN IN THE
AMOUNT OF $840,000.00 PREVIOUSLY APPROVED BY CITY RESOLUTION, WHICH RESOLUTION
ESTABLISHED ONLY PLEDGED SEWER REVENUES AS MEANS FOR LOAN REPAYMENT OF
INFILTRATION AND INFLOW IMPROVEMENTS TO THE CITY SEWER SYSTEM; CLARIFYING THAT
ESTABLISHING PLEDGED REVENUES TO REPAY THE LOAN SHALL INCLUDE BOTH WATER AND

City Attorney Ansbro read the title of Resolution#2013-083.
Vice-Mayor Jones asked about the amount expended to date and the areas it has gone into, as
well as for an explanation of groundwater infiltration and inflow for the audience's benefit.
City Manager Baldwin responded the project has been done and the $840,000.00 loan has been
spent; the omission of water revenues as pledged revenues to repay the loan was a clerical
oversight. He explained maintenance of the sanitary sewer system is necessary to keep
groundwater from infiltrating through cracks in the system, which adds to the water treatment
expense.
Dominic Orlando, Director of Public Services, added that the project was citywide within the
City's service area, which is east of Ravenswood Road, and the City realizes a savings of$10-
15,000.00 per month on treatment costs.

City Attorney Ansbro read the title of Ordinance#2013-011.
Vice-Mayor Jones asked about using a single hauler within the City.
City Manager Baldwin explained the Commission did not favor allowing only one commercial
hauler in the past. The advantage to this would be the ability to collect more revenue and the
reduction of residential rates if it is tied with the residential hauler.
Vice-Mayor Jones requested that City Manager Baldwin look into a single hauler and report back
to the Commission.

8.1 Professional Auditing Services Bids Received
Mayor Duke gave a brief background of the solicitation for, and receipt of, bids for auditing
services and noted staff is requesting direction from the Commission regarding selection of a
firm.
Commissioner Grace motioned to narrow the list of eight firms to four; seconded by
Commissioner Brandimarte.
Commissioner Grace recommended Harvey, Covington& Thomas of South Florida, LLC.
Vice-Mayor Jones recommended GLSC & Company, PLLC; S. Davis & Associates, P.A.; and
Nowlen Holt&Miner, PA.
The motion carried on the following 4-0 Roll Call vote:

City Attorney Ansbro read the title of Ordinance#2013-007.
Corinne Lajoie, Principal City Planner, noted, at first reading, the Commission requested that a
public hearing before the Planning & Zoning Board be required for approval of new duplexes.
She added the 300' notification will apply for the P&Z Board.

Teddy Bohanan, 312 SW 15fl' Street, commented she likes and owns duplexes, but the ones
around her are horrible because of who they are rented to. She noted we need to make sure the
duplex owners comply with City code in order to prevent crime and detriment in the
neighborhoods.
Randy Wright, 4391 SW 30' Lane, questioned the setback provision "from 15 to 25' from the
street line" and whether a variance would be necessary for placing a home more than 25 feet
from the line.
Principal City Planner Lajoie said the language in Section 303-90 (C) should be changed to read
"... a new building can be placed a minimum of 15' from the street line."
Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public
Hearing.
Vice-Mayor Jones commented he is uncomfortable with duplex site plans going only to the
Planning & Zoning Board and the Commission agreed the ordinance should be changed to
require Commission approval of duplexes.
Commissioner Grace motioned to adopt Ordinance #2013-007 with the recommended
changes to setback and duplexes, on second reading; seconded by Vice-Mayor Jones. The

10. Discussion and Possible Action
Addendum
10.1 City Commission Vacancy (Continued from August 9, 2013)
Mayor Duke noted there will be discussion only after a motion and second is made. He gave a
brief recap of the prior meetings held to fill the vacancy and added he remains willing to
compromise for the betterment of the City.
Commissioner Grace motioned to appoint Jean Cook. Motion died for lack of a second.
Commissioner Grace motioned to appoint Ann Page; seconded by Mayor Duke, who
passed the gavel to Vice-Mayor Jones.
Commissioner Grace commented we are in the middle of budget season and need a full
Commission; it would be a travesty to the residents of Dania Beach if an appointment is not
made tonight.

Mayor Duke felt most of the applicants would do a good job, but he would like someone who
lives out west, is perhaps younger, has a business sense, and is presently involved. He felt Ann
Page fits this bill and although she was not his top pick, she would do a fantastic job.

Commissioner Brandimarte motioned to nominate Bob Adams to fill the position; seconded
by Vice-Mayor Jones.
Vice-Mayor Jones spoke of Bob Adams qualifications and noted he is taken aback by some of
the things that have been said and done. While we certainly need to move forward, this is the
fourth attempt at making an appointment and we probably need to move on with City business.
If the Commission is unable to make an appointment tonight, we will move forward as a City
and this can be taken up at a later date. He added there is always a mess when there is no
process.
Mayor Duke commented there was a definite order and process set forth by the Commission that
provided for an application procedure and deadline, which was complied with by 21 of the
applicants. He noted the 12 applicants shortlisted at the last meeting are highly qualified and
shooting from the hip, as Vice-Mayor Jones had described the lack of a process, is picking
someone from the audience at random.

Vice-Mayor Jones voiced why he supports Mr. Fetscher and explained the lack of
communication from Ann Page regarding her intent not to run in the next election.

Mayor Duke commented Dr. Fetcher is a good applicant, but he is the only one Vice-Mayor
Jones and Commissioner Brandimarte have voted for so far, which he finds uncompromising and
inconsistent with the spirit of working together. He felt it does not matter if the appointee runs
for the seat.
Commissioner Brandimarte said she has been honest from the start and told the Commission of
her one vote. Her reason for nominating someone from the floor is because the Commission has
considered the same applicants over and over, and gets the same results. She knows who she is
voting for and this is her right.

Ann Page, 38 SW 50' Street, asked if a motion could be made to have the City Manager break the
deadlock and choose the person to fill the vacancy.
Mayor Duke said he would not be opposed to having the City Clerk and City Manager number
21 ping pong balls,place them in a bag, and draw one out.
Commissioner Grace motioned to pick one person lottery style. Motion died for lack of a
second.

Tuesday,August 13,2013—7:00 p.m.
Vice-Mayor Jones spoke about a recent conference he attended in San Diego on behalf of the
hospital district and discussions/functions regarding health and palliative care.
Vice-Mayor Jones spoke of the Holocaust Documentation and Education Center coming to the
City and noted they will soon be closing on the property at the old Dania Laundry.
Vice-Mayor Jones commented about National Night Out on Crime, noting he wants to see it
continue in Dania Beach.
Vice-Mayor Jones expressed displeasure with how the book bag giveaway last Saturday was
handled insofar as the entire Commission should have been involved and the flyer, which was
not approved by Parks & Recreation, only listed "Vice-Mayor" Grace and Mayor Duke. He said
a sponsoring organization should never be used for political gain and flyers like this going out
into the community should list all of the names of the Commissioners.
