Call to Order/Roll Call Mayor Duke called the meeting to order at 7:01 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Presentation of the winning Friends of the Library Historic Essay—Jayme Seufert Ms. Jayme Seufert, 42 SW 5 h Avenue, 13-year old student at Olsen Middle School, read her Historic Essay on Charles K. McElyea. 4. Proclamations 4.1 All Airborne Week — Presented to Chairman Jose Perez Ortiz, and Secretary Bob Buffington of the South Florida All Airborne Chapter Mayor Duke presented the proclamation to Secretary Bob Buffington of the South Florida All Airborne Chapter. 5. Citizen Comments Pat Wright, 4391 SW 34 Lane, addressed the issue of the Commission vacancy. She said she supports Paul Fetscher, and noted she was appalled by the attitude of Ann Page at the last meeting. She added the four Commissioners make good decisions concerning Dania Beach without a fifth person and suggested they wait until the seat is filled at the November 2014 election. Walter Dix, 2650 West State Road 84, IAFF Local 4321, Broward Fire Fighters, addressed Item #7.3 on the Consent Agenda and said he wanted the Commission to be aware of the pitfalls of reducing staffing on the EMS vehicles. George Jason, 4549 SW 37 h Avenue, noted his displeasure with the Mayor's comment at the last Commission meeting that a "younger" person should be appointed to fill the Commission vacancy. He suggested the Commission consider other applicants for the position, and noted his interest in filling the position. Michael Owen Sartin, 746 SW 3`d Street, commented the Commission is polarized, and recommended the Commission follow the Charter and admit that they are unable to select someone. He suggested the Commission appoint a Charter Review Board to begin reviewing the Charter for needed reform and added he does not recommend filling the position. Luis A. Rimoli, 902 Natures Cove Road, noted he is one of the 20 applicants to fill the vacancy and is qualified for the position. He challenged the Commission to tell the citizens of Dania Beach why the applicants are not qualified to fill the vacancy. Owen Goldman, 3625 N Country Club Drive, Aventura, spoke in support of Ann Page to fill the Commission vacancy. Susan Roberson Hodd, 910 N Victoria Park Road, Ft. Lauderdale, read a letter from Francis Tyler in support of Ann Page to fill the Commission vacancy. Sarah Hershberger, 38 SW 5d' Street, spoke in support of Ann Page to fill the Commission vacancy. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, reminded everyone of the Crime Symposium to be held on September 10, and Operation Medicine Cabinet and Shred-A-Thon scheduled for October 26d'. He encouraged citizens to continue emailing BSO regarding things happening around the City. 7. Grace to attend the National League of Cities 2013 Congress of the Cities and Exposition in Seattle, Washington, on November 13-16, 2013 (Estimated cost$2,195.44) Vice-Mayor Jones spoke in support of the Commissioners traveling across the country to attend conferences and bringing back information. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,August 27,2013—7:00 p.m. Vice-Mayor Jones motioned to approve the travel request; seconded by Commissioner Brandimarte. Bids and Requests for Proposals 8.1 RESOLUTION#2013-086 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, ESTABLISHING A FINAL RANKING OF AUDIT FIRMS SUBMITTING PROPOSALS FOR ANNUAL FINANCIAL AUDITING SERVICES FOR THE CITY OF DANIA BEACH, FLORIDA; AUTHORIZING THE PROPER CITY OFFICIALS TO NEGOTIATE AN ENGAGEMENT LETTER AGREEMENT WITH THE TOP- RANKED FIRM AND TO PROVIDE THE NEGOTIATED ENGAGEMENT LETTER AGREEMENT TO THE CITY COMMISSION AT THE SEPTEMBER 10, 2013 MEETING FOR ITS APPROVAL; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro relayed a message from Finance Director Bates that the Commission could move forward with this item if they are ready to rank the top three firms; however, all of the firms were notified earlier today that the item would be continued until September 10th Commissioner Grace felt it would be more business-friendly if the firms were present. Commissioner Grace motioned to continue Resolution #2013-086 until the September 10, 2013 City Commission meeting; seconded by Vice-Mayor Jones. MELI BASEBALL DUGOUT REPLACEMENT PROJECT; AUTHORIZING THE AWARD OF BID TO BLUEPRINT INDUSTRIAL CONTRACTORS, INC. IN THE AMOUNT OF$75,900.00 AND AUTHORIZING THE PROPER OFFICIALS TO EXECUTE AN AGREEMENT FOR THE PROJECT;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-087. Vice-Mayor Jones motioned to adopt Resolution #2013-087; seconded by Commissioner Grace. Vice-Mayor Jones commented we need to ensure that there is a contingency included in bid awards and felt this project should therefore be budgeted at $99,000.00. Perhaps 10-15% of the Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,August 27,2013—7:00 p.m. I value of a job could be built-in as contingency on future bids in order for the vendors to do what needs to be done. Public Hearings and Site Plans 9.1 Community Bus Service Route Expansion Mark Felicetty, Director of Parks and Recreation, gave a brief presentation, noting the new proposal has six additional stops on the east side and seven additional stops on the west side. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition,he closed the Public Hearing. Vice-Mayor Jones motioned to approve the new routes; seconded by Commissioner Grace. Vice-Mayor Jones commented on the fact that additional bus shelters are required, and noted he will address it with the CRA Director. Mayor Duke suggested going to the Clubhouse in the Estates of Ft. Lauderdale rather than to 53r , going to the Quarterdeck at the beach, and perhaps later expanding into Dania Beach Heights. Additionally, he felt there is a potential for advertising on the buses. City Manager Baldwin confirmed there would be no change to residents' parking. Vice-Mayor Jones motioned to adopt Ordinance #2013-011, on second reading; seconded by Commissioner Brandimarte. Vice-Mayor Jones requested that the City Manager look into a single hauler. Discussion and Possible Action 10.1 City Commission Vacancy (Continued from August 13, 2013) Mayor Duke noted this is the fifth attempt to fill the vacancy, and provided an overview of the previous meetings held to make an appointment. He said the deadlock has to stop, and asked that someone on this board step up and do the right thing in order to fill the seat. Commissioner Grace motioned that if the Commission deadlocks tonight, they not pursue this and wait until the 2014 election for the position to be filled; seconded by Commissioner Brandimarte. Commissioner Brandimarte noted the only other option is to open the process to new candidates. Vice-Mayor Jones said that when someone comes with their own plan and says this is what will be done, it is not a process. He noted he would like to see the seat filled, but only where there is shared input to reach a process; perhaps a workshop for such input would be appropriate. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,August 27,2013—7:00 p.m. Mayor Duke noted the only stalemate is that Commissioner Brandimarte and Vice-Mayor Jones will only vote for one person when there are 21 applicants. Commissioner Brandimarte reiterated that her request to open the process to new candidates was refused,although the 21 have been turned down four times. The motion failed on the following 2-2 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Grace No Mayor Duke No Mayor Duke passed the gavel to Vice-Mayor Jones and motioned for each Commissioner to eliminate one applicant and pick from the remaining applicants; seconded by Commissioner Grace. The motion failed on the following 2-2 Roll Call vote: Commissioner Brandimarte No Vice-Mayor Jones No Commissioner Grace Yes Mayor Duke Yes Mayor Duke tabled this item until the next meeting. 10.2 Discussion to re-open the application process for the City Commission vacancy — Vice-Mayor Jones Vice-Mayor Jones noted this needs to be done because there was never a process in the first place; a workshop could have been held in order for the Commission to provide input toward that end. He commented he could say that the Mayor is a bully; he is trying to be a strong Mayor when we have a City Manager type government; he tried to dismiss the Vice-Mayor during a meeting, which does not show team spirit; and he contacted the Governor to intervene without discussing it with the Commission. By doing this, the Mayor has violated fiduciary trust, protocol, and the spirit of the Commission. He added the leadership should have come from the Mayor,but it did not. Vice-Mayor Jones motioned to re-open the application process to new applicants, those who have been previously vetted and voted on cannot apply,specific time periods to submit applications and interview candidates to be decided later; seconded by Commissioner Brandimarte. Discussion ensued regarding the process and ranking procedure used in 2006 and the way filling the current vacancy has been handled. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte provided an update on the Florida League of Cities conference she attended in Orlando. She noted her attendance at a Homeless in Florida workshop and questioned laws relating to solicitation in the roadway. City Attorney Ansbro noted he developed an ordinance to address panhandling by homeless people at traffic lights and he will bring it before the Commission. Chief Granville noted no one has been cited or arrested,but they have been asked to move. Commissioner Brandimarte concluded her update on the conference. 11.2 Commissioner Grace Commissioner Grace said she will respect everyone's opinion,just as she hopes they will respect hers. 11.4 Vice-Mayor Jones Vice-Mayor Jones commented on the Florida League of Cities conference in Orlando and the sessions he attended. Vice-Mayor Jones noted the vegetation and shrubbery on SW P Avenue is out of control, and asked City Manager Baldwin to look into the situation. 11.5 Mayor Duke Mayor Duke thanked Vice-Mayor Jones and Commissioner Brandimarte on their reports from the Florida League of Cities. Mayor Duke read a letter of compliment from the Pompano Beach Sail and Power Squadron, which hosted the ABC Safe Boating course in Dania Beach. 12. The decission should be made based on the UQ ALITY OF LIFE for the residence in the City of Dania Beach, and the most qualified applicant,who's credentials you have. That being said= COMMON SENSE should dictate that if you have applicants, or an applicant who is/are currently serving on major Boards in the City of Dania Beach, who have an understanding of the process (Will not need OJT), we think that he/she should be given greater consideration than the other applicants. In addition, if those applicants have a business background, a Law Enforcement background, and a history of Community service, and who are native Danians, those applicants should be given major consideration .
