HomeMy WebLinkAboutR-2013-097 Will Apply for Pump-Out Clean Vessell Act (CVA) Grant not to Exceed $120,000.00 for Municipal Marina Phase II Project RESOLUTION NO. 2013-097 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO APPLY FOR A PUMP-OUT CLEAN VESSEL ACT ("CVA") GRANT WITH THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION IN AN AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY THOUSAND DOLLARS ($120,000.00), SUCH GRANT TO PROVIDE ADDITIONAL FUNDING SOURCES AND APPROPRIATIONS FOR THE DANIA BEACH MUNICIPAL MARINA PHASE II PROJECT; AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A GRANT AGREEMENT UPON SUCCESSFUL GRANT AWARD TO THE CITY OF DANIA BEACH; PROVIDING FOR MATCHING FUNDS OF TWENTY-FIVE PERCENT (25%) AS REQUIRED BY THE GRANTING AGENCY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach is desirous to apply for a CVA Grant for a Project component of the Dania Beach Municipal Marina Phase II to cover the sewer pump-out facilities expense in the amount of$120,000.000 ; and WHEREAS, the Florida Department of Environmental Protection (FDEP) under a CVA Grant is accepting applications for eligible projects with 75% reimbursement, which requires a 25% local match; and WHEREAS, the City of Dania Beach has matching funds available and appropriated in the Marina Improvement Phase II account that are encumbered with the project's construction contractor and qualify as matching funds for the FDEP grant application; and WHEREAS, this grant will allow the City to construct a Sewer Pump-out Facility as an added component of the Dania Beach Municipal Marina Phase II Project, and this component is eligible for the FDEP Grant; NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the proper City officials are authorized to apply for a Pump-out CVA Grant with the Florida Department of Environmental Protection ("FDEP"), which Application is made a part of and is incorporated into this Resolution by this reference; it is attached as Exhibit"A". Section 2. That the City Manager and City Attorney are authorized to make minor revisions to such grant Application as are deemed necessary and proper for the best interests of the City. Section 3. That the Administration is authorized to use existing, available encumbered Marina Improvement Phase II construction appropriation in an amount of $30,000.00 (25% of the projected Pump-out total cost of $120,000.00) that are currently encumbered with the Pro'ect's construction contractor as matching funds for the in J g grant funding upon the successful FDEP award to and execution of grant documents by the City. Section 4. That the proper City officials are authorized execute an Agreement with the Florida. Department of Environmental Protection, if the City is successful with its application and receives an award of the ant. PP �' Section 5. That grant funding, if awarded to the City, shall be transferred and added to the Dania Beach Municipal Marina Phase II Project funding sources with a corresponding expenditure appropriation for installation of a Marina Pump-out system. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7. Public Access and Fees To receive CVA funds,facilities must provide public access to pumpout equipment.Fees to use the pumpout equipment cannot exceed$5.00 per vessel. ❖Business Registration All applicants for CVA grants(private businesses and government entities)must register with the State of Florida Department of Management Services vendor system.If you are not a registered vendor,register at: fts://vendor.myfloridamarke!place.com.Private businesses (not applicable to government entities)must also register with the State of Florida,Division of Corporations.If you are not registered,register at:hns://efile.sunbiz.org/onhnenu.htn-d Applications will not be processed without appropriate business registration. ❖Insurance All facilities(except self-insured,government entities)must be insured by carriers licensed in or eligible to do business in Florida,and must maintain applicable Commercial General Liability,Automobile Liability and Workers Compensation coverage.A current Certificate of Insurance that includes the Florida Department of Environmental Protection as an additional insured must be submitted with the grant application. Follow Insurance link for detailed information. ❖Permits Facilities must have any/all permits applicable to the pumpout project in place in order for DEP to process the application and approve funding.Failure to obtain required permits prior to placing a pumpout systenO/quipment into operation can result in enforcement actions and civil penalties. ❖Vendor Quotes Applicants must submit two written quotes for any equipment costs that exceed$2,500.Quotes must be submitted with the application form and approved before any work can begin. Site Visit Prior to approving funding for the purchase and installation of pumpout equipment,a DEP District Coordinator will visit your facility to determine if any permits are needed for your project,and to ensure the proposed pumpout location allows for proper sewage disposal.This is not a regulatory inspection,but it must be conducted to process the application and approve funding. Allowable Expenses Expenses for permits;construction,renovation;equipment purchase and installation;operations;maintenance and repair;sewage hauling;signage;and educational materials are allowed for reimbursement. Reimbursement Grant recipients are reimbursed 75%of the total,approved project cost and must provide a minimum of 25% of the total, approved project cost as match.Expenditures made prior to official DEP notification that you can begin the project will not be reimbursed. Reports A progress report is required during installation/construction Quarterly pumpout activity reports are required for five years following completion of the pumpout project.
