HomeMy WebLinkAboutR-2013-114 Amended Section 9.1 of Resolution 28-85 ''Addressing the Commission'' Applicable to Citizen Comments to be consistent with a new state law (Section 286.0114, Florida Statutes) RESOLUTION NO. 2013-114 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING SECTION 9.1 OF RESOLUTION 28-85 AS AMENDED, WHICH SECTION IS ENTITLED "ADDRESSING THE COMMISSION", TO REVISE THE PROCEDURES APPLICABLE TO CITIZEN COMMENTS AT CITY COMMISSION MEETINGS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Commission of the City of Dania Beach, Florida, wishes to amend section 9.1 of Resolution 28-85 entitled "Addressing the Commission" (as amended) in connection with citizen comments made at City Commission meetings, to be consistent with a new state law(Section 286.0114, Florida Statutes); and WHEREAS, the City Commission also desires to provide citizens and other interested persons wishing to address comments to the Commission on matters not appearing on the Commission agenda an opportunity to do so at each Commission meeting; NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That Section 9.1 of Resolution No. 28-85, which section is entitled "Addressing the Commission", as amended, is further amended to read as follows: Sec. 9.1 Addressing the Commission: dufing the pefied set aside for- " ' ." A thirty (30) minute "Citizen Comments" period shall be designated on the agenda for citizens and interested persons to speak on matters whether or not scheduled on that day's agenda. pr-effiptly at 7:30 Pr r Individuals wishing to speak on a matter not included on the "Public Hearing" section of the agenda, which matter pertains to an item before the City Commission which requires a decision of the City Commission, may do so by signing in and submitting_a form to that effect with the City Clerk prior to the meeting. Speakers at Public Hearings shall also submit such a form. Each speaker shall be limited to 3 minutes for his or her comments. Per-sons desir-ing te speak dufing the eitizen eemmei# period shall infefffl the Qt-y Clerk immediately prior- to the begifming of the fneefing ef their- intenfieft te speak.- If more than ten (10) speakers express a desire to speak, the Commission shall determine on a meeting by meeting basis whether to (a) extend the time allotted for citizen comments to accommodate all speakers, or (b) whether to limit the number of speakers or amount of time per speaker. A speaker's time shall not be transferable to another speaker. Section 2. That all sections or parts of sections of the City Code of Ordinances, all charter sections or parts of such Charter sections and all resolutions or parts of resolutions in conflict with the foregoing are repealed to the extent of such conflict. Section 3. That if any word, phrase, clause, subsection or section of this resolution is for any reason held unconstitutional or invalid, the invalidity shall not affect the validity of the original Resolution or this Resolution.
