Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Bobbie H. Grace Asst. City Manager: Colin Donnelly City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event request for the "8th Annual Dania Beach Vintage Motorcycle Show" to be held on Saturday, January 25, 2014, at Frost Park from 10:00 a.m. to 5:00 p.m. The applicant is requesting a road closure for Fronton Boulevard from N.E. 2"d Street to N.E. 1st Street, between 6:00 a.m. - 5:00 p.m.; a special event fee waiver of $150.00; Message Board provided by BSO; and assistance from the Parks and Recreation Department at Frost Park. Commissioner Grace motioned to approve the Special Event request for the 8th Annual Dania Beach Vintage Motorcycle Show, including the street closure, few waiver, message board, and use of city staff; seconded by Vice-Mayor Jones. The motion carried on the following 4-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Grace Yes Mayor Duke Yes 3.2 Presentation by the Dania Beach Professional Arts and Cultural Alliance (PACA) Founding members Robert Miller and Stacy Brown noted the Professional Arts and Cultural Alliance (PACA) is a 501(c)3 non-profit organization serving both property and business owners of the Dania Beach Business, Antique and Arts District. The group is primarily small downtown business owners and professionals who would like to provide their professional arts and cultural experience to build a more caring business and community. More information may be obtained from their website http://daniafirst.com. Mayor Duke advanced the public hearing for the airport settlement agreement. 9.4 ORDINANCE #2013-014 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A SETTLEMENT AGREEMENT IN COMPLIANCE WITH CITY CHARTER REQUIREMENTS, WITH BROWARD COUNTY, FLORIDA, RELATED TO LITIGATION EXISTING BETWEEN THE PARTIES IN CONNECTION WITH CONSTRUCTION OF A NEW SOUTH RUNWAY AT FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) City Attorney Ansbro read the title of Ordinance#2013-014. Neal McAliley, Airport Special Counsel, provided an overview of the settlement agreement, which was included in the agenda packet. He noted that a unanimous vote of the Commission is required to adopt the ordinance, and explained the reasons the settlement team recommends approval. He further provided details of the benefits to the residents and to the City itself under this agreement. Mayor Duke opened the Public Hearing. Troy Thomassen, 4711 SW 34d' Drive, commented that ocean access property values have already gone down and questioned how long the voluntary night closings would last. He urged the County not to approve this settlement and asked the Commission to consider not approving it also. Rae Sandler, Melaleuca Gardens, felt this was a pretty good proposal and suggested that everyone take the soundproofing offered by the County. Randy Wright, NW 34 h Lane, asked what quality of life is worth, and noted that planes will be 325 feet above his head and will destroy his quality of life. He expressed safety and health concerns, and urged the Commission to reject the settlement. He asked what would happen to the residents' mortgages if they take the payout. Clive Taylor, 642 NE 3ra Street, said this matter has been going on too long and we should follow the advice of our counsel. Christine Douglas, Davis Isles, said her neighborhood is hoping they will be included in the next soundproofing. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,October 22,2013—7:00 p.m. David Hoyt, President of Oaks of Hidden Harbor HOA, noted they feel a fair settlement has been reached and urged the Commission to approve it. Dawn Reed, 2724 SW 45d` Street, encouraged the Commission to approve the settlement. Attorney McAliley addressed some of the questions and comments posed by the residents. He noted the settlement provides more options for the residents and nothing in the agreement prevents them from suing the County to seek compensation for the loss of property value. He elaborated on the issues raised about the voluntary night closure and residential mortgages. Vice-Mayor Jones questioned what happens if the agreement is violated once the south runway is opened. Attorney McAliley responded the City would go back to court to enforce the agreement. Bruce Hannover, 617 NE 2nd Place, urged the Commission to vote for the settlement. Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public Hearing. Vice-Mayor Jones motioned to adopt Ordinance #2013-014, on first reading; seconded by Commissioner Brandimarte. Vice-Mayor Jones noted the runway will open and there will be people who will suffer; his concern is for the people who will receive no benefit. At this time, he feels it would be the right decision to go forward. Commissioner Grace said she does not think this is the best deal for Dania Beach and would like to see everyone get something out of this deal. While she appreciates the phone calls from residents, both for and against this agreement, she presently does not support it. Commissioner Brandimarte commented she supports this agreement because it puts control in the hands of the residents. Mayor Duke felt, on balance, this is a good agreement, but he understands the quality of life issues for the affected residents. He noted the County is behind schedule on the sound insulation program, which causes concern about how far behind they might be with the other issues involved. He supports the agreement, but would like a better plan to address the health risks. Anne Castro stated there would be no going back to the table for negotiation; if the Commission does not approve this agreement, then the only choice is court. Attorney McAliley noted the health issues have been raised and were brought out by the concerns of the residents. He reviewed the provisions in the agreement that address health issues and reiterated we are not going to get anything substantially better in court. He stressed that if all four Commissioners do not vote yes tonight, this is over and we go back to court. He Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,October 22,2013—7:00 p.m. clarified this settlement is a result from the lawsuit; the Commission can vote yes tonight and some of these issues could be deliberated prior to the second reading. He encouraged the Commission to take this deal as there are no guarantees of doing better in court. Mayor Duke said the health issue is the most important issue. The second issue raised is legal fees; he would like an explanation in writing of how feasible it is to hit the hurdles for the CRA loan benefit. The third issue is the lack of representation on the Commission, and he questioned the legality of the Commission vote. He noted he has a problem with approving this without a five-member commission as it would leave us vulnerable to a lawsuit. Commissioner Grace said the City Attorney assured her that the Commission could vote as a body of four on the agreement, and it would be legal and binding. City Attorney Ansbro confirmed that the four seated Commissioners could vote on the agreement. Commissioner Grace noted she does not support the decision that the Commission will make tonight, but we will do the best we can for the residents. Vice-Mayor Jones rescinded his motion. City Attorney Ansbro urged the Commission to approve the ordinance on first reading. Vice-Mayor Jones said the Mayor is holding the City hostage until the fifth commissioner is seated, and he addressed the health and litigation fees issues raised. Commissioner Grace commented there is no reason for anyone to come back to the podium because the best possible thing to do is motion to approve the ordinance. Commissioner Brandimarte questioned how much money has been spent on this issue, how many more millions must be spent before we settle, and why we are not listening to our attorneys. Commissioner Grace motioned to adopt Ordinance #2013-014, on first reading; seconded by Vice-Mayor Jones. Mayor Duke addressed the board vacancies on the agenda tonight and also addressed the Commission vacancy. He felt the Commission is not fully representative on the issues coming before it, and he is not for the appointment to any of the board vacancies until a fifth commissioner is seated. He asked for a motion to settle this issue tonight and come back in two weeks. Proclamations 4.1 Breast Cancer Awareness Month Commissioner Grace read the proclamation for Breast Cancer Awareness Month. 5. Citizen Comments Leon Carroll, 109 NW 11t' Avenue, invited everyone to the Patch Garden on Saturday, October 26, for Food Day, which will include samples of food grown in the garden. Memorial Health Services will also be there for health screenings and to assist those without insurance. Jeffery Bennett, 126 NW 8d` Avenue, spoke on behalf of John Paul Alvarez, candidate for State Representative for District 100. Charles Camacho, 121 NE P Street, reported on the wires at NE 2"d Place and NE 2"d Avenue and noted they are getting lower because the poles are starting to bend over. He added he is the Chairman for this year's Relay for Life. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, reported on thefts and burglaries in the City. He reminded everyone that Operation Medicine Cabinet, including a Shred-A-Thon, will be held this weekend. He mentioned recent emails he received, and said that he and his staff are not involved in politics. 7. Discussion and Possible Action 10.1 City Commission Vacancy—Mayor Duke Mayor Duke asked if anyone wanted to set up a workshop in the next two weeks. There was no response from the Commission. Mayor Duke noted that David Nuby Jr. has withdrawn his name from the list of applicants. Mayor Duke said this would be continued to the next meeting and asked the City Clerk to poll the Commission to see if they are available for a workshop within the next two weeks. 10.2 Discussion to re-open the application process for the City Commission vacancy — Vice-Mayor Jones Vice-Mayor Jones motioned to reopen the application process; seconded by Commissioner Brandimarte. Mayor Duke noted we have 19 applicants and he has never received an answer as to why they are not qualified. Commissioner Brandimarte noted that the Commission has not voted to allow Bryan Cowart back into the applicant pool. Vice-Mayor Jones motioned to not allow Bryan Cowart back onto the list of applicants; seconded by Commissioner Brandimarte. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte had no comments. 11.2 Commissioner Grace Minutes of Regular Meeting g 9 Dania Beach City Commission Tuesday,October 22,2013—7:00 p.m. Commissioner Grace had no comments. 11.4 Vice-Mayor Jones Vice-Mayor Jones requested a traffic study be conducted to see if a school zone on Stirling Road, from Bryan Road to Phippen Waiters Road, was needed. Vice-Mayor Jones commented the sidewalks on Phippen Waiters Road need repair. Vice-Mayor Jones commented on Waste Management not picking up bulk waste on the designated days in the southeast and southwest areas. Vice-Mayor Jones felt there has been a lax in code enforcement; he would like to know if there is a problem in Code Compliance. Vice-Mayor Jones reported on the Broward League of Cities meeting where items discussed included the gambling compact, CRA Enterprise Zone, insurance tax, and red-light cameras. Vice-Mayor Jones commented the Town Hall Meeting was well-attended. Two pertinent issues were school zone traffic and the other was dealing with the lake in College Gardens; residents want to know if the City can clean it up. He proposed that we have Town Hall meetings in the west also; staff does not necessarily need to attend. 11.5 Mayor Duke Mayor Duke clarified there is no ban on traveling; only on using taxpayer dollars to do so. He responded to Vice-Mayor Jones' remark about him made during the settlement agreement discussion. Mayor Duke noted the CRA's contribution in highlighting the City in the New Alliance Annual Economic Resources Book; additionally, the City has recently been featured in two other magazines. He added he is receiving positive reaction from the traffic signal box wraps. 12. Appointments 12.1 Selection of Vice-Mayor for term beginning November 12, 2013 Commissioner Grace motioned to appoint Commissioner Brandimarte; seconded by Vice- Mayor Jones. The motion carried on the following 3-1 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Jones Yes Commissioner Grace Yes Mayor Duke No Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,October 22,2013—7:00 p.m. Mayor Duke noted he will not support any board appointments for the Commission vacancy. 12.2 Airport Advisory Board Vice-Mayor Jones— 1 appointment 3 appointments - Commission vacancy (Bob Lizana, Thomas Hart and David Clark would like to be reappointed) Vice-Mayor Jones motioned to appoint David Clark to the Airport Advisory Board; seconded by Commissioner Brandimarte.
