MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, NOVEMBER 12, 2013 —7:00 P.M. 1. Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Chickie Brandimarte Commissioners: Bobbie H. Grace Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special event request from the Dania Beach Lions Club for a "Quarterdeck Moonlight Classic Car Show" to benefit the Nicholas James Costello Scholarship Foundation. The event will be held on Saturday, November 16, 2013 from 5:00 p.m.-10:00 p.m., at the Dania Beach North end parking lot. The applicant is requesting a special event fee waiver of $150.00, parking fees waived for event volunteers, use of the Dania Beach North end parking lot, and barricades from Public Services. Commissioner Grace motioned to approve the Special Event request for Dania Beach Lions Club Quarterdeck Moonlight Classic Car Show; seconded by Commissioner Jones. The motion carried unanimously. 4. Proclamations 4.1 Nova Southeastern University's 50'h Anniversary Day Mayor Duke noted the proclamation will be forwarded to Nova Southeastern University. 5. Citizen Comments Mark LaRocca, 4511 SW 34th Avenue, urged the Commission to reappoint the members of the Airport Advisory Board. Ann Page, 38 SW 5th Street, complained of the sign on the Holiday Inn Express Hotel. She asked the Commission to adopt the old sign code. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, thanked Mayor Duke and Commissioner Jones for attending the Shred-A-Thon and Operation Medicine Cabinet event. He advised of robberies by sudden snatching involving iPhones. 7. CONTROLS,INC.;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Commissioner Grace motioned to adopt the Consent Agenda; seconded by Commissioner Jones. The motion carried unanimously. 8. Bids and Requests for Proposals 8.1 RESOLUTION#2013-134 A RESOLUTION OF THE CITY COMMISSION OF DANIA BEACH, FLORIDA, AUTHORIZING THE CITY ADMINISTRATION TO PURCHASE A SHADE SHELTER FOR THE C.W. THOMAS PARK PLAYGROUND IN AN AMOUNT NOT TO EXCEED $39,180.00 FROM SHADE SYSTEMS INC., USING AVAILABLE PRICING PROVIDED BY ST. JOHN'S COUNTY CONTRACT BID NO. #11-60; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-134. Commissioner Jones motioned to adopt Resolution #2013-134; seconded by Commissioner Grace. Commissioner Jones questioned if the shelter would be taken down during storms, its durability, the warranty, and how it is connected and put in place. Mark Felicetty, Director of Parks and Recreation, responded it is rated 99% UV protection, has a 20-year structural warranty and 10-year canopy warranty, and is on a slide system so the canopy can be removed during storms. He confirmed it is a galvanized steel structure and is self- supporting. The motion carried unanimously. 9. Public Hearings and Site Plans 9.1 ORDINANCE#2013-014 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A SETTLEMENT AGREEMENT IN COMPLIANCE WITH CITY CHARTER REQUIREMENTS, WITH BROWARD COUNTY, FLORIDA, RELATED TO LITIGATION EXISTING BETWEEN THE PARTIES IN CONNECTION WITH CONSTRUCTION OF A NEW SOUTH RUNWAY AT FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. SECOND READING � ) City Attorney Ansbro read the title of Ordinance#2013-014. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,November 12,2013—7:00 p.m. Neal McAliley, Airport Special Counsel, provided an overview of the proposed airport settlement agreement. He noted that a unanimous vote of the Commission is required, and urged them to approve the agreement. He said we are unlikely to do better in a litigated outcome, and from his perspective,the City should take this for what it does for the residents. Mayor Duke opened the Public Hearing. Ted Testerman, 3371 SW 44th Street, spoke against the agreement because he does not trust Broward County. He thought the Commission should fight more for the residents. Wendy Wood, 845 NW loth Avenue, applauded the Commission for fighting for the residents and urged them to vote for the agreement. Leslie Carhart, 846 Argonaut Isle, spoke in favor of the agreement. Rae Sandler, 1433 Argonaut Isle, spoke in favor of the agreement and urged the Commission to do what is right for the residents. Wesley Ruggles, Jr., 3080 SW 46th Court, asked if anyone ever challenged the validity of the curves of the sound pressure levels provided by the FAA, and if there was a mechanism in the agreement that spells out the ground rules for conditions that are worse than expected. Alexsandra Bloir, 3080 SW 4e Court, questioned how the airport could operate before the soundproofing is installed in all homes. She asked if the residents could contact contractors on their own to provide estimates and perform the work, and then be reimbursed by the County. Barbara Estep, 958 Nautilus Isle, spoke in favor of the settlement agreement. Ian Richter, 906 Nautilus Isle, questioned the location of the terminals and asked what the residents can do if they cannot sue in the future. Giancarlo Ricchi, 301 NE 5th Court, commented the residents should have a right to sue the County and FAA after the consequences of the expansion are known. Irene Lathrop, 818 NW 1 Oth Avenue,urged the Commission to approve the agreement. Alan Ray, 1409 Argonaut Isle, asked the Commission to support the settlement agreement. John Earle, 2869 Hidden Harbour Court,urged the Commission to approve the agreement. Gary Jordan, 2965 Hidden Harbour Street, representing the Oaks of Hidden Harbor, urged the Commission to approve the agreement. Clive Taylor, 642 NE 3rd Street,asked the Commission to approve the agreement. Steve Wiesner, 2837 Hidden Harbor Court,urged the Commission to approve the agreement. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,November 12,2013—7:00 p.m. Mark LaRocca, 4511 SW 34 Avenue, said we need to pass this agreement because it is in the best interest of the residents. Attorney McAliley answered questions posed by the residents: ➢ It is unknown if property taxes will decrease ➢ Any adverse effects on lifestyle would be because the runway is getting built and not from the City entering into this agreement ➢ This settlement agreement provides real actions compared to just words in the ,1995 Interlocal Agreement relative to flight restrictions ➢ FAA analysis of the noise impacts was challenged in the lawsuit against the Army Corps of Engineers ➢ The Part 150 study is governed by federal law and would be based upon the current fleet mix ➢ Regarding the Dania Beach noise ordinance, Federal law preempts state and local law when it comes to airports ➢ Broward County, not the City, is doing the sound insulation and it is up to the County to speed it up ➢ Broward County's position is homeowners cannot do the sound insulation themselves if they want the County to pay for it ➢ The agreement not to sue Broward County in the future is limited to dropping the two lawsuits related to the south runway expansion and the City agreeing to not challenge specific plans for terminals within the existing terminal complex ➢ This settlement gives more options to residents, but it is not taking away their individual rights Charles Camacho, 121 NE 3rd Street, noted the County Commission has animosity toward cities that are suing them. Troy Thomassen, 4711 SW 30'Drive, expressed concern with the amount of money the County is allocating per home for soundproofing; he is also concerned with increased traffic and health concerns. Attorney McAliley responded the County is agreeing to do soundproofing and pay for it; if they do not use the amounts estimated, the funding is not available to be used for other items. By putting the program in the agreement, the County is locked into doing the soundproofing, and residents who were initiallyoffered soundproofing and turned it down, will now et a second P g g chance. Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public Hearing. Commissioner Jones motioned to adopt Ordinance#2013-014, on second reading; seconded by Vice-Mayor Brandimarte. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,November 12,2013—7:00 p.m. Commissioner Grace made several comments and asked Attorney McAliley to come back to the podium to answer her questions. Attorney McAliley responded to questions on parcels 7 & 8; the Hilton Hotel property; lawsuits and attorney's fees; the CRA extension element; the City getting everything we wanted; NE section benefits; what happens if the settlement agreement is not approved tonight; and County and FAA approval time limits. Commissioner Jones felt this is the best we can do in the City of Dania Beach, and we need to move forward. Vice-Mayor Brandimarte said the right thing is to pass this unanimously. Mayor Duke commented he wants to get this settlement done, which he feels is as good as we can get. One of the issues of concern was the conveyance and release agreement, and he urged everyone to seek legal advice. He read aloud a response he received from his own attorney regarding the conveyance and release agreement. He said his second issue is the CRA loans; he thinks it is a benefit, and it incentivizes the Commission to encourage and promote redevelopment. The motion carried on the following 4-0 Roll Call vote: Commissioner Grace Yes Vice-Mayor Brandimarte Yes Commissioner Jones Yes Mayor Duke Yes 10. Discussion and Possible Action 10.1 City Commission Vacancy—Mayor Duke Mayor Duke asked the Commission to appoint one of the 17 applicants. Commissioner Grace motioned for James Ridgely; seconded by Mayor Duke. The motion failed on the following 2-2 Roll Call vote: Commissioner Grace Yes Vice-Mayor Brandimarte No Commissioner Jones No Mayor Duke Yes Mayor Duke noted he is against opening the application process. He said he is willing to work with 14 of the 17 applicants, and added he cannot get two Commissioners to get off their one applicant. He asked if anyone is willing to work with his 14 applicants. Commissioner Grace suggested putting the 14 names in a hat and picking one. Commissioner Jones said the Mayor could define a process. He spoke of the lack of a process, noting he is stuck on the fact the Commission never agreed on one. He asked to reopen the Minutes of Reg ular Meeting 6 Dania Beach City Commission Tuesday,November 12,2013—7:00 p.m. process and move forward, or include the 18 in the mix,reopen the application process and move forward. He suggested going back to workshop and talk about how the Commission will set a process and shortlist. Commissioner Jones motioned for Paul Fetscher; seconded by Vice-Mayor Brandimarte. The motion failed on the following 2-2 Roll Call vote: Commissioner Grace No Vice-Mayor Brandimarte Yes Commissioner Jones Yes Mayor Duke No Mayor Duke said people do not like the fact that two Commissioners are locked in on one applicant. Vice-Mayor Brandimarte commented that some of the applicants spoke in favor of opening up the application process. 10.2 Discussion to re-open the application process for the City Commission vacancy — Commissioner Jones Commissioner Jones said he would not discuss this again. 11. Commission Comments 11.2 Commissioner Jones Commissioner Jones thanked the citizens for allowing him to serve as Vice-Mayor for the past year and as a Commissioner for the next three years. Commissioner Jones commented he attended the Florida Redevelopment Association Conference in Tampa and the CRA received two awards, one for the Patch Garden and the other for redevelopment. Commissioner Jones thanked the City for supporting him at the African American Research Library and Cultural Center event,where he was one of 15 honorees. 11.1 Commissioner Grace Commissioner Grace commented on the first annual Oktoberfest at C.W. Thomas Park. Commissioner Grace encouraged everyone to support the Lions Club. 11.3 Vice-Mayor Brandimarte Vice-Mayor Brandimarte spoke of the recent FRA Conference she attended. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,November 12,2013—7:00 p.m. Vice-Mayor Brandimarte said she noticed COP cars parked in the garage, and therefore they are not being seen in the City. She addressed issues with the way the program is being run and noted volunteers are dropping out. She asked the City Manager why the cars are in the garage. City Manager Baldwin responded he does not control the BSO COP program, but if the Commission wants the cars removed from the parking garage,he will speak to the sheriff. Mayor Duke noted there were a lot of problems with the COPS program, which is why it was modified. 11.4 Mayor Duke Mayor Duke had no comments. 12. Appointments Airport Advisory Board Commissioner Jones— 1 appointment Commission Vacancy—3 appointments Commissioner Jones motioned to appoint Betty Sokol to the Airport Advisory Board; seconded by Commissioner Brandimarte. The motion carried unanimously. Commissioner Jones motioned to reappoint former Commissioner Flury's appointments to the Airport Advisory Board; seconded by Commissioner Brandimarte. The motion failed 2-2. Creative Arts Council Advisory Board Commission Vacancy— 1 appointment Commissioner Jones motioned to reappoint former Commissioner Flury's appointment; seconded by Commissioner Brandimarte. The motion failed 2-2. Dania Beach Housing Authority_ 1 Mayor appointment to fill a 4 year term Mayor Duke motioned to appoint Brenda Lowary to the Dania Beach Housing Authority; seconded by Commissioner Grace. The motion carried unanimously.
