DANIA BEACH CITY COMMISSION
ABATEMENT HEARING
THURSDAY, NOVEMBER 21, 2013 — 6:00 P.M.
1. Call to Order
Vice-Mayor Brandimarte called the meeting to order at 6:02 p.m.

3. Abatement Requests
3.1 Consideration of the abatement request for Mosh LLC c/o Holocaust Documentation
and Education Center, for property located at 303 N Federal Highway, Case#10-1057
(Folio #0234-06-0730)
Attorney Tim Ryan noted this case originally involved 11 violations, but went to the Special
Magistrate for 4 violations: asphalt in disrepair, docking platform and rear of the building have
holes in them, the fence needs inspections, and the dumpster needs to be in an approved
dumpster enclosure. The fines ran for 648 days for a total of$129,854.00, including recording
fees. The Special Magistrate recommends abatement of$12,960.00.
Senator Steve Geller, representing the Holocaust Museum, requested abatement to costs of
$7,500.00, as determined by staff.
Commissioner Jones motioned to abate the lien to $7,500.00, to be paid in 60 days;
seconded by Commissioner Grace. The motion carried on the following 3-0 Roll Call vote:

3.2 Consideration of the abatement request for 2950 Griffin Road LLC c/o Angela
Suleymanova, for property located at 2950 Griffin Road, Case #12-0253 (Folio #02-
32-14-0160)
Attorney Ryan noted this case involved 8 violations, but went to the Special Magistrate for 7
violations: demolished bathroom with exposed plumbing, trash and litter, mobile MRI trailer on
the property without a valid license plate and a MRI trailer is not a permitted use,no business tax
receipt for the rental units, and repairs to the electrical and air conditioning unit were performed
without permits. The fines ran for 206 days for a total of$41,407.50, including recording fees.
The Special Magistrate recommends abatement of$8,000.00.
Commissioner Grace motioned to abate the lien to $8,000.00, as recommended by the
Special Magistrate, to be paid in 60 days; seconded by Commissioner Jones. The motion
carried on the following 3-0 Roll Call vote:

3.3 Approval of the settlement received for Al Bartosh and Bank of America for property
located at 203 SE 2 Street, Case #s 06-1452, 2012-0308, & 2013-0186 (Folio #0234-
18-0370)
Attorney Ryan noted the City received $9,635.05 as settlement for the code cases due to
foreclosure.
Commissioner Jones motioned to accept the settlement, as recommended by Attorney
Ryan; seconded by Commissioner Grace. The motion carried on the following 3-0 Roll
Call vote:

3.4 Approval of the settlement received for Patricia Devanny for property located at 54
SW 14 Street, Case#10-0284 (Folio#1203-10-5960)
Attorney Ryan noted the City received $4,500.00 as settlement for the code cases due to
foreclosure.
Commissioner Jones motioned to accept the settlement, as recommended by Attorney
Ryan; seconded by Commissioner Grace. The motion carried on the following 3-0 Roll
Call vote:

Commissioner Jones motioned to excuse the absence of Mayor Duke; seconded by
Commissioner Grace. The motion carried.
Attorney Ryan introduced his new associate Eric Abend.
4. Adjournment
Vice-Mayor Brandimarte adjourned the meeting at 6:20 p.m.
