RESOLUTION NO. 2013-150 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE SITE PLAN(SP-45-13)SUBMITTED BY BRIDGE DEVELOPMENT PARTNERS, LLC, ON BEHALF OF BRIDGE MARINA MILE, LLC, PROPERTY OWNER, FOR PROPERTY LOCATED ON THE WEST SIDE OF SW 26 TERRACE,BETWEEN I-595 AND SW 36 STREET IN THE CITY OF DANIA BEACH,FLORIDA;PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 28, Part 6 of the Dania Beach Land Development Code ("LDC"), Article 635, entitled "Development Review Procedures and Requirements", states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Bridge Development Partners is requesting site plan approval to allow the construction of a 189,620 square feet warehouse building that will contain office uses ten percent (10%),warehouse uses eighty-three percent(83%)and accessory distribution seven percent(7%)to be located on the west side of SW 26 Terrace,between I-595 and SW 36 Street in the City of Dania Beach; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That that certain application (SP-45-13) for site plan approval, a copy of which is attached as Exhibit"A",which is made a part of and incorporated into this Resolution by this reference, is approved. Section 2. That based upon the criteria set forth in Section 635 of the Dania Beach Land Development Code, all site plan approvals shall automatically expire and become null and void unless the applicant files a complete building permit application with construction drawings for all improvements shown on the site plan,within eighteen(18)months from the date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. Earlier this year, the applicant obtained approval on a delegation request to amend the plat note to restrict the use on the property to 250,000 square feet of industrial use with a maximum of thirty(30%) percent ancillary office use, and 20,000 square feet of office. The applicant is requesting site plan approval to construct a 189,620 square feet warehouse building that will contain office uses (10%), warehouse uses (83%) and accessory distribution (7%).
