Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Chickie Brandimarte Commissioners: Bobbie H. Grace Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals Commissioner Grace motioned to approve all the items; seconded by Vice-Mayor Brandimarte. 2. Special event request from the Law Office of Russel Lazega, P.A., for a "December to Remember Holiday Party", to be held at 45 East Sheridan Street on December 11, 2013 from 5:30 p.m. - 8:00 p.m. Commissioner Jones questioned possible liability exposure due to liquor being given away. City Attorney Ansbro responded there would be no liability to the City. Commissioner Grace commented her understanding is that when a City facility is rented and there is alcohol involved, there has to be a licensed bartender. Commissioner Grace motioned to approve the Special Event request for the Law Office of Russel Lazega, P.A. December to Remember Holiday Party; seconded by Vice-Mayor Brandimarte. The motion carried unanimously. 5. Approve the Parks, Recreation and Community Affairs Advisory Board recommendation for a $600.00 rental fee waiver for use of the I. T. Parker Community Center by the Tiger Fund Organization on June 7, 2014. Vice-Mayor Brandimarte noted access to the website given on their flyer is forbidden. John Venezia, 7900 NW 18th Place, Margate, noted this is an event the organization sponsors every year; the original founder recently passed away, which is why the website is restricted at this time. Commissioner Grace motioned to approve the I. T. Parker Community Center fee waiver for the Tiger Fund Organization; seconded by Commissioner Jones. The motion carried unanimously. 1. Florida Redevelopment Association 2013 Roy F. Kenzie Awards for the Dania Beach Community Redevelopment Agency(CRA) Mayor Duke spoke of the two awards received by the Dania Beach CRA: Cultural Enhancement for Cultural Arts Initiatives, including the Arts and Seafood Festival; and Out of the Box for the Dania Beach PATCH (Peoples Access to Community Horticulture). Jeremy Earle, CRA Director, gave a brief overview of the awards received from the Florida Redevelopment Association. Commissioner Grace noted she will push for the art walkways that were discussed in the workshop with the Creative Arts Council Advisory Board. 3. Special event request from Friends of the Library for the "Walk for the Dania Beach Paul DeMaio Library", to be held Saturday, January 25, 2014 from 8:00 a.m. - 11:00 a.m. This is a fundraising event for the Library, and the applicant is requesting a Special Event fee waiver for $150.00, and BSO escort detail. Commissioner Grace motioned to approve the Special Event request for the Friends of the Library Walk for the Dania Beach Paul DeMaio Library, including permit fee waiver and BSO detail; seconded by Commissioner Jones. The motion carried unanimously. Commissioner Jones questioned Item #7.5 on the Consent Agenda; in particular, the disposition of leftover funds from the previous year. Captain Kevin Granville, BSO Chief of Police, responded the money was used for the summer break program for school children. Commissioner Jones said he would like this year's dollars to be utilized for that program. Commissioner Grace suggested any monies remaining from last year be combined with the upcoming year's funds to further the summer program. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,December 10,2013—7:00 p.m. 4. Special event request from TNT Fireworks to install a temporary canopy to operate a "Return Center" at 768 East Dania Beach Boulevard from December 31, 2013 - January 5, 2014, from 9:00 a.m. to 5:00 p.m. Commissioner Grace motioned to approve the Special Event request from TNT Fireworks to install a temporary canopy to operate a Return Center; seconded by Commissioner Jones. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Jimmie Peterman, 717 SW 4d' Terrace, addressed landscaping on the corner of Phippen Waiters Road and tree trimming in the area. Terry Hale-Hicks, 331 SW 2nd Avenue, thanked the Commission for the Community Garden Event with Memorial Health Care because it saved the life of her neighbor, Mr. Johnson. Bob Mikes, 601 NW 7`h Street, addressed the issue of trees that had been cut along Old Griffin Road by Competition Motorcycle. He requested that guard rails be installed along the road to prevent vehicles from driving into the canal and to stop illegal dumping. Mr. Mikes also noted that additional site plan review and tree canopy is needed for future projects along the runway expansion. Ann Page, 38 SW 5d' Street, thanked everyone involved in the PACA event on Saturday night. She said the Friends of the Library would like to partner with the American Legion for the sale of alcohol at the Arts and Seafood Festival this year. Pat Rafacz, 610 Trafalgar Court, provided information on healthcare that is available to residents from Memorial Healthcare in Dania Beach. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, reviewed some of the 2013 accomplishments, which included the City's first crime symposium, back-to-school giveaway program, and updating the COP program. He noted residential and conveyance burglaries have declined, but street robberies are increasing slightly. 7. Addendum Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,December 10,2013—7:00 p.m. 7.7 RESOLUTION#2013-155 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING ADDITIONAL EXPENDITURES RELATED TO COSTS AND EXPENSES ASSOCIATED WITH THE FORT LAUDERDALE-HOLLYWOOD AIRPORT LITIGATION; PROVIDING APPROPRIATION OF ADDITIONAL FUNDS IN AN AMOUNT OF $115,000.00 FOR SUCH ITEMS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Commissioner Grace motioned to adopt the Consent Agenda, with the addition of Item #7.7; seconded by Commissioner Jones. Public Hearings and Site Plans City Attorney Ansbro advised the remaining items were quasi-judicial hearings and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. 9.1 RESOLUTION#2013-148 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE APPLICATION FOR A SPECIAL EXCEPTION(SE-61-13)FROM SECTION 835.50 OF THE CITY LAND DEVELOPMENT CODE,AND VARIANCE REQUESTS(VA-62-13NA-63-13)FROM SECTIONS 205.10 AND 835.50 OF THE CITY LAND DEVELOPMENT CODE, SUBMITTED BY ROBERT D. PRITT, REPRESENTING THE PROPERTY OWNER, FLORIDA POWER & LIGHT COMPANY, FOR PROPERTY LOCATED AT 760 NE 7'H AVENUE IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-148. Corinne Lajoie,Principal City Planner, provided an overview of the requests. Mayor Duke opened the Public Hearing. FOR PROPERTY LOCATED AT 303 NORTH FEDERAL HIGHWAY IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2013-149. Corinne Lajoie, Principal City Planner, noted the applicant has received approval from the FEC to use their land for vehicle circulation, and a parking agreement must be in place prior to issuance of building permits. Merrill Romanik, with Synalovski, Romanik, Saye, and Rosita Kenensberg, Holocaust Documentation and Education Center, Inc., noted this will be the first holocaust museum in South Florida, and the first that provides information in English and Spanish. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Discussion and Possible Action 1. SE Stormwater Drainage - Meadowbrook Easement Dominic Orlando, Director of Public Services, provided a history of the process to alleviate the flooding in the southeast neighborhood. He said the project has been delayed due to the easement required from Meadowbrook, but Phase I will be bid soon; additional engineering is needed before the bidding of Phase II. He noted this project will not stop flooding, but it will reduce the intensity. Vice-Mayor Brandimarte noted the Meadowbrook Board will not meet until this Saturday to discuss and approve the easement. City Attorney Ansbro commended Mr. Viviano for his persistence on working with the Meadowbrook Board. City Attorney Ansbro recommended the Commission adopt a resolution as follows: RESOLUTION#2013-156 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA (THE "GRANTEE"), ACCEPTING AN AMENDED AND RESTATED EASEMENT FROM MEADOWBROOK LAKES VIEW CONDOMINIUM ASSOCIATION "A", INC., A FLORIDA NON-PROFIT CORPORATION (MEADOWBROOK "A") AND A UTILITY EASEMENT AGREEMENT FROM MEADOWBROOK LAKES VIEW CONDOMINIUM ASSOCIATION "B", INC., A FLORIDA NON-PROFIT CORPORATION (MEADOWBROOK "B") FOR PURPOSES OF DRAINAGE, WATER MAIN, STORM WATER, AND OTHER SIMILAR FUNCTIONS FOR THE BENEFIT OF THE GRANTORS, THE GRANTEE AND THE REAL PROPERTY DESCRIBED IN EXHIBITS "B" AND "D" ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS;AND FURTHER;PROVIDING FOR AN EFFECTIVE DATE. Commissioner Jones motioned to adopt the proposed Resolution #2013-156; seconded by Vice-Mayor Brandimarte. The motion carried unanimously. 2. Discussion to change meeting schedule or eliminate Abatement Hearings Vice-Mayor Brandimarte suggested holding the meetings prior to the CRA Board meetings on a quarterly basis. City Attorney Ansbro clarified the Commission would meet every three months for Abatement Hearings. The consensus of the Commission was to hold Abatement Hearings every three months prior to regular CRA Board meetings. Commission Comments 11.1 Commissioner Grace Commissioner Grace wished everyone happy holidays. 11.2 Commissioner Jones Commissioner Jones commented on some of the tree trimming throughout the City, and felt it should be done uniformly and consistently. Commissioner Jones requested information on grant dollars received by the City. Commissioner Jones commented on the Holiday Lighting Event. Commissioner Jones asked about the status of the baseball dugouts at Meli Park. Mark Felicetty, Director of Parks & Recreation, noted the project should be completed by next Friday. Commissioner Jones asked when the Southwest Center would be painted and signage installed. City Manager Baldwin noted paint estimates are being obtained. Commissioner Jones questioned whether Danians have been successful in obtaining jobs in the City. Commissioner Jones commented Dania Jai Alai is hiring and we need to know where Danians can apply. Commissioner Jones wished everyone happy holidays. 11.3 Vice-Mayor Brandimarte Vice-Mayor Brandimarte addressed the issue that Dania Jai Alai was supposed to hold a Job Fair,which was discussed at the last CRA Board meeting. Vice-Mayor Brandimarte said Frost Park is a mess because the landscapers are blowing the grass cuttings onto the basketball and tennis courts. Vice-Mayor Brandimarte wished everyone happy, healthy holidays. 11.4 Mayor Duke Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,December 10,2013—7:00 p.m. Mayor Duke noted Jai Alai has already hired 135 people, and need to hire an additional 195 employees. His understanding is that the Job Fair has not been arranged yet, but it will be held soon. Mayor Duke addressed demolition occurring around the City, noting that Nautical Ventures is being demolished, and the Hilton Hotel is scheduled to be razed in April. Also, the old bus terminal on Ravenswood Road is being knocked down. Mayor Duke commented on the Holiday Lighting Event, and the Pearl Harbor Remembrance Day at the Fort Lauderdale Coast Guard Station. Mayor Duke wished everyone happy holidays. 12. Appointments Commissioner Jones motioned to re-appoint the appointments of Commissioner Flury; seconded by Vice-Mayor Brandimarte. Administrative Reports 13.1 City Manager City Manager Baldwin wished everyone happy holidays. 13.2 City Attorney Commissioner Jones asked when allowing hand-held signs in the chamber began. City Attorney Ansbro responded if the conduct is not disruptive, it is allowed. Vice-Mayor Brandimarte questioned what this might lead to.
