Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Chickie Brandimarte Commissioners: Bobbie H. Grace Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Pastor Tony Suriani, Lighthouse Community Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.4 Special event request for Oil Spill Response Team USA, Inc. to conduct an "Oil Spill Training", to be held at Whiskey Creek on Thursday, February 13, 2014, from 7:30 a.m. -4:00 p.m. This will be a familiarization, assessment and deployment of oil spill response equipment. Commissioner Grace motioned to approve the Special Event request for Oil Spill Response Team USA, Inc.; seconded by Commissioner Brandimarte. The motion carried unanimously. 3.1 Broward Boating Improvement Program (BBIP) check presentation from Griffm Marine Park solar lighting—Broward County Vice-Mayor Tim Ryan A check for $36,100.00 was presented to the City by Broward County Vice-Mayor Tim Ryan, Associate Planner John Fiore as Liaison for the Broward County Marine Advisory Commission, and Marine Advisory Board Members Chris Barile and Clive Taylor. 3.2 Presentation by Dr. Merilyn Blair-Johnson regarding S.T.E.M. (Science, Technology, Engineering&Mathematics) Members of the Dania Beach Education Advisory Board introduced Dr. Merilyn Blair-Johnson. Dr. Merilyn Blair-Johnson, S.T.E.M. Supervisor for Broward County Schools, asked the Commission to partner with the school district to help create and develop programs to offer extracurricular opportunities to our students. 3.3 Dania Beach Lions Club Presentation—Moon Lite Classic Car Show Jim Silvernale, Dania Beach Lions Club, reported on the Moon Lite Classic Car Show which was held at the beach on November 16, 2013. He presented a plaque to the City for their support of the event. 4. Proclamations 4.1 Broward County Diversity Community Month — Stewart Webster, Chair of the Diversity Advisory Council Commissioner Grace presented the proclamation to Stewart Webster, Chair of the Diversity Advisory Council 4.2 Terry Hale-Hicks Mayor Duke presented a proclamation to Terry Hale-Hicks for her recent efforts in driving a man suffering from a heart attack to the hospital, and rescuing a pelican who was tangled in fishing line at the beach. 5. Citizen Comments Carolyn Jones thanked the City for its participation in the MLK day celebration, and for painting the SW Community Center. Clive Taylor & Clare Frost, 642 NE 3rd Street, thanked the Commission for their support for the 8d'Annual Vintage Motorcycle Show and announced the date of January 31, 2015 for next year's event. They suggested that perhaps the Lions Club could take over the event in the future, and noted that parking will be an issue at future events. Omar Recuero, 2012 Plunkett Street, Hollywood, Libertarian Party, announced his candidacy for District 100 House of Representatives. Patricia Tyra, 2912 SW 54d' Street, addressed graffiti, requested art wraparounds for the western part of the City, and asked that the Dania Beach seal be redesigned to include a sailboat. Charles Camacho, 121 NE 3rd Street, spoke of the Dania Beach Relay for Life. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,January 28,2014—'7:00 p.m. Pastor Lillian Charles, President of the Friends of the Library, 631 Alabama Avenue, Ft. Lauderdale,thanked the Commission for their support on the Walk for the Dania Beach Library. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, reported on the recent Prostitution Sting along Federal Highway in Dania Beach. He noted that we continue to have a problem with luggage theft at hotels, and addressed recent burglaries. Michael Cassano, Deputy Fire Chief of Operations, BSO Fire Rescue, recognized Captain Brian Phipps as the Dania Beach Firefighter of the Year. 7. Consent A eg nda Items removed from Consent Agenda: #7.4 7.1 Minutes: Approve Minutes of January 14, 2014 City Commission Meeting 7.2 Travel Requests: None 7.3 Approve 2014 Legislative Agenda Resolutions 7.5 RESOLUTION#2014-004 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO ACCEPT AND EXECUTE A CLEAN VESSEL ACT GRANT PROGRAM AGREEMENT BETWEEN THE CITY OF DANIA BEACH, FLORIDA, AND THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION IN THE AMOUNT OF $90,000.00, WITH FUNDING TO BE USED FOR CONSTRUCTION OF A PUMP OUT FACILITY FOR THE DANIA BEACH MARINA;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Commissioner Grace motioned to adopt the Consent Agenda, with the exception of Item #7.4; seconded by Commissioner Jones. DB/A PARKER SYSTEMS, REFERENCING COMPETITIVE PRICING UNDER A LEE COUNTY CONTRACT AWARDED ON AUGUST 1, 2013 RESULTING FROM BID NUMBER IFB130392, WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS, AND FURTHER AUTHORIZING ACCEPTANCE OF A LOWER METER PER-UNIT PRICE TOTALING AN AMOUNT NOT TO EXCEED SDXTY-FIVE THOUSAND DOLLARS ($65,000.00); PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Continued from January 14,2014) City Attorney Ansbro read the title of Resolution#2014-002. Commissioner Grace requested answers to the questions the Commission asked at the last meeting. Marc LaFerrier, Community Development Director, noted the questions were answered in the memorandum included in the agenda packet, and reviewed the information with the Commission. Commissioner Jones motioned to adopt Resolution #2014-002; seconded by Vice-Mayor Brandimarte. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans 9.1 ORDINANCE#2014-001 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING THE CITY OF DANIA BEACH CODE OF ORDINANCES TO PROVIDE FOR COMPLIANCE WITH THE INTERNAL REVENUE CODE RELATING TO THE CITY OF DANIA BEACH GENERAL EMPLOYEES' RETIREMENT PLAN ("PLAN"); PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) City Attorney Ansbro read the title of Ordinance#2014-001. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition,he closed the Public Hearing. Commissioner Grace motioned to adopt Ordinance #2014-001, on second reading; seconded by Commissioner Jones. Discussion and Possible Action 10.1 City Commission Vacancy—Mayor Duke Mayor Duke noted we are not fulfilling our Charter, and re-stated his position that he would be happy to work with 14 of the applicants. He said that if any of the Commissioners want to appoint anyone who is not on the list, he would not oppose it, but he does not see any reason to re-open the process. 10.2 Discussion to re-open the application process for the City Commission vacancy — Commissioner Jones Commissioner Jones noted he wanted to re-open the process because the Commission could not agree on any of the candidates. Charles Camacho, 121 NE 3rd Street, asked the Commission to place the process for selecting a candidate on the agenda. Commissioner Grace clarified for the record that she is consistent with her thought plan in that she will only consider the current pool of applicants. Terry Hale-Hicks, 331 SW 2"d Avenue, asked what business is not going on or what has been delayed due to the vacant seat. Mayor Duke noted the vote on the employees in the DROP plan was postponed until the 5th Commissioner is appointed. Commissioner Jones noted the vacated seat's appointees for Boards have been ostracized. Betty Sokol, 609 NW loth Street, commented that the Commission is working together. 11. Commission Comments 11.1 Commissioner Grace Commissioner Grace acknowledged a new program, "Earn Your Bike", to be implemented at the PATCH beginning February 15th. Commissioner Grace commented there is no funding for FCAT preparation at Collins Elementary this year and asked if we can try to find a solution to the $4,200.00 cost to help the children. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,January 28,2014—7:00 p.m. Assistant City Manager Donnelly noted the After School Program funding through our partnership with ASP, Inc., is not for school day programming; however, he will work with the Grant Advisory Board and will contact ASP as a possible resource. Commissioner Grace said she is still getting complaints concerning Code Enforcement personnel, and noted she had asked for sensitivity training for them and Department Heads. City Manager Baldwin noted staff is looking into customer service training programs. 11.2 Commissioner Jones Commissioner Jones commented on the following recent events: • MLK celebration • PATCH opening • Walk for the Dania Beach Library • Vintage Motorcycle Show Commissioner Jones spoke of his attendance at the Broward League of Cities and School Board joint meeting for the 2014 legislative action year. Commissioner Jones commented about a recent Education Advisory Board meeting he attended, where they had concerns about the Head Start program being cancelled at Collins Elementary purportedly due to low enrollment. The suggestion from this meeting was that we attend the School Board meetings and make our feelings known. Commissioner Jones noted the Broward League of Cities Ethics Task Force opposes the creation of a Czar position for the entire County, as proposed by the OIG. Commissioner Jones spoke of the Florida League of Cities Economic Development and Growth Management Committee and noted the FLC Legislative Action Agenda includes the topic of vacation rentals. Fortunately, Dania Beach has an ordinance in place that prevents the state from preempting regulation by the City. 11.3 Vice-Mayor Brandimarte Vice-Mayor Brandimarte commented about her attendance at Family Day at the Saratoga Apartments. 11.4 Mayor Duke Mayor Duke noted this is the second year in a row he was not invited to the Saratoga Apartments Mayor Duke commented that the December Finance Reports indicate Pier revenues are continuing to decline, and asked about the status of the Pier Operator RFP. City Manager Baldwin responded the RFP is ready to go. Minutes of Regular Meeting Dania Beach City Commission Tuesday,January 28,2014—7:00 p.m. Mayor Duke noted the State of the City video will be shown at the next meeting and spoke of his walk-through of Dania Jai Alai during the filming. 12. ApWintments Commissioner Jones motioned to reappoint all of former Commissioner Flury's appointments to the boards, and their terms would expire with the November 2014 election; seconded by Vice-Mayor Brandimarte. The motion failed on the following 2-2 Roll Call vote: Commissioner Grace No Vice-Mayor Brandimarte Yes Commissioner Jones Yes Mayor Duke No Mayor Duke noted that his appointee to the Creative Arts Council Advisory Board resigned, and appointed Henriette Kitte Arnold as his replacement. Commissioner Grace motioned to approve the appointment; seconded by Mayor Duke. Administrative Reports 13.1 City Manager City Manager Baldwin noted we are on target with the airport settlement provisions. City Manager Baldwin advised the Southeast Stonmwater Drainage and Oasis projects are moving forward. City Manager Baldwin commented the Goals and Objectives meetings with each Commissioner should be wrapped up next week, and then a workshop or agenda discussion item can be scheduled. City Manager Baldwin noted that BSO will drop off an agreement for police services; the current agreement expires in September.
