HomeMy WebLinkAboutR-2014-015 Approved Change Order No. 1 for Simpson Environmental Services, Inc. for $76,500.00 for the Lime Softening Plant Rehabilitation - Lead Paint Abatement Project RESOLUTION NO. 2014-015 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING AND RATIFYING WORK PERFORMED AND IDENTIFIED IN CHANGE ORDER NO. 1 TO BE ISSUED TO SIMPSON ENVIRONMENTAL SERVICES, INC; INCREASING THE APPROVED CONTRACT AMOUNT BY $76,500.00 FOR THE LIME SOFTENING PLANT REHABILITATION - LEAD PAINT ABATEMENT PROJECT TO A TOTAL OF $461,500.00, TO COMPLY WITH REQUIREMENTS OF A CONSENT ORDER ISSUED BY THE BROWARD COUNTY HEALTH DEPARTMENT TO THE CITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Department of Environmental Protection (the "FDEP") approved State Revolving Funds for the Lime Softening Plant Rehabilitation - Lead Paint Abatement Project in 2011; and WHEREAS, advertisements for bids were placed in local newspapers in November, 2012; and WHEREAS, the City of Dania Beach opened bids for the Project on Friday, January 11, 2013; and WHEREAS, the City awarded the bid in an amount of$385,000.00 to the low bidder, Simpson Environmental Services, Inc.,via Resolution No. 2013-022; and WHEREAS, issues with differing site conditions with respect to the amount and consistency of lime sludge have delayed the Contractor's completion time and added costs to its efforts; and WHEREAS, City staff initially questioned the subject change order and requested that the Contractor furnish additional supporting documentation; and WHEREAS, City staff scheduled and held several meetings reviewing Contractor's claim for additional costs while work continued to meet a Broward County Health Department Consent Order Date to have the lead paint abatement completed; and WHEREAS, City staff suggested that work be completed on both accelators before processing the subject Change Order; and WHEREAS, upon further review by the City Public Works Department and the City Consultant, more effort was expended than anticipated in the original bid award for the Project; and WHEREAS, conditions of a Consent Order received by the City from Broward Public Health Unit regarding lead paint in the accelators at the water plant were met by the City; NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing findings are incorporated by reference and made a part of this Resolution by this reference. Section 2. That the City Commission of the City of Dania Beach, Florida ratifies and approves the expenditures performed in Change Order No. 1 related to the approved Contract with Simpson Environmental Services, Inc., adding to and increasing the Contract amount and Purchase Order with Simpson Environmental by $76,500.00, bringing the Contract amount to $461,500.00 and authorizes and directs the City Manager to execute same. Section 3. That Water Fund Contingency Account fund appropriations of$78,118.00 have previously been used for other approved costs, leaving an available balance of$8,249.00 in Account #401-33-01-533-99-10 as of February 24, 2014 and requiring the appropriation and transfer of Unappropriated Water Fund Net Resources in an amount of $68,251.00 using re- appropriation of Net Position account #401-00-00-389-90-02, thus providing a total transfer appropriation of $76,500.00 to the Water Fund, Water Plant Rehabilitation Capital Project account#301-40-33-533-31-10 for the subject Change Order. Section 4. That all resolutions or part of Resolutions in conflict with any of the provisions of this Resolution are repealed to the extent of such conflict. 2 RESOLUTION#2014-015 Section 5.
