HomeMy WebLinkAboutR-2014-018 - Authorized an Application to the Florida Inland Naviagation District (FIND) for Funding & Administration of the City Marina Renovation Phase II for $617,495.00 RESOLUTION NO. 2014-018 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO MAKE AN APPLICATION TO THE FLORIDA INLAND NAVIGATION DISTRICT ("F.I.N.D."), TO PROVIDE FOR FUNDING AND ADMINISTRATION OF THE CITY MARINA RENOVATION PHASE II PROJECT FROM A WATERWAYS ASSISTANCE PROGRAM GRANT IN THE AMOUNT OF $617,495.00; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach is interested in carrying out the following described project for the enjoyment of the citizenry of the City of Dania Beach and the State of Florida: Project Title: Dania Beach Municipal Marina Renovation Project, Phase H. The Total actual construction cost award (excluding permits, insurance and construction monitoring) is $6,186,787.00. Brief Description of Project: the Dania Beach Marina will be redesigned and rebuilt, which will include 120 slips, a new sea wall, and upland improvements, including a harbor master's office, laundry, fish cleaning station, pump-out facilities, security kiosks, hardscape improvements and project management; and WHEREAS, financial assistance is required for the Program funding mentioned above; and WHEREAS, the City has already appropriated more than an equal amount of required matching funds for this Marina Phase II Project grant application for $617,495.00, within the City's available Capital Projects' Fund—Marina Project Phase II,as follows: City General Fund Transfers 2012 $1,350,495.00 City Bank Loan 2013 $2,400,000.00 FIND grant#1 Oct. 2012 $1,382,505.00 FIND grant#2 Nov. 2013 $1,000,000.00 BBIP grant Aug. 2012 $1,367,000.00 Total=$7,500,000.00; (Broward Boating Improvement Program) NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the proper City officials of the City of Dania Beach are authorized to submit an application to the Florida Inland Navigation District in an amount of up to 50% of the actual cost of the Marina Phase II Project, on behalf of the City of Dania Beach. Section 2. The City of Dania Beach certifies the following: 1. That the City will accept the terms and conditions set forth in F.I.N.D. Rule 66B-2 F.A.C., which will be a part of the Project Agreement for any assistance awarded under the attached proposal. 2. That the City is in complete accord with the attached proposal and that it will carry out the Program in the manner described in the proposal and any plans and specifications attached to it, unless prior approval for any change has been received from F.I.N.D. 3. That the City has the ability and intention to finance its share of the cost of the Project, and that the Project will be operated and maintained at the expense of the City for public use. 4. That the City will not discriminate against any person on the basis of race, color or national origin in the use of any property or facility acquired or developed pursuant to the proposal, and it shall comply with the terms and intent of the Title VI of the Civil Rights Act of 1964, P.L. 88-352 (1964), and design and construct all facilities to comply fully with statutes relating to accessibility by disabled persons as well as other federal, state and local laws, rules and requirements. 5. That the City will maintain adequate financial records relating to the proposed Project to substantiate claims for reimbursement. 6. That the City will make available to F.I.N.D. if requested, a post-audit of expenses incurred on the Project prior to or in conjunction with the request for the final ten percent(10%) of the funding agreed to by F.I.N.D. Section 3. That the City Commission has already provided required matching grant funds for this Marina Phase H Project within the City's Capital Project Fund — Marina Renovation Phase II Project, in an amount exceeding this $617,495.00 F.I.N.D. grant application (F.I.N.D. grant#3) amount. 2 RESOLUTION#2014-018 Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5.
