A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, APPROVING VARIANCES (VA-33-14 AND VA-34-14)
SUBMITTED BY LAWRENCE KRAMER ON BEHALF OF VILLAGE AT
DANIA BEACH, LLC., FOR PROPERTY LOCATED AT 180 DANIA BEACH
BOULEVARD IN THE CITY OF DANIA BEACH,FLORIDA;PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,Lawrence Kramer,on behalf of Village at Dania Beach,LLC(the"Applicant")
is requesting site plan approval to allow the construction of a mixed use, seven-story building
totaling approximately 83,875 square feet to be located at 180 East Dania Beach Boulevard in the
City of Dania Beach; and
WHEREAS,Chapter 28, Part 6 of the City Land Development Code(the"LDC"),Article
625,entitled"Variances",states that variances may be approved by the City Commission at the time
of site plan approval; and
WHEREAS,the Applicant is requesting a variance to provide 260 parking spaces,where the
LDC requires 277 parking spaces via the parking reductions for mixed use developments, per
Section 265-90;and
WHEREAS,the Applicant is requesting a variance to provide seven percent(7%)percent
pervious area,where the LD C requires a minimum of ten percent(10%),per Section 303-60(D);and
WHEREAS,the City Commission conducted a duly noticed public hearing in accordance
with Article 610 of the LDC; and
WHEREAS, the Applicant, in a letter sent to the City dated March 12, 2014 (attached as
Exhibit `B", and incorporated into this Resolution by this reference), has voluntarily agreed to
submit construction documents to the City's Building Department for building permits by May 31,
2014, and has agreed and proferred that upon receipt of such building permits, the Applicant will
commence construction of the development subject to this Resolution within forty-five(45)days;
and
WHEREAS, the Applicant also willingly proffers, understands and agrees that the
development orders approved by this Resolution shall expire unless the Applicant has applied for
building permits within sixty (60) days after approval of this Resolution, and construction of the
development subject to this approval is commenced no later than 45 days after issuance of such
building permits;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That,having determined that the criteria of Sec.625-40 of the Code have been
satisfied,those certain applications:
1. (VA-33-14)for variance approval,and
2. (VA-34-14)for variance approval,
copies of which are attached as composite Exhibit"A", and are made a part of and
incorporated into this Resolution by this reference,are approved with the following
conditions:
1. Applicant,Village at Dania Beach,LLC in a letter to the City dated March 12,2014
(attached as Exhibit `B") has voluntarily agreed to submit construction documents to the City's
Building Department for building permits for the development approved in this Resolution within
sixty (60) days following the approval of this Resolution. Upon receipt of the building permits,
applicant Village at Dania Beach,LLC shall commence construction of the development approved in
this Resolution within forty-five (45) days. Applicant, Village at Dania Beach LLC, willingly
proffers and agrees that the development orders approved by this Resolution shall expire unless the
Applicant applies for building permits within sixty (60) days following the approval of this
Resolution,and construction of the development approved in this Resolution is commenced no later
than 45 days after issuance of the building permits.
2. All applicable state and federal permits must be obtained before commencement of
the development. Issuance of a development permit by a municipality does not in any way create any
right on the part of an applicant to obtain a permit from a state or federal agency and does not create
any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain
requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes
actions that result in a violation of state or federal law.
Section 2. That pursuant to Section 625-50 of the LDC, all variance approvals shall
automatically expire unless all building permits remain valid until the project is complete,and unless
the conditions and limitations of the variances are satisfied.

Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

Village at Dania Beach,LLC has submitted our project"Dania Place"for DRC approval. In order for us to
develop the project we are requesting three(3)variances. The variances are crucial to the ability to
develop a multi-story mixed use structure with a parking garage and to make this project financially
viable.
Furthermore,we hereby affirm that Village at Dania Beach, LLC is committed to commence construction
this summer. In order to achieve this,we have,at our own risk,initiated the development of all
construction documents and permit sets. We are committed to submit the construction documents to
the City's Building Department for permitting by the end of May. Upon receipt of the building permit
we will commence construction within 45 days.
Village at Dania Beach,LLC willing proffers that such development orders shall expire unless we have
applied for a building permit within 60 days after approval of the development order,and construction
is commenced no later than 45 days after issuance of the building permit.
