HomeMy WebLinkAboutR-2014-022 - Executed a Third Amendment to the Existing Agreement to Increase the Number of Firefighters/Paramedics Assigned to the City thru funding from 2013 ''Safer'' Grant RESOLUTION NO. 2014-022 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A THIRD AMENDMENT TO THE AGREEMENT EXISTING BETWEEN THE CITY OF DANIA BEACH, FLORIDA AND THE BROWARD SHERIFF'S OFFICE, RELATING TO THE FIRE RESCUE STAFFING STRUCTURE TO INCREASE THE NUMBER OF FIREFIGHTERS/PARAMEDICS ASSIGNED TO THE CITY THROUGH AND ONLY DURING FUNDING FROM A 2013 "SAFER" GRANT UNTIL ITS EXPIRATION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City entered into an Agreement with Broward Sheriff's Office for Fire Rescue Services on January 6,2011; and WHEREAS, the City has received funding from a 2013 "SAFER" Grant for use by the Broward Sheriffs Office, relating to its Fire Rescue staffing structure of its ALS rescue trucks, which will be used to increase the number of Firefighters/Paramedics assigned to the City through funding from the 2013 "SAFER" Grant until its expiration and the City and the Broward Sheriffs Office desire to amend the Agreement accordingly; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. The above "Whereas" clauses are affirmed, approved and incorporated in this Resolution by this reference. Section 2. That the proper City officials are authorized to execute a Third Amendment to the Agreement dated January 6, 2011, existing between the City of Dania Beach, Florida and the Broward Sheriffs Office relatingto Fire Rescue staffing structure of the ALS g rescue trucks by increasing the number of Firefighters/Paramedics assigned to the City through funding from a 2013 "SAFER" Grant until its expiration (end of funding). Copies of the Third Amendment and the composite Exhibit "A" are attached, made a part of and incorporated into this Resolution by this reference. Section 3. That the City Manager and City Attorney are authorized to make minor revisions to the Third Amendment to the Agreement and the Exhibit which are deemed necessary,proper and in the best interests of the City. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to such extent of such conflict. Section 5. DUKE,III CITY CLERK YOR APPROVED AS TO FO AND CORRECTNESS: THOMXS BR CITY ATT EY 2 RESOLUTION#2014-022 THIRD AMENDMENT TO THE AGREEMENT FOR FIRE RESCUE SERVICES THIS THIRD AMENDMENT TO THE AGREEMENT FOR FIRE RESCUE AND EMERGENCY MEDICAL SERVICES, dated the day of , 2014, is made by and between the City of Dania Beach, (hereinafter referred to as the "CITY") and the Broward Sheriff's Office (hereinafter referred to as`BSO") WITNESSETH: WHEREAS, on or about January 6, 2011, the CITY contracted with the Broward Sheriff's Office for the provision of fire rescue services, and WHEREAS, the CITY is desirous of adjusting the staffing structure to increase the number of Firefighter/Paramedics assigned to the CITY, and NOW, THEREFORE, in consideration of the mutual promises contained herein, and for other good and valuable consideration, the receipt and legal sufficiency of which are hereby acknowledged,the parties hereto agree as follows: 1. The above recitals are true and correct and incorporated herein by reference. 2. This Agreement is comprised of the Agreement, the Special Terms and Conditions set forth in Exhibit A of the Agreement, Exhibits B and C to the Agreement, the First Amendment, the Second Amendment, and this Third Amendment and the Revised Special Terms and Conditions set forth in Exhibit A to this Third Amendment, which is attached and incorporated herein. 3. In the event there is a conflict between the General Terms and Conditions, Special Terms and Conditions, and the Transition of Employees Terms and Conditions, the documents shall be controlling in the following order: a. Special Terms and Conditions b. General Terms and Conditions 4. The staffing levels for the ALS rescue trucks will be increased by a total of nine (9) firefighters/paramedics using funding provided to the City by the 2013 SAFER Grant Agreement. The SAFER grant positions will be funded by the grant until its expiration and/or funds have been exhausted as provided in more detail on the Revised Terms and Conditions set forth in Exhibit A to this Amendment. The City of Dania Beach is not obligated to fund the nine (9) firefighters/paramedics positions beyond the funding availability and grant period of the 2013 SAFER grant fund award. 5. Except as modified herein, all remaining terms and conditions of the Agreement shall remain in full force and effort. 3 RESOLUTION#2014-022 THIRD AMENDMENT TO THE AGREEMENT FOR FIRE AND EMERGENCY MEDICAL SERVICES BETWEEN THE CITY OF DANIA BEACH, FLORIDA AND THE BROWARD SHERIFF'S OFFICE IN WITNESS HEREOF, each of the parties hereto have authorized its duly authorized representative to execute this Agreement on the day and date first set forth above. ANSBRO CITY ATTORNEY 5 RESOLUTION#2014-022 EXHIBIT A TO THE THIRD AMENDMENT REVISED SPECIAL TERMS AND CONDITIONS The following Special Terms and Conditions have been agreed upon by and between the CITY and BSO: CITY: City of Dania Beach EFFECTIVE DATE OF January 29, 2011 AGREEMENT FIRST AMENDMENT September 25, 2012 EFFECTIVE DATE: SECOND AMENDMENT October 1, 2013 EFFECTIVE DATE THIRD AMENDMENT April 1, 2014 EFFECTIVE DATE FIRST YEAR January 29, 2011 — September 30, 2011 TERM January 29, 2011 — September 30, 2015 RENEWAL OPTION Renewable for three (3), five (5) year terms upon mutual written agreement of the parties as to the terms and conditions agreed upon at such time. STAFFING STRUCTURE: Fire Station 1 One (1) ALS Rescue Truck — staffed with one (1) Officer and one (1) Firefighter/Paramedic One (1) ALS Engine Aerial — Staffed with one (1) Officer (cross-trained firefighter/paramedic), one (1) Driver Engineer and one (1) Firefighter. (One (1) member must be a cross-trained 6 RESOLUTION#2014-022 firefighter/paramedic) Fire Prevention Services—the Fire Prevention Bureau will be located at 102 West Dania Beach Boulevard. The following staff will work on a forty(40)hour, five (5) days per week full-time basis. Also Inspector call-out during the term of the Agreement. 1. One (1) Fire Officer certified by the State of Florida and Broward County as a Fire Safety Inspector and one (1) Administrative Assistant. 2. Three (3) Firefighters certified by the State of Florida and Broward County as a Fire Safety Inspector. Fire Station 93, subject to relocation One (1) ALS Rescue Truck — staffed with one (1) Officer(cross- trained firefighter/paramedic) and one (1) Firefighter/Paramedic One (1) ALS Engine Aerial — Staffed with one (1) Officer, one (1) Driver Engineer and one (1) Firefighter. (One (1) member must be a cross-trained firefighter/paramedic) 2013 SAFER Grant The Staffing Structure will be increased by the addition of nine 7 RESOLUTION#2014-022 (9)cross trained firefighters/paramedics subject to the availability of a SAFER Grant funding award to increase staffing on ALS rescue trucks for the City. Funding for these positions is limited to the amount and conditions specified in the 2013 SAFER Grant Agreement between the CITY AND FEMA. CONSIDERATION: Fiscal Year 2013/14 $ 8,822,840.00 Monthly Consideration $ 735,236.67 Additional Consideration—initial SAFER Grant 2013 SAFER Grant—May 16, $1,619,631.00—total Grant award 2014 or sooner through May 15, 2016 or as funding is available through the 2013 SAFER Grant. Expenditures related to the SAFER Grant shall be itemized separately from other contract costs on BSO monthly billings to City.
