HomeMy WebLinkAboutR-2014-017 - Approved Change Order No. 1 to Close Construction, Inc. for a Credit of $17,437.25 relating to Repair of Two Accelerators RESOLUTION NO. 2014-017 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, RATIFYING THE USE OF CONTRACT ALLOWANCE EXPENDITURES AND APPROVING CHANGE ORDER NO. 1 TO CLOSE CONSTRUCTION, INC., FOR A NET CREDIT AMOUNT OF $17,437.25, REDUCING THE TOTAL CONTRACT AMOUNT FROM $857,830.00 TO $840,392.75, RELATING TO THE REPAIR OF TWO ACCELATORS AS PART OF THE LIME SOFTENING PLANT REHABILITATION PROJECT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Department of Environmental Protection ("FDEP") approved State Revolving Funds for the City Lime Softening Plant Rehabilitation - Repair of Two Accelators Project in 2011; and WHEREAS, advertisements for bids were placed in local newspapers on March 7, 2013; and WHEREAS,the City opened bids for the Project on Friday, April 12, 2013; and WHEREAS, the City awarded the bid in an amount of$857,830.00 to the low bidder, Close Construction, Inc.,via Resolution No. 2013-056 on June 11, 2013; and WHEREAS, the Contract included a $50,000.00 allowance for metal work; several issues arose during construction necessitating the use of$32,971.39 of allowance funds: Item Change Work Order 2 -Pans $8,808.03 Work Order 3 -Pipe Supports and Coatings $22,988.96 TOTAL $31,796.99 Since $31,796.99 plus a$765.76 permit fee of the$50,000.00 allowance balance has been used to address the above listed Work Orders, a remaining credit of$17,437.25 to the original Contract total amount is appropriate. Overall, this causes a change to the Contract amount as follows: Contract Amount $857,830.00 Net Credit ($17,437.25) Revised Contract Amount $840,392.75; and WHEREAS, after review by City Staff and the City Consultants, it was acknowledged that the above listed Work Orders were required and were needed to meet the terms of a Consent Order existing between the City and the Broward County Health Department; the work was completed utilizing the Contract allowance in the original bid award for the Project; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing findings are incorporated into this Resolution by this reference and are made a part of it. Section 2. That the City Commission approves and ratifies expenditures already made from the Contract allowance amount of $50,000.00, which amount exceeds the City's $25,000.00 purchasing limit. Section 3. That the City Commission approves Change Order No. 1 to the Contract with Close Construction, Inc. in a credit amount of $17,437.25, reducing the Contract total amount to $840,392.75, and the City Manager is authorized to execute it. Section 4. State Revolving Funds were approved for this contractual work and FDEP has acknowledged and approved the use of the Contract allowance for the above listed Work i Order Nos. 2 and 3. Section5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6.
