MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, MARCH 25, 2014 — 7:00 P.M. 1. Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Chickie Brandimarte Commissioners: Bobbie H. Grace Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro Deputy City Clerk: Tom Schneider 2. Invocation and Pledge of Allegiance Pastor Faye Williams, Ebenezer Deliverance Temple, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.3 Special Event request from Marine Industries of South Florida for the "1 Sth Annual Plywood Regatta", to be held on April 5-6, 2014, at the North end of the Marina parking lot. The applicant is also requesting a special event fee waiver of$150.00, as well as waiver of parking fees for mentors. 3.4 Special Event request from the City of Dania Beach Parks and Recreation Department, and the Chamber of Commerce, for a "Hurricane Exposition" to be held on June 7, 2014, from 10:00 a.m. - 1:00 p.m. in the City Hall Atrium Commissioner Grace motioned to approve Item #3.3 and Item #3.4; seconded by Commissioner Jones. The motion carried unanimously. 4. Proclamations 4.1 Women's History Monty—Commissioner Grace Commissioner Grace read the proclamation for Women's History Month. 4.2 Anne Castro—Commissioner Jones Commissioner Jones presented a proclamation to former Mayor and City Commissioner Anne Castro for her accomplishments and contributions to the City of Dania Beach and Broward County. 3.1 Annual Audit— Presentation of Comprehensive Annual Financial Report (CAFR) for Fiscal Year ending 9-30-2013 Mark Bates, Director of Finance, introduced Adam Siegel, Audit Manager, Harvey, Covington& Thomas of South Florida. Mr. Siegel provided an overview of the Comprehensive Annual Financial Report for FY 2012- 2013, which was included in the agenda packet. Commissioner Grace commented she was very impressed by the thoroughness of the audit. Commissioner Jones asked about the findings dealing with the financial statement audit. Mr. Siegel explained it relates to a water service connections/internal control procedures issue stemming from prior years; it is nothing new, but was left in because it has not been resolved. City Manager Baldwin noted some improvements have been made. Commissioner Jones questioned the requirements we will be subject to under GASB 6768. Mr. Siegel responded the unfunded liability for the pensions will be required to be shown on the government-wide financial statements. Commissioner Jones noted we will have to deal with this in the future. Commissioner Jones motioned to accept the FY 2012-2013 Comprehensive Annual Financial Report; seconded by Commissioner Grace. Mayor Duke observed that City revenues are the highest since 2007 even while the overall tax burden on the residents has been decreased; 16 entities account for half of the tax burden in the City; and the majority of the outstanding debt for business activities is a low figure. The motion carried on the following 4-0 Roll Call vote: Commissioner Grace Yes Vice-Mayor Brandimarte Yes Commissioner Jones Yes Mayor Duke Yes 3.2 Dania Beach Ocean Park Waterfront Revitalization Plan Presentation Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,March 25,2014—7:00 p.m. City Manager Baldwin gave a brief overview, and noted the plan is divided into three phases. Staff is recommending approval and funding of Phase I, and approval of Phase II; Phase III is to be a roadmap for the future. Kona Gray, ASLA, Principal, EDSA, thanked the residents and City staff for their input and cooperation, and gave a presentation on the Waterfront Revitalization Plan, which was included in the agenda packet. Commissioner Grace said she was impressed with the number of residents who toured other beaches in order to provide input for what is desired in Dania Beach. She spoke about funding for the three phases, and noted she is bothered by the fact that a lot of sand has been lost; hopefully, we can work with the County, Fort Lauderdale, and Hollywood to build up our beach. Terry Hale-Hicks, 331 SW 2"d Avenue, addressed beach parking, showers for fishermen, and the garbage problem. Clive Taylor, 642 NE 3Td Street, representing the Marine Advisory Board, said we need to move forward and get beach revitalization done. Mark LaRocca, 4511 SW 34d' Avenue, addressed trash on the beach, and noted the open top containers in front of the Quarterdeck get smelly. He questioned whether compactors were considered for handling solid waste generated by the beach. Pat Rafacz, 610 Trafalgar Court, suggested the name over the entrance should include "Dania Beach". Commissioner Jones commented about the three phases of the plan, and said the overall design is great. He added he is looking forward to moving in this direction and we need to get started. He noted that along with the plan being implemented is the restoration of the beach, and hopefully we will be able to obtain future grant dollars to restore the beach and dunes. Commissioner Jones questioned what moving the dunes to the west means. Mr. Gray explained there is the opportunity to tighten up the parking to gain room for a walkway along the beach as well as an area to add dunes to the existing ones. Vice-Mayor Brandimarte felt that, although the later phases are very expensive, the plan is fantastic, and we need to move forward now. RESOLUTION NO. 2014-023 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE FINAL VERSION OF THE DANIA BEACH OCEAN PARK WATERFRONT REVITALIZATION PLAN; PROVIDING FOR A FUNDING APPROPRIATION IN THE AMOUNT OF $1,600,000.00 TO IMPLEMENT PHASE I;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2014-023. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,March 25,2014—7:00 p.m. Vice-Mayor Brandimarte motioned to adopt Resolution #2014-023; seconded by Commissioner Jones. Mayor Duke commented it is exciting to see the plan come together, and the Commission is obligated to address the beach. He said with improvement of the beach, we will receive a financial return for our taxpayers, which we have an obligation to get in order to ensure we can maintain the beach properly. Additionally, this ties in with efforts to attract quality redevelopment in the downtown area. i P The motion carried on the following 4-0 Roll Call vote: Commissioner Grace Yes Vice-Mayor Brandimarte Yes Commissioner Jones Yes Mayor Duke Yes 5. Citizen Comments Charles Camacho, 121 NE 3rd Street, gave an update on the Relay for Life. Vivek Golikeri, 301 SE 3`d Street, proposed forcing law breakers to pay part of the cost of law enforcement through fines and community service. Terry Hale-Hicks 331 SW 2nd Avenue, spoke on behalf of Captain Bob at the Marina regarding Olsen Middle School teachers making loud noises when conducting school traffic at 7:00 a.m., and questioned noise restrictions during this time of day. Mayor Duke said the City Manager would follow up. Bob Adams, 330 SE 3rd Terrace, spoke as the Chair of the Board of Commissioners of the Dania Beach Housing Authority, regarding filling the Executive Director position with Anne Castro. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, spoke of the recent increase in burglaries at the marina, and introduced Detective Edward Valderrama and Detective Abraham Cremidis, whose efforts resulted in the apprehension of the perpetrators and recovery of all of the stolen items. Chief Granville noted a "Driveway Initiative" will begin where BSO will come out to neighborhoods and meet with a gathering of residents in a host driveway to discuss crime or quality of life issues. Michael Cassano, Deputy Fire Chief of Operations, BSO Fire Rescue, spoke of a "Safety Belt Program" initiative that will be launched for Dania Beach elementary schools in May. Discussion ensued regarding the upcoming hurricane season preparedness and exposition. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,March 25,2014—7:00 p.m. 7. FOR PHASE I OF THE S.E. STORMWATER DRAINAGE PROJECT; AUTHORIZING THE CITY MANAGER TO REFINE AND EXECUTE AN AGREEMENT FOR SERVICES CONSISTENT WITH THE BID IN AN AMOUNT NOT TO EXCEED $1,259,000.00; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Public Hearings and Site Plans 9.1 RESOLUTION#2014-020 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING VARIANCES (VA-33-14 AND VA-34-14) SUBMITTED BY LAWRENCE KRAMER ON BEHALF OF VILLAGE AT DANIA BEACH,LLC.,FOR PROPERTY LOCATED AT 180 DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. 9.2 RESOLUTION#2014-021 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-69-13) SUBMITTED BY LAWRENCE KRAMER ON BEHALF OF VILLAGE AT DANIA BEACH, LLC., FOR PROPERTY LOCATED AT 180 EAST DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution #2014-020 and Resolution #2014-021 because they relate to the same property. He advised these items were quasi-judicial hearings and swore- Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,March 25,2014—7:00 p.m. in those who would speak. He asked the Commission to disclose any communication they had on these matters. Commissioner Jones said he had been contacted by the developer. Corinne Lajoie, Principal City Planner, gave an overview of the applicant's requests for variances and site plan approval. Lawrence Kramer, Southeast Architect Services, described the amenities planned for the project, and the composition of mixed retail/residential. Mayor Duke opened the Public Hearing. Bob Terjesen, 110 SE Park Street, expressed concerns about the parking garage entrances and garbage pickup areas being directly across the street from his house. Craig Urbine, 229 SE 40' Street, spoke in favor of the project, noting it would be a catalyst to change things downtown and to support the existing businesses there. Michael Shiff, 200 E Dania Beach Boulevard, provided a handout to the Commission, a copy of which is attached to and incorporated in these minutes, and raised concerns and posed questions about various aspects of the proposed project. Mr. Kramer addressed the streetscape and drainage issues raised. Dominic Orlando, Director of Public Services, noted the City Engineer reviewed the drainage plans which, as designed, should work. Mr. Terjesen said his concerns with traffic flow on Park Street and dumpsters were not addressed. Mr. Kramer explained the configuration of parking garage entrances and concealment of the dumpsters, as well as the utilization of garbage compactors. Bill Harris, 902 Nature Coves Road, commented we need a showplace building in Dania Beach, and there are trade-offs to alleviate the concerns raised. Judy Jensen, 46 SE 6th Street, felt there should be restrictions on the number of animals per household in Dania Beach overall, and on the number and size of animals for rental properties. Mr. Kramer spoke of plans for a cistern to be used for the landscaping, and a green wall on the parking garage. He added there will be a limit of one dog per household as well as a weight restriction. Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public Hearing. Discussion and Possible Action There were no discussion items on this agenda. 11. Commission Comments 11.1 Commissioner Grace Commissioner Grace commented about recent break-ins in the Northwest section of the City and suggested moving the cameras around, especially on the park area. Commissioner Grace said she is still receiving complaints about Code Enforcement and noted she had previously asked about placing bulk pickup dates on water bills. She added she will continue talking about how code enforcement is being done as long as she hears from residents of the Southeast and Southwest sections. Commissioner Grace spoke about recent and upcoming community and social events. 11.2 Commissioner Jones Commissioner Jones spoke of his Town Hall meeting held at P.J. Meli Park, and thanked everyone who attended. Commissioner Jones commented on the Women's Club event held at the library, and the bicycle safety event. Commissioner Jones spoke about code enforcement and the need for a GIS system to monitor code violations. Minutes of Regular Meeting g Dania Beach City Commission Tuesday,March 25,2014—7:00 p.m. 11.3 Vice-Mayor Brandimarte Vice-Mayor Brandimarte thanked the Dania Beach Improvement Committee for picking up 31 bags of trash on Dania Beach Boulevard. 11.4 Mayor Duke Mayor Duke spoke of a local paper carrying a City advertisement for employment opportunities, and noted he believes the City and residents are best served if strong preference is given to current City employees, particularly those who live in Dania Beach. 12. Appointments Commissioner Grace motioned to appoint Commissioner Jones as Director and Commissioner Grace as Alternate to the Broward League of Cities 2014-2015 Board of Directors; seconded by Vice-Mayor Brandimarte. The motion carried unanimously. Commissioner Grace motioned to appoint Bill Harris to the Creative Arts Council Advisory Board; seconded by Mayor Duke. My name is Michael Shiff I am the owner and developer of Street and Main the mixed use development at 200 East Dania Beach Blvd., located directly across the street from the proposed Dania Place.As some of you may remember I was also the developer of The Oaks at Hidden Harbour,the 55 unit townhome project located on the Dania Beach Cutoff Canal. I have reviewed the documents and staff report for the proposed Dania Place and wish to offer the following perspective. As with most developers,the Village at Dania Beach LLC has requested the maximum allowable for this site even using bonuses allowed for in the cities codes and proposes 144 units on less than a 2 acre site or 72 units per acre. If approved as proposed this will be the greatest residential density in the City. In addition to the mere size of the project I wish to bring up a few issues that I believe need additional scrutiny by yourselves and by staff. When I developed the property across the street I encountered as I recall 10-15 feet of muck which not only required the use of pilings for the buildings foundations but also the first floor slab. I am sure the developer is proposing a similar structural system, but the muck also causes a problem with drainage.The proposed development has only 5% pervious area which means that 95%of the site is covered in concrete,the project is being constructed with no setbacks from adjacent properties or R.O.W's.The developer is proposing a series of trench drains to satisfy the required drainage for this property.The trench drains are all covered in concrete which means if and when they fail there will be no way to correct them without removing most if not all of the first floor concrete slab.As with what occasionally happens to my site under heavy rain,and will also happen to this site,the trenches can no longer handle the water and the catch basins overflow into the parking areas. I would strongly recommend that the City engineer require a deep well injection system. Drainage in this area is already bad enough let's not make it worse. Having some experience with parking garages I looked at the ramp from the ground floor to the first elevated parking floor which is the third floor and is 14'6"above the first floor.The required slope is approximately 1'in 8.5',assuming that you can get by with the 6"structural slab that is proposed.This slope is much greater that the recommended maximum of 1'in 10',which in itself is extremely steep and requires transitional ramping at the top and bottom.Although not a City code issue the ramping needs to be looked at. One question that needs to be answered by the developer is,will pets be allowed in the development? Most residential development allow pets and they would be hard pressed not to.The problem here is that the developer has not made any provision for a pet area, by that I mean a place for their residents to walk their animals.The only solution remaining would be for them to walk them in the adjacent neighborhood. Since there is no place along Dania Beach Blvd.that leaves only the neighboring residents lawns and swales. I'm sure you will be told that they will require their pet owning residents to pick up after their pets, but we all know that is unenforceable.The only solution is for you to require as part of their site plan approval that no pets be allowed unless they provide for an onsite pet area large enough to handle the amount of pets expected. I can easily imagine that number to be 25-30%of the residents. The developer proposes to utilize on street parking for 11 spaces calling them Community Spaces. I wish to respectfully and strongly request that this not be granted.What once was an old and admittedly dilapidated two story hotel,at least it was set back from the R.O.W.The proposal is for a 7 story 70'apartment structure with no setback from either Dania Beach Blvd.or S.E.2nd Avenue. e Y S. E. 2nd avenue is highly used as a main access off Dania Beach Blvd. not only to my development but to the residential neighborhood.These spaces will only be used by the residents who will live in the town homes along S.E. 2nd Ave. and they have the parking garage to park in.To allow on street parking is not only dangerous to traffic turning off Dania Beach Blvd. but to take away the only possible area for landscaping on this project which would at least offer somewhat of a visual barrier to my project across the street is just wrong.To use the old saying,to add insult to injury,two of those spaces are on my side of the street,one of them blocking fire access to my back flow preventer.These on street spaces should not be allowed and the developer should be required to heavily landscape these swale areas.They could even use these areas,on their side of the street,to walk their pets,although they are grossly inadequate in size for that purpose. I would hope that you would agree that my observations and suggestions are worthwhile and require the recommended changes.Thank you for your time and consideration.
