MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, APRIL 8, 2014 — 7:00 P.M. 1. Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Chickie Brandimarte Commissioners: Bobbie H. Grace Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Father Roger Holoubek, St. Maurice at Resurrection Catholic Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event request from the Oil Spill Training Response Team for an "Oil Spill Training Exercise" to be held on May 1, 2014, from 8:00 a.m. - 4:30 p.m. at Whiskey Creek,North of the fishing pier and Marina 3.2 Special Event request from Divers Cove for a volunteer "Pier Cleanup", to be held on June 22, 2014 from 9:00 a.m. -12:00 p.m. Commissioner Grace motioned to approve the Special Event request for Item #3.1 and Item #3.2; seconded by Commissioner Jones. The motion carried unanimously. 3.3 Courage Games 5k Ruck Run Presentation—Bill Carney, Project Courage Bill Carney, Project Courage, provided an overview of the 5k Ruck Run to be held on Saturday, April 26 at 8:00 p.m. at Dania Beach. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Charles Camacho, 121 NE 3ra Street, provided an update on the Dania Beach Relay for Life, and � requested the Commission name May 3 aas Relay for Life Day. Commissioner Grace asked if the City had paid the $5,000.00 for the Relay for Life sponsorship. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, briefed the Commission on a reverse burglary sting which was conducted last week. Mayor Duke said the Marine Advisory Board asked that the BSO Marine Unit be moved to Dania Beach; staff followed up and BSO sent their requirements to the City. He asked the City Manager to provide BSO's response to the Commission, and for them to consider this as a starting point for discussion of possible options to make this happen. Commissioner Grace commented she does not want to give out free boat slips, nor does she want us to jeopardize our grant. City Manager Baldwin noted that the first step is to check our grant agreement to see if the relocation is feasible, and then a full analysis would be given to the Commission. Michael Cassano, Deputy Fire Chief of Operations, BSO Fire Rescue, updated the Commission on their seatbelt safety initiative and the event to be held in May. 7. Ordinances (Titles read by City Attorney) 7.6 ORDINANCE #2014-003 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, CREATING SECTION 21-7, "PROHIBITION OF RIGHT-OF-WAY VENDORS AND SOLICITORS ON CERTAIN ROADWAYS," OF THE CITY CODE OF ORDINANCES, TO PROHIBIT SOLICITATIONS IN AND UPON PORTIONS OF CERTAIN ROADWAYS WITHIN THE CITY; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING AN EFFECTIVE DATE. OFFERING AN EMPLOYEE LOAN AT WORK PROGRAM TO ACTIVELY EMPLOYED CITY STAFF, WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2014-027. Commissioner Jones noted he requested this item because he thinks the program would be beneficial for our employees. Commissioner Jones motioned to adopt Resolution #2014-027; seconded by Mayor Duke. Bids and Requests for Proposals Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,April 8,2014—7:00 p.m. There were no proposals on this agenda. 9. Public Hearings and Site Plans City Attorney Ansbro advised the remaining item was a quasi-judicial hearing and swore-in those who would speak. He asked the Commission to disclose any communication they had on this matter. 9.1 RESOLUTION#2014-025 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-001-14) SUBMITTED BY NASRIN NILCHIAN, PROPERTY OWNER FOR PROPERTY LOCATED AT 41 NE 2ND AVENUE IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS;FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2014-025. Corinne Lajoie, Principal City Planner, provided an overview of the site plan request. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Commissioner Jones motioned to adopt Resolution #2014-025; seconded by Commissioner Grace. The motion carried on the following 4-0 Roll Call vote: Commissioner Grace Yes Vice-Mayor Brandimarte Yes Commissioner Jones Yes Mayor Duke Yes 10. Discussion and Possible Action 10.1 Tourist Tax Revenue Letter to Broward County—City Manager Baldwin City Manager Baldwin explained the purpose of the letter is to express the City's concern that additional tax benefits for the Florida Panthers from tourist tax dollars will compromise funding of projects and programs already needed to support tourism in the City of Dania Beach and Broward County. He noted tonight's action is to articulate our policy and send the letter to Broward County. Commissioner Jones commented he is concerned with the private phone number included in the letter, and that the letter should be from the Mayor and City Commission. Vice-Mayor Brandimarte felt a cover letter stating that the Commission voted in support of the Mayor sending the letter should be included. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,April 8,2014—7:00 p.m. The Commission concurred on sending the letter to the Broward County Commission. 11. Commission Comments 11.1 Commissioner Grace Commissioner Grace's comments included the following: an update on the PATCH Garden;that attendees of the Arts and Seafood Festival tripped on the handicap walkway, people were not happy that Dania Beach residents were not a bigger part of the exhibitors, and the volunteers did an awesome job; an additional update on Relay for Life; her Employee of the Month is Assistant City Manager Colin Donnelly; and particulars of community and civic events. 11.2 Commissioner Jones Commissioner Jones commented on the Gallery of Amazing Things event and its production company, Staged Right Events. He said the Arts and Seafood Festival and Vintage Motorcycle Show are signature events which are furthering our efforts to become a destination, and noted the Eminent Domain bill passed the Florida Senate. Commissioner Jones spoke about cheap shots that have been taken against Anne Castro for his presentation to her of a Key to the City on a blog entitled the Chronicles of Dania. 11.3 Vice-Mayor Brandimarte Vice-Mayor Brandimarte said it would be nice for the Commission to know when a Key to the City will be presented. She also commented on the Arts and Seafood Festival. 11.4 Mayor Duke Mayor Duke said he would also like to know when Keys to the City are presented. He noted he would like to have seen how Staged Right Events would have promoted the Arts and Seafood Festival. 12. Appointments Commissioner Jones motioned to re-appoint all of former Commissioner Flury's board appointments; seconded by Vice-Mayor Brandimarte. The motion failed on the following 2-2 Roll Call vote: Commissioner Grace No Vice-Mayor Brandimarte Yes Commissioner Jones Yes Mayor Duke No 13. Administrative Reports Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,April 8,2014—7:00 p.m. 13.1 City Manager City Manager Baldwin spoke of the community clean-up scheduled for the Oasis projects this weekend. Commissioner Grace commented Dania Beach is 110 years old this year, and felt something needs to be put together to commemorate the event. City Manager Baldwin noted staff will analyze an additional tax exemption during the upcoming budget session. City Manager Baldwin commented on the Commission Chamber audio equipment purchase and upcoming hurricane exposition. 13.2 City Attorney City Attorney Ansbro recognized Dominic Orlando, Director of Public Services, for his creative efforts on the Taylor Lane/Taylor Road drainage issue. 13.3 City Clerk—Reminders Tuesday, April 22, 2014 - 7:00 p.m. City Commission Meeting Wednesday,May 7, 2014 - 6:00 p.m. CRA Board Meeting Tuesday, May 13, 2014 - 7:00 p.m. City Commission Meeting Tuesday, May 27, 2014 - 7:00 p.m. City Commission Meeting 14.
