DANIA BEACH CITY COMMISSION
TUESDAY, APRIL 22, 2014 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor Duke called the meeting to order at 7:00 p.m.
Present:

2. Invocation and Pledge of Allegiance
Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 Special event request from Virgin America for an "Earth Day Cleanup" to be held on
Saturday, April 26, 2014, from 10:00 a.m. - 4:00 p.m. at Dania Beach. The applicant
is requesting a special event fee waiver of $150.00, and a waiver of beach parking
fees for 10 volunteers.
3.2 Special Event request from Pierce Promotions for a 'Bass Pro Shop/Bank of America
Promotion" to be held on April 26 & 27, 2014, from 10:00 a.m. - 9:00 p.m. at the
Bass Pro Shop located at 200 Gulf Stream Way
Commissioner Grace motioned to approve the Special Event request for Item #3.1 and
Item#3.2; seconded by Commissioner Jones. The motion carried unanimously.
4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
David Nuby, Jr., 401 SW 12d' Avenue, spoke on behalf of the Shriners of Pompano Beach,
noting they will be hosting their 5t' Annual Diabetes Walk on May 24t' in Fort Lauderdale, and
asked that the City of Dania Beach sponsor a team of 10 for$100.00. City Attorney Ansbro said
he would sponsor a team.
Charles Camacho, 121 NE P Street, gave an update on the Relay for Life event scheduled for
May 3`d and 4 h.
Commissioner Grace commented this is the first year she will miss the Survivors' Dinner due to
a conflicting event.
Commissioner Jones noted he would be in Tallahassee and unable to attend the event.
Gary Luedtke, 4461 SW 34 h Drive, spoke of a July 23, 1993 City-approved payment of up to
$8,000.00 to Real Estate Analysts of Ft. Lauderdale, on SW 17th Street, to do an appraisal of
Melaleuca Gardens and western properties. He requested the City look into whether or not
appraisals were done and, if available, provide this information to the residents so they can
compare property values then to the appraisals to be done by the County relating to the airport
Conveyance and Release Agreements.
Mayor Duke suggested Mr. Luedtke make a public records request to the City Clerk.
Shawn DeRosa, 408 SE 5d' Street, spoke of the following concerns he felt should be addressed
by the City: speeding on SE 5d' Street (asked that the City advocate for stop signs at SE 0
Avenue); deterioration of the roads in the southeast section of Dania Beach; the condition of
residential driveway aprons, particularly on SE 3rd Avenue (questioned if the City could provide
a program to restore the aprons similar to the recycled paint program); dirt piles around the
power poles along SE 3`d Avenue, from 2nd Street to Dania Beach Boulevard; street sweeping;
broken parking machines at the Pier; clean-up of the Winn Dixie property on SE P Avenue; and
investigation of the claim that the original southeast drainage engineering plan, approved by
senior management,was faulty.
Mayor Duke said the suggestion regarding repair of driveway aprons sounds like a resident-
driven initiative, and he does not think it would be a City program as this is a private property
issue. He added the appearance of the aprons could be a code issue. He stated five new parking
meters for the Pier were recently purchased, and the Commission shares the concerns expressed
and has approved a number of initiatives to approve the appearance of the City. Mayor Duke
noted it does not make sense to resurface the streets in the southeast before the drainage issue is
fixed, and Public Services would follow up on the dirt pile issue. Regarding the claim of a faulty
drainage engineering plan, he had previously advised Mr. DeRosa to contact the Inspector
General if he felt anything was done incorrectly, and administration is aware of the allegation.
Commissioner Grace noted staff was aware that a couple parking meters at the beach were not
working and tickets were not being issued because of this. She added that if someone in Mr.
DeRosa's neighborhood needs their house painted,they should contact her.

Vice-Mayor Brandimarte spoke of the drainage pipes on SE P Avenue, noting the new drainage
system will be made of a totally different material, and said street work would commence after
the P
drainage pipes are installed.
Commissioner Jones commented that stop signs require approval from the County, and
suggested Mr. DeRosa speak with Community Development.
Dr. Peter Tomasello,402 SE 5th Street, advocated for stop signs on SE 5th Street.
Mayor Duke noted a letter from another neighbor on 5th Street requesting stop signs had been
distributed to the Commission, and follow-up would be done.
Patricia Tyra, 2912 SW 54th Street, spoke of today's denim theme intended to bring awareness to
sexually assaulted individuals; Sun Sentinel photographs of the Arts and Seafood Festival and
other photo opportunities; and prioritization of beach renourishment.
Teddy Bohanan, 312 SW 15th Street, commented on stalking incidents and activities, and her
hiring of a private detective since she feels BSO cannot stop the stalking of senior citizens.
Mayor Duke asked Chief Granville to follow up.
Rose Lizana, 214 SE 2°d Street, on behalf of the Dania Kiwanis Club, invited everyone to
participate in the annual Kiwanis golf tournament and luncheon on April 26.
6. Public Safety Reports
Captain Kevin Granville, BSO Chief of Police, reported that dump truck citations have decreased
due to the enforcement efforts undertaken. He addressed a burglary conveyance in Melaleuca
Gardens and burglaries at the beach, which have ceased due to deployment of the watchtower.
He spoke of an elderly exploitation case in Meadowbrook that is under investigation and
burglary conveyances in the western area. Chief Granville noted crime overall in the City is
down 15.7%, and then introduced Deputy Paul Auerbach, who has been selected as the agency
Field Training Deputy of the Year for a second time.

Commissioner Grace motioned to adopt the Consent Agenda; seconded by Commissioner
Jones. The motion carried unanimously.
8. Bids and Requests for Proposals
8.1 RESOLUTION#2014-032
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,
ESTABLISHING A FINAL RANKING OF FIRMS SUBMITTING PROPOSALS FOR PIER CONCESSION
MANAGEMENT SERVICES FOR THE CITY; AUTHORIZING THE PROPER CITY OFFICIALS TO
NEGOTIATE AN AGREEMENT WITH THE TOP-RANKED FIRM AND PROVIDE AN AGREEMENT TO
THE CITY COMMISSION FOR ITS APPROVAL; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2014-032.
Mayor Duke gave a brief background on this item.
Commissioner Grace motioned to adopt Resolution #2014-032; seconded by Commissioner
Jones.
Commissioner Jones asked if there was a difference in the management fees among the four
responses, although he knows negotiations will occur with the approved vendor.
Assistant City Manager Donnelly responded that when the issue was brought to the Commission
in November, there had not been negotiations and there was not a finalized deal for a
management contract.
Mayor Duke reviewed the financial loss during the five month process of the RFP, and noted the
importance of making the right decisions at the right time; had the same operator being
recommended now been selected in November, we would be operating in the black rather than in

the red. He asked that consideration be given to letting Dania Beach seniors onto the Pier for
free.
Commissioner Jones said the handicapped and disabled should be given free access if it is given
to seniors. He commented on this item going out to bid, and noted this was done to ensure we
got the best deal for our citizens and beach.

9. Public Hearings and Site Plans
9.1 ORDINANCE#2014-003
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, CREATING
SECTION 21-7, "PROHIBITION OF RIGHT-OF-WAY VENDORS AND SOLICITORS ON CERTAIN
ROADWAYS," OF THE CITY CODE OF ORDINANCES, TO PROHIBIT SOLICITATIONS IN AND UPON
PORTIONS OF CERTAIN ROADWAYS WITHIN THE CITY; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CONFLICTS;FURTHER,PROVIDING AN EFFECTIVE DATE. (SECOND READING)
City Attorney Ansbro read the title of Ordinance #2014-003, and gave a brief summary of its
history and provisions.
Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition,he closed the Public Hearing.
Commissioner Jones motioned to adopt Ordinance#2014-003, on second reading; seconded
by Commissioner Grace. The motion carried on the following 4-0 Roll Call vote:

City Attorney Ansbro advised the remaining items were quasi-judicial hearings and swore-in
those who would speak. He asked the Commission to disclose any communication they had on
these matters.
9.2 ORDINANCE#2014-002
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING
THE REQUEST MADE BY PAUL E.BREWER AND ASSOCIATES, INC.,ON BEHALF OF THE PROPERTY
OWNER, MILE MARKER 55, LLC, TO CREATE A PLAT (PL-55-13) TO BE KNOWN AS THE "MILE
MARKER 55, LLC PLAT", FOR PROPERTY LOCATED AT 801 EAST DANIA BEACH BOULEVARD IN
THE CITY OF DANIA BEACH; ACCEPTING THE DEDICATION FOR PUBLIC USE OF ALL STREETS,

City Attorney Ansbro read the title of Ordinance#2014-002.
Commissioner Grace noted she had been contacted by the developer.
Corinne Lajoie, Principal City Planner, provided an overview of the request for the property
currently known as Weiner's Mobile Home Park.
Mayor Duke opened the Public Hearing.
Paul Brewer, Paul E. Brewer and Associates, Inc., on behalf of the property owner, was available
for questions.
Gerard J. Dour, 801 E. Dania Beach Boulevard, #46, expressed opposition to this project, and
asked the City to not grant any variances to the developer unless the City ensures that the
residents are compensated for the fair market value of their homes and for moving expenses.
Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public
Hearing.
Commissioner Grace motioned to adopt Ordinance 42014-002, on first reading; seconded
by Commissioner Jones.
Commissioner Jones asked if there were any variances granted for this project.
Principal City Planner Lajoie responded there was a variance granted when the Commission
approved the site plan in October 2013.

City Attorney Ansbro read the title of Resolution#2014-029.

Leigh Kerr, planning consultant for the applicant, provided additional details of the purpose of
the request.
Mayor Duke, Commissioner Grace, and Commissioner Jones noted they had been contacted by
the petitioner.
Vice-Mayor Brandimarte asked about the equipment referenced in the agenda backup.
Mr. Kerr responded there would not be equipment per se other than that used to clean and fuel
the cars, and to change the oil.
Commissioner Jones questioned whether the use would transfer with the property if it is sold.
Principal City Planner Lajoie responded in the affirmative.
Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition,he closed the Public Hearing.
Commissioner Grace motioned to adopt Resolution #2014-029; seconded by Commissioner
Jones.
Commissioner Jones commented perhaps there could be signage placed indicating this area is in
Dania Beach.

10. Discussion and Possible Action
10.1 Schedule City Commission Summer Break
The Commission selected July 8,2014 as their summer break.
11. Commission Comments
11.1 Commissioner Grace
Commissioner Grace noted the turnout of volunteers for the Oasis neighborhood cleanup was
fantastic.
Commissioner Grace commented about the Easter Egg Roll event held last Saturday and the
Relay for Life event on May 34.

Commissioner Grace spoke of upcoming social and community events in Dania Beach.
Commissioner Grace noted the PATCH looks very nice and is generating a lot of traffic.
11.2 Commissioner Jones
Commissioner Jones commented on the Kiwanis golf tournament to be held on Saturday.
Commissioner Jones spoke of Memorial Regional Hospital and its designation as the only heart
transplant center in South Broward.
Commissioner Jones invited everyone to join St. Ruth Missionary Baptist Church in the events
scheduled this week celebrating Bishop Curry's 5`h anniversary.
11.3 Vice-Mayor Brandimarte
Vice-Mayor Brandimarte thanked Mr. Camacho for explaining that 73 cents of every dollar
donated goes to cancer research.
Vice-Mayor Brandimarte spoke of a recent conversation with a solicitor at an intersection while
she was stopped for a red light. She felt that, with the adoption of the Ordinance prohibiting
solicitations on certain roadways, somehow a letter should be sent to the bosses of these
solicitors to inform them this activity is now illegal. Additionally, she thinks Chief Granville is
going to have a big job policing this activity where it is now prohibited.
11.4 Mayor Duke
Mayor Duke commented that the numerous complaints regarding the audio and video of this
meeting and others have been addressed; upgrades will be occurring in the next month or so. He
noted the number of visits to the City website and views of the beach cam made last month.
Mayor Duke said beach erosion is a priority of the entire Commission, and spoke of the ongoing
work, which includes being at the table on the Panthers Tourist Tax issue. He noted the deferred
maintenance issues at the beach are being addressed currently, and only so much can be done
about erosion as it is an extremely costly issue. Segment 3, which includes Dania Beach, is in
line for renourishment in the next two to three years, but the City is trying to get it done sooner.
Mayor Duke addressed the newspaper article and television report about access to go south when
leaving the airport not being provided after the runway expansion is completed. He noted the
City has been aware of the plan for south access for many years, and explained how it will be
configured.
Mayor Duke commented that the sound insulation program is considerably behind schedule; City
officials are doing what they can to advocate for the residents. Additionally, the trucks, dirt, and
noise on Griffin Road continue to be addressed.

13. Administrative Reports
13.1 City Manager
13.1.1 Update on SE Stormwater Project
Assistant City Manager Donnelly noted the Public Services Department met with the contractor
and issued a Notice to Proceed, effective May 1st; the construction schedule is 6 to 9 months in
duration. He advised that Public Services is working with Calvin Giordano on Phase II, on some
redesigning of the project and changes to the consulting contract.

From a concerned Neighbor:
I have lived in Dania Beach for 4 years,and bought a home located at the corner of 41h Ave and 5th St.
My physical address is 401 SE 5th St. I would like to bring to the mayors and the commissions attention a
hazardous situation that exists in this very family oriented neighborhood. While there is a stop sign
Controlling traffic flow north and south at the intersection of 4th Ave and 5th Street,there is no stop sign
on the far busier east-west 51h St. On numerous occasions I have observed cars speeding through
the intersection with no regard for speed limits or safety. This is of particular concern because this area
has children who reside in the homes near this intersection,who can be seen skateboarding, playing
basketball, bike riding,dog walking. Also,critically,this is a heavily traveled area for students from
Olson Middle School,as they walk or bike to and from from school.
I would implore the Mayor and The Commissioners to please consider placing a stop sign on 5th Street
at the intersection of 4th Avenue, before we have a tragedy that can be prevented.

Comments by Dania Beach citizens or interested parties that are not part of the regular printed agenda may be made during each
Commission meeting during the period set aside for"Citizen Comments." A thirty(30)minute-Citizen Comments"period shall
be designated on the agenda for citizens and interested persons to speak on matters not scheduled on that day's agenda. Each
speaker shall be limited to 3 minutes for his or her comments. Persons desiring to speak during the citizen comment period shall
inform the City Clerk immediately prior to the beginning of the meeting of their intention to speak. If more than 10 speakers
express a desire to speak,the Commission shall determine on a meeting by meeting basis whether to(a)emend the time allotted
for citizen comments to accommodate all speakers,or(b)whether to limit the number of speakers or amount of time per speaker.
A speaker's time shall not be transferable to another speaker.
