A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO
EXECUTE AN INTERLOCAL AGREEMENT BETWEEN BROWARD
COUNTY AND THE CITY OF DANIA BEACH, FLORIDA, TO ADDRESS A
DRAINAGE RETENTION EASEMENT TO DISCHARGE AND STORE
TREATED STORM WATER RUNOFF AT THE DANIA SALTMARSH TO
BENEFIT WEST LAKE PARK, RELATING TO THE SOUTHEAST STORM
WATER DRAINAGE PROJECT-PHASE II; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, a drainage outfall is a vital component of the Southeast Storm Water
Drainage Project; and
WHEREAS, the County owns certain land in the City known as the Dania Saltmarsh,
referred to as "COUNTY's Property", consisting of approximately eighty (80) acres adjacent to
West Lake Park("Park"); and
WHEREAS, the County manages the Park as an estuarine system that continually
benefits from improved storm water flow through County Property to avoid a hypersaline
condition in the sensitive Park ecosystem; and
WHEREAS, the City and the County desire to enter into an Agreement providing for the
construction and perpetual maintenance by the City of a stormwater retention swale and
inflow/outflow structures on approximately 0.72 acres of County Property for the mutual benefit
of the Parties and for mitigation activities related to the Project; and
WHEREAS, construction of a stormwater retention swale that will be designed as a
bioswale and associated inflow/outflow structures to receive, treat and release excess stormwater
which will sheetflow within the Park, will benefit County by providing additional fresh water to
the Park system thereby improving the ecologically viable habitat in the Park, and benefit the
City by alleviating drainage problems in the Southeast area of the City adjacent to County's
Property;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That the foregoing "Whereas" clauses are made a part of and incorporated
into this Resolution by this reference.
Section 2. That the proper City officials are authorized to execute an Interlocal
Agreement on behalf of the City with Broward County to address drainage outfall for the
Southeast Drainage Project.
Section 3. That the City Manager and City Attorney are authorized to make minor
revisions to the agreement for such services which are deemed necessary and in the best interests
of the City of Dania Beach, as related to the construction.
Section 4. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 5. That this Resolution shall be in full force and take effect immediately
upon its passage and adoption.
