DANIA BEACH CITY COMMISSION
TUESDAY, MAY 13, 2014 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor Duke called the meeting to order at 7:00 p.m.
Present:

2. Invocation and Pledge of Allegiance
Reverend Easu Dalrymple, Lael Baptist Church, gave the invocation followed by the Pledge of
Allegiance to the United States Flag.
3. Presentations and Special Event Approvals
3.1 Approve the Parks, Recreation and Community Affairs Advisory Board
recommendation for a full fee waiver of $300.00 for Collins Elementary School to
utilize the I. T. Parker Community Center for their annual "Student Awards Night" on
May 21, 2014, from 6:00 pm- 9:00 pm.
Commissioner Grace motioned to approve the Special Event request for Collins
Elementary School; seconded by Commissioner Jones. The motion carried unanimously.
3.2 Request from the Dania Beach Improvement Committee to place a piece of
permanent public art near the Dania Beach Library
Bo Donly, representing the Dania Beach Improvement Committee, requested City Commission
approval to place a bronze statue near the front entrance to the Paul DeMaio Library. The costs
associated with the statue would be paid by the Dania Beach Improvement Committee; the City
would provide the concrete pad.
Commissioner Jones motioned to approve the request of the Dania Beach Improvement
Committee; seconded by Commissioner Grace. The motion carried unanimously.
3.3 Fleet Week 5K Ruck Run- Silver Wings Army Paratroopers Jump - Mayor Duke
Mayor Duke presented a video of the Silver Wings Army Paratroopers Jump which took place at
Dania Beach on April 26, 2014.
3.4 Presentation b Creative Arts Council Advisory Board

Kim Ford, Henriette Kitte Arnold, and Joan Gringer, representing the Dania Beach Creative Arts
Council Advisory Board, requested $1,500.00 in funding to host a Dania Beach Signal Box
Artists Reception in the atrium at City Hall on Wednesday, June I Ith, at 6:30 p.m., to recognize
the seven signal box artists. Ms. Ford said the reception will also unveil the atrium as an exhibit
space, and noted the Dania Beach Improvement Committee has already purchased the system to
hang artwork, amounting to approximately $1,000.00, as a donation to the City. She restated
their need for the support of the City.
Mayor Duke suggested the Commission budget for the arts rather than approving allocations on
an as-needed basis.
Commissioner Grace questioned the implementation of signal box art in the northwest section.
Ms. Ford explained the council's desire to extend the program into other areas, and noted
continuing City support of their endeavors would be necessary for the short-term.
Vice-Mayor Brandimarte commented she cannot support an event at City Hall using taxpayers'
money for champagne, food, and waiters for 50 people, as indicated in the agenda backup; the
event should be open to all citizens.
Commissioner Jones said he favors using City Hall for exhibiting art, but has a problem with
selected people being invited to the reception; more citizens should be involved. He noted the
Commission would budget dollars for the council for next year.
Ms. Ford clarified that the event would be open to everyone; the cost quote for 50 people is an
estimate of the number who are likely to attend. She reiterated the dual purpose of using City
Hall as the venue for the reception, as well as their seeking other funding sources.
Commissioner Jones motioned to approve the $1,500.00 funding request of the Dania
Beach Creative Arts Council Advisory Board, with funds coming from the General Fund
Contingency Account; seconded by Mayor Duke.
Mayor Duke asked the City Manager to look for future funding for the next seven or eight signal
box wraps, based on approximately$800.00 per wrap, and the thank-you party to follow.
The motion carried unanimously.
4. Proclamations

5. Citizen Comments
Lois Quatrini, 3037 Lakeshore Drive, expressed concern about kids diving and jumping off the
bridge on Lakeshore Drive, and how her prior complaints to BSO, her HOA office, and the City
have not stopped the problem.
Mayor Duke requested the City Manager follow up with the matter.
Kristin Dridge, 227 SE 8 Street,Vice-President of the Friends of the Library, spoke of the recent
change of officers, and involvement in recent and upcoming events.
Teddy Bohanan, 312 SW 15 Street, commented she is still being stalked, has raised the reward to
$1,500.00, and continues to take a stand for the seniors in Dania Beach.
Charles Camacho, 121 NE 3rd Street, thanked everyone who was involved in the Relay for Life
event.
Patricia Tyra, 2912 SW 54t' Street, acknowledged Nurses' Week and all the nurses in attendance
at this meeting and those watching at home.
Laurence Younghans, 3055 Lakeshore Drive, thanked everyone involved in the clean-up of, and
improvements made to,the Estates of Fort Lauderdale.
6. Public Safety Reports
Captain Kevin Granville, BSO Chief of Police, spoke of a residential burglary in Melaleuca
Gardens and the recent increase in Marina and marine industry burglaries; BSO is working with
other agencies to apprehend those responsible. Burglary conveyances continue to be a problem,
but crime is down 21% citywide. He gave an update on BSO Fire Rescue's seatbelt safety
initiative at Collins and Dania Beach Elementary schools, and noted he will look into the bridge
situation on Lakeshore Drive.

City Attorney Ansbro read the title of Resolution#2014-034.
Commissioner Jones questioned whether or not we could retain water for use in other locations
and suggested we might want to look into it.
Commissioner Jones motioned to adopt Resolution #2014-034; seconded by Commissioner
Grace.
Mayor Duke noted this is part of the plan that is going to service the entire southeast; the runoff
is going to be naturally filtered by a bio Swale that we are going to construct. He agreed that if
there is more water than needed for West Lake Park,we should capture and use it.
The motion carried unanimously.
8. Bids and Requests for Proposals
There were no proposals on this agenda.
9. Public Hearings and Site Plans
City Attorney Ansbro advised items 9.1 and 9.3 were quasi-judicial hearings and swore-in those
who would speak. He asked the Commission to disclose any communication they had on these
matters.
Mayor Duke and Commissioners Grace and Jones said they had been contacted by Wallypark
representatives.

Corinne Lajoie, Principal City Planner, provided an overview of the request for the property
currently known as Weiner's Mobile Home Park. She noted she received a letter of objection
today, a copy of which is attached to and incorporated in these minutes.
Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or

City Attorney Ansbro read the title of Ordinance#2014-004.
Corinne Lajoie, Principal City Planner, provided an overview of all the proposed amendments to
the Land Development Code.
Commissioner Grace questioned whether safeguards would be in place with brewpubs located in
close proximity to churches and schools on Federal Highway.
Principal City Planner Lajoie responded a 1,000 foot separation would be required for tasting
rooms where consumption would occur.
Mayor Duke opened the Public Hearing.
Charles Camacho, 121 NE P Street, asked for clarification regarding fleet parking.

Principal City Planner Lajoie explained the intent is for contractor service vehicles, such as an air
conditioning contractor, and is not for vehicle storage.
Randy Wright, 43 SW 34th Lane, questioned whether onsite sales for brewpubs should be higher
than the required 25.1% since onsite sales is their primary purpose. He noted offsite sales cannot
exceed 75%, and asked how and when this production is going to be monitored, whether onsite
sales can be averaged when there is a shortfall, who will do the monitoring, and how much it will
cost the City. Further, he asked what the consequences would be if a brewpub was reclassified
as a microbrewery due to exceeding the maximum for offsite sales, and whether brewpub
production should be limited. Mr. Wright questioned monitoring of production and sales for
microbreweries, and whether the brewpub and microbrewery classifications should be combined.
He asked similar questions concerning the micro distillery classification.
Marc LaFerrier, Director of Community Development, asked the Commission to pass the
ordinance on first reading, and noted questions would be answered during the presentation at
second reading.
Rae Sandler, 1433 Argonaut Isle, asked where and what neighborhood mixed use zoning districts
are affected.
Principal City Planner Lajoie explained they are located in the CRA area, which is east of I-95,
and the zoning map, available on the City's website, would be helpful.
Mayor Duke asked that the zoning map be included in the backup for second reading of the
ordinance.
Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public
Hearing.
Commissioner Grace motioned to adopt Ordinance #2014-004, on first reading; seconded
by Commissioner Jones. The motion carried unanimously.

Tuesday,May 13,2014—7:00 p.m.
Corinne Lajoie, Principal City Planner, provided an overview of the request, noting the text
amendment is specific to the IRO Zoning District citywide.
Leigh Kerr, planning consultant for the applicant, made a presentation. He noted they will
include the name Dania Beach on property identification signs, and there will be no heavy
equipment on site.
Mayor Duke opened the Public Hearing.
Rick Fairchild, 2100 S. Ocean Drive, Fort Lauderdale, commented his family made a similar
request in 2010 for the PEDD zoning district and they had to go a different route to obtain
approval. He questioned why staff is supporting a text amendment in this situation and why the
applicant does not request rezoning to PEDD instead.
Principal City Planner Lajoie noted that PEDD is a very different zoning district because it is
shared by four different governmental agencies and would require filing a petition with each of
the agencies.
Charles Camacho, 121 NE 3`d Street, questioned the parking capacity of the property and
whether this would cause traffic issues with the new southbound exit from the airport.
Mr. Ken explained three-fourths of the site is an existing facility and additional parking will be
added to the NISA Plat; the number is unknown as the site plan is not complete. He noted the
airport southbound exit would be south of the subject site.
Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public
Hearing.
Commissioner Jones motioned to adopt Ordinance #2014-006, on first reading; seconded
by Commissioner Grace. The motion carried unanimously.
10. Discussion and Possible Action
10.1 City Commission Vacancy—Commissioner Jones
Commissioner Jones nominated C.K. McElyea to fill the vacant Commission position;
seconded by Vice-Mayor Brandimarte. Motion failed on the following 2-2 Roll Call vote:

Jackie Plybon, 7080 Nova Drive, Davie, commented about the failure to appoint former
Commissioner C.K. McElyea.

11. Commission Comments
11.1 Commissioner Grace
Commissioner Grace commented CX McElyea is a good man and she always supported him
when he supported her. She said wait until November and pick your candidates.
Commissioner Grace spoke of community activities and events.
Commissioner Grace noted the 5:00 p.m. closing time for the cemeteries needs to be changed as
there are people who wish to visit later, and flowers need to be planted around the palm trees
along Phippen Waiters Road.
Commissioner r G ace questioned why we are charging for handicap parking at the beach, and
said this issue and whether we have enough handicap parking could perhaps be discussed at
budget time.
11.2 Commissioner Jones
Commissioner Jones spoke of church and community events.
Commissioner Jones commented about the CRA community input meetings he attended.
Commissioner Jones noted that the flooding at the PATCH needs to be addressed.
Commissioner Jones provided details of the County Housing Stability Program.
Commissioner Jones commented to Commissioner Grace about the event on Saturday where he
will be honored.
Commissioner Grace responded that if she wanted something on the agenda, it would be there,
and she feels the City should not pay for a table if it is not a sponsored event.
11.3 Vice-Mayor Brandimarte
Vice-Mayor Brandimarte commented she paid for her ticket as did the seniors in the club.
Vice-Mayor Brandimarte noted Broward County only has two mosquito trucks; they need to get
more as the northwest area of Dania Beach is particularly suffering from an infestation that
requires more than one spraying.
Vice-Mayor Brandimarte said PATCH flooding must be addressed and the soil should be tested
because the lumber around the plants is treated with chemicals; this puts the organic label in
question.
11.4 Mayor Duke

Mayor Duke noted enforcement of the pandering ordinance began on Monday.
Mayor Duke commented the PATCH was built on a retention site and it will require money to
raise the elevation.
Mayor Duke spoke of a resolution recently approved by the Commission providing for a payroll
deduction for an employee loan program, and cautioned that the interest rate is very high.
Mayor Duke read a letter from Bridge Development Partners complimenting Community
Development Department staff.
12. Appointments
Commissioner Jones motioned to re-appoint all of former Commissioner Flury's board
appointments; seconded by Vice-Mayor Brandimarte. The motion failed on a 2-2 voice
vote.
Mayor Duke noted one of his appointments to the Marine Advisory Board, James Reckart,
moved and he would like to appoint Mike Grady to take his place.
Commissioner Grace motioned to approve the appointment; seconded by Mayor Duke.

13. Administrative Reports
13.1 City Manager
City Manager Baldwin commented the budget is being prepared; BSO's budget next year for law
enforcement will come in at less than a 1% increase, and the Fire Department budget will be
approximately 7% higher. Meetings are scheduled with BSO to negotiate a new contract for law
enforcement and to discuss that budget and the one for fire rescue. He noted a budget calendar
will be forthcoming.
City Manager Baldwin said the southeast stormwater project is beginning.
City Manager Baldwin advised Phippen Waiters Road has been inventoried; we are in the
process of replacing landscaping, correcting deficiencies due to the lack of irrigation, and getting
bids for trees.

City Manager Baldwin noted the marina should be completed on time, Oasis VIII will be brought
to the Commission for approval to bid, responses for the Ocean Park Revitalization RFQ are due
May 23, and the hurricane prepare-a-thon is coming up on June 7.
Mayor Duke asked the City Manager to address two budget-related matters: commercial waste
haulers are slacking and not paying what is owed to the City; and ensuring we get a return of the
tourist tax revenues collected by the County as Dania Beach is the third largest contributor to the
tax.
13.2 City Attorney

This letter is to express my opposition to the project proposed by Mile Marker 55 LLC for the property
currently known as Weiner's Mobile Home Park.
I will not be in attendance at the May 13th 2014 public hearing. I attended the previous two meetin s
and it was stated that the project was already approved.This makes me wonder what purpose li
meeting serves when the outcome is pre-determined.This does not sound moral or legal me. public
I am asking that you reconsider this project,and as I stated at the previous meetings there are many
current Dania Beach residents that will lose their homes who were not informed as to what was
happening with the project,and were under the impression they would be properly compensated based
on the condition and value of their property.
So I am asking again, please do not grant anything more than is legally required of
you when
approvals or variances to this project unless Mile Marker 55 LLC compensates the current pa k'ving resiidents
fairly for their losses. Fair compensation would amount to a miniscule fraction of the total cost for the
Project. There are currently no gargantuan projects towering over our quaint small town and this will be
the start of a massive influx of sun blocking ugliness destroying the towns charming atmosphere all in
the name of the city receiving more tax dollars.
