DANIA BEACH CITY COMMISSION
TUESDAY, MAY 27, 2014— 7:00 P.M.
1. Call to Order/Roll Call
Mayor Duke called the meeting to order at 7:00 p.m.

2. Invocation and Pledge of Allegiance
Pastor Juan Cuevas, Maranatha Ministries, gave the invocation followed by the Pledge of
Allegiance to the United States Flag.
3. Presentations and Special Event Approvals
3.1 2014 Comprehensive Emergency Management Plan (CEMP) — Battalion Chief Sean
Brown, BSO Fire Marshall's Office
Battalion Chief Sean Brown, BSO Fire Marshall's Office, provided an overview of the 2014
Comprehensive Emergency Management Plan.
Commissioner Jones asked why there was no coordination with Memorial Hospital, and
Battalion Chief Brown responded the local hospitals should be listed in the plan.
Commissioner Grace motioned to approve the 2014 Comprehensive Emergency
Management Plan (CEMP); seconded by Commissioner Jones. The motion carried
unanimously.
Patricia Tyra, 2912 SW 50 Street, questioned if people in mobile home parks were eligible for
the pet shelters, and Battalion Chief Brown responded in the affirmative.
3.2 Special Event request from the American Cancer Society to have a "Relay for Life
Car Show", to be held on June 7, 2014, in the Dania Beach Jai Alai parking lot from
10:00 a.m. - 8:00 p.m. The applicant is requesting a special event fee waiver of
$150.00.
Commissioner Grace motioned to approve the Special Event request for the American
Cancer Society, including the fee waiver; seconded by Commissioner Brandimarte. The
motion carried unanimously.
3.3 Special Event request from Neptune Fireworks to have a "Fireworks Sale", at 768 E.
Dania Beach Boulevard, from June 6 - July 12, 2014, from 9:00 a.m. - 9:00 p.m.
Commissioner Grace motioned to approve the Special Event request for Neptune
Fireworks; seconded by Commissioner Jones. The motion carried unanimously.
4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
Derrick Hankerson, 746 SW 3`d Street, requested plants on Phippen Waiters Road and solar
lighting for College Gardens.
Carolyn Jones, 722 SW 3rd Street, introduced Tiara Brown, Akia McGee, Zachary McKinney,
and Laquitney Curry, the scholarship winners of the 2014 Martin Luther King Charitable
Corporation Scholarship.
Kristin Dridge, 227 SE 8t' Street, President of the Friends of the Library, provided an update of
upcoming events and new programs.
Gary Luedtke, 4461 SW 34d' Drive, requested the City look up a payment made to a company
regarding an appraisal of Melaleuca Gardens and properties west of the airport. He addressed
the City's 60 daytime and 55 nighttime decibel noise level limitations, and questioned if there
was something that could be done once the jets begin flying over the City in September.
Randy Wright, 4391 SW 34d' Lane, commented the Airport Advisory Board requests
reinstatement of the three members that were removed with Commissioner Flury's departure, so
they could have a full board in order to assist residents with the expansion of the Fort Lauderdale
airport. He noted the sound mitigation program is behind schedule, and there has been no new
activity in seven months. He asked what the Commission was doing to ensure the County keeps
its promise that the sound insulation would be completed before the opening of the airport.
Additionally, he said the AAB has been trying to get the County to attend a meeting, and asked if
the Commission could help in this regard.

Commissioner Jones appealed to the Commission to install the members of the AAB, and
motioned to reappoint the former AAB members or appoint new members.
Mayor Duke suggested making appointments during that portion of the agenda.
6. Public Safety Reports
Captain Kevin Granville, BSO Chief of Police, introduced several members of his staff, and
provided an update of crime in the City.
There was a special presentation by Lt. Robert Furman and Ellie Flury on the partnership
program with Scholastic Books to provide reading rooms and books in elementary schools. Lt.
Furman noted they are trying to get organizations involved and participate in the cost involved.

Commissioner Grace motioned to adopt the Consent Agenda, with the exception of Items
#7.3,#7.9, and#7.10; seconded by Commissioner Jones. The motion carried unanimously.
7.3 RESOLUTION#2014-038
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING THE APPROPRIATION OF FUNDS FOR FISCAL YEAR 2013-2014, RELATING TO MID-
YEAR REVIEW BY CITY ADMINISTRATION, INCLUDING ADJUSTMENTS PERTAINING TO UTILITY
SERVICE WORKER AND METER READING STAFF; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2014-038.
Commissioner Jones requested information on the line item transfers, in particular the
$92,000.00 for solid waste bulk disposal services, and the process used for employee payout.
Mark Bates, Finance Director, explained the solid waste bulk cost was an oversight in the
budgeting process last year, and the added funding for staff payout of leave benefits is to cover
the unplanned retirement of employees during the past six months, which is paid out at the rate
the employee is making when he or she departs.

7.9 RESOLUTION#2014-044
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING APPROVAL OF AN ASSIGNMENT OF THE CONTROLLING INTEREST IN THE DANIA
BEACH GRILL, INC., A FLORIDA CORPORATION TO LAURIE BARTH, AN INDIVIDUAL; PROVIDING
FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2014-044.
Vice-Mayor Brandimarte questioned if we had a clause that would protect the City from a
lawsuit for any loss of business during the revitalization of the beach.
Jason Dubow, representing Laurie Barth, noted he has worked with the City Attorney and an
agreement has been signed by Ms. Barth.
Vice-Mayor Brandimarte motioned to adopt Resolution #2014-044; seconded by
Commissioner Jones.
Commissioner Jones clarified with the City Attorney that this does not prevent us from going out
to bid in 2019.
The motion carried unanimously.

City Attorney Ansbro noted a letter of support was received today from Best Friends Animal
Society.

City Attorney Ansbro read the title of Ordinance#2014-004.
Corinne Lajoie, Principal City Planner, provided an overview of all the proposed amendments to
the Land Development Code, including the changes discussed at first reading of the ordinance.
She noted a particular statement that refers to usage of fees needs to be struck from the
ordinance.

9.4 ORDINANCE#2014-007

THE CITY CODE OF ORDINANCES TO REPEAL CHAPTER 12, ENTITLED "FLOOD DAMAGE
PREVENTION' AND ADOPTING A NEW CHAPTER 12, ENTITLED "FLOOD DAMAGE PREVENTION";
ADOPTING FLOOD HAZARD MAPS, DESIGNATING A FLOODPLAIN ADMINISTRATOR; ADOPTING
PROCEDURES AND CRITERIA FOR DEVELOPMENT IN FLOOD HAZARD AREAS, AND FOR OTHER
PURPOSES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING

City Attorney Ansbro read the title of Ordinance#2014-007.
Marc LaFerrier, Director of Community Development, noted the importance of adopting the
ordinance.
Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, he closed the Public Hearing.
Commissioner Jones motioned to adopt Ordinance #2014-007, on first reading; seconded
by Commissioner Grace.
Director LaFerrier confirmed new flood plain maps would be available to the public.
The motion carried unanimously.
10. Discussion and Possible Action
10.1 City Commission Meeting Schedule
City Manager Baldwin noted a survey was prepared for the Commission with information on
meeting times and summer schedules of other cities in Broward County. If the Commission
wants to change the start time of meetings, a resolution is required and will be prepared for the
next meeting. He further noted the Commission can change their summer work schedule at their
pleasure.
Mayor Duke questioned whether there would be issues if the Commission took off a meeting in
August. Director LaFerrier responded there were no issues with Community Development.
Commissioner Jones motioned to cancel the August 12, 2014 City Commission meeting;
seconded by Vice-Mayor Brandimarte. The motion carried unanimously.
The consensus of the Commission was to keep the regular meeting times at 7:00 p.m.

11.1 Commissioner Grace
Commissioner Grace had no comments.
11.2 Commissioner Jones
Commissioner Jones questioned the status of the stop signs requested at the last Commission
meeting. Dominic Orlando, Director of Public Services, responded the request was sent to
Broward County Engineering for review, and added staff does not recommend installation of the
stop signs. He noted the City will have to be responsible for the entire maintenance of the
intersections if traffic signs are installed.
Commissioner Jones noted the Ely Boulevard corridor needs to have the trees trimmed, and NW
1st Street needs landscaping. Director Orlando said he will look at it.
Commissioner Jones stated a light is out at the northwest corner of Meli Park.
Commissioner Jones provided County housing stability program information for those in need.
Commissioner Jones requested that the Commission be kept posted on the status of the drainage
project underway on Taylor Lane.
Commissioner Jones noted FDOT will hold a public workshop on the implementation of the I-95
Express Lanes on June 3ra
Commissioner Jones spoke of social events, and thanked those who attended his event for their
support.
11.3 Vice-Mayor Brandimarte
Vice-Mayor Brandimarte commented on a summer program that 30 underprivileged children
will not be able to participate in this year due to lack of funding. She asked if BSO could
possibly sponsor the program.
11.4 Mayor Duke
Mayor Duke commented the solar lights and landscape projects, unless they are just fixes, need
to be budget issues and planned.
Mayor Duke spoke of the commercial franchise fees collection issue he raised at a previous
meeting. City Attorney Ansbro noted we are current with the franchise fees.
Mayor Duke addressed the airport issues discussed at this meeting and noted he is personally in
constant contact with BCAD, the County, and attorneys; to a certain extent this is out of the
Commission's control because it is a County project. He added Director LaFerrier is doing a
great job keeping everyone informed. The sound insulation program, which now includes

HVAC, is way behind; other than staying on top of the situation and doing the best we can, it is
out of our control.
Mayor Duke commented board appointments are important, but the principle is still the same; if
the Commission seat gets filled,the appointments will be made.
Mayor Duke asked the City Attorney to find out about the 1993 appraisal of properties in
Melaleuca Gardens and the noise ordinance noted by Gary Luedtke. City Attorney Ansbro said
noise from airplanes cannot be addressed through our noise ordinance.
Commissioner Jones commented that just because the Commission agreed to the ILA, it does not
mean that we do not continue to be engaged and monitor the situation.
12. Appointments
Commissioner Jones motioned to re-appoint former Commissioner Flury's Airport

City Manager Baldwin addressed the outstanding issues with commercial waste haulers doing
business in Dania Beach and not reporting it.
City Manager Baldwin noted Nicki Grossman will make a presentation relative to the tourist tax
in September or October.

City Manager Baldwin said three bids were received for the Ocean Park Revitalization Plan, the
Sabal Palms should start in early June, and approval to bid Oasis VIII and the bid award for
Oasis V will be brought to the Commission on June 24t'
City Manager Baldwin spoke of addressing problems in the neighborhood of Oasis I.
City Manager Baldwin noted Kent George was unaware the plans for Taylor Lane had been
submitted by the City in April.
City Manager Baldwin commented on the Hurricane PrepareAthon.

Re: Consideration of a Pet Sales Ordinance
Dear Mayor Duke and members of the Commission,
On behalf of Best Friends Animal Society, a national animal welfare organization in its
thirtieth year, I would like to offer our support for an ordinance to restrict the retail sale
of dogs and cats in Dania Beach pet stores. We urge you to join the other seventeen
municipalities in Florida that have made the change to no longer allow pet stores to sell
commercially bred companion animals, unless the animals come from shelters or rescue
groups.
Pet mills, particularly puppy mills, are a serious problem in the U.S. These facilities, which
supply nearly 100% of retail pet stores and online retailers, are cruel and inhumane facilities
in which profit and maximum productivity take priority over the welfare of the animals.
Although the USDA regulates these breeders, the minimum federal standards do not ensure
a humane life for dogs; in fact, they do little more than require food and water. These types
of kennels can legally have hundreds- often a thousand- dogs in one facility, and these
dogs are allowed to be confined to very small cages for their entire lives.
Because the goal is to make a profit, pet mill owners must cut corners to keep expenses low
and profits high. For the unsuspecting consumer, this frequently results in the purchase of a
pet facing an array of immediate veterinary problems or harboring genetic diseases that
surface down the line. This creates a financial burden on the consumer and results in many
of these animals being surrendered to overcrowded shelters.
It makes little sense to continue manufacturing dogs and cats when so many are being killed
for lack of space. Public education has been effective, but until communities take the
initiative to limit the supply of pets being imported from substandard commercial facilities,
there can be no hope of preventing these unnecessary deaths.
Those who benefit most from companion animal sales in pet stores are the retailers
themselves. While they may profit from the practice of buying these pets at a low price from
commercial brokers and then selling them (typically without first spaying or neutering them)
at a high price, it is the taxpaying public who pays for animal control to house and kill
unwanted animals in the community.

Pet stores that sell commercially bred animals can be part of the solution rather than the
problem, simply by either stopping pet sales altogether (and focusing on other profitable,
ancillary components such as grooming, daycare or pet supplies), or by changing to a
business model that offers products, services, and space for animal rescue organizations to
adopt out animals from their stores.
Best Friends has partnered with several of the many pet stores that have transitioned from
selling milled dogs and cats to offering rescued pets for adoption, and we have found this
"humane" model to be both viable and embraced by the communities in which the stores are
located. Thus, a restriction on the retail sale of pets would not preclude pet stores from
staying in business, and could in fact alleviate a significant burden on the city by increasing
pet adoptions.
Best Friends and our members thank you for taking a compassionate, common sense
initiative to addressing the pet mill crisis in your community and setting a positive example
for the rest of the country to follow. We have been proud to work with many of the
municipalities throughout North America that have enacted similar ordinances (including Los
Angeles, Chicago and San Diego), and we are proud to support you in your efforts as well. I
