Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Commissioners: Bobbie H. Grace Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson Absent: Vice-Mayor: Chickie Brandimarte Commissioner Jones motioned to excuse the absence of Vice-Mayor Brandimarte. The motion died for lack of a second. 2. Invocation and Pledge of Allegiance Reverend Doctor Gregory Pope,First Bethel Baptist Church of Dania Beach, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals Commissioner Jones invited the 7-member Real Estate Development class from Nova Southeastern University to make their final team presentation to the City Commission. The class has been studying how to revitalize downtown Dania Beach, from Dania Beach Boulevard northward for up to three blocks on both sides of Federal Highway. Dan Murphy, Economic Development Manager, introduced Michael Maxwell, Professor, and member of the Urban Land Institute, and the students who worked on the project. Michael Maxwell, Professor, and member of the Urban Land Institute, provided an overview of the project,which is attached to and incorporated into these minutes. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Fay Bartelmes, 214 SW 2nd Terrace, spoke about the tree problems at Community Baptist Church on SW 30th Avenue, and asked if the City could make the property owner trim the tree behind the church in order to discourage the ongoing activity there. Mayor Duke asked the City Manager to have Code Compliance look into the issue. Jessica Digirolamo, 6842 NW 31 st Avenue, Ft. Lauderdale, representing the Cultural Arts Exchange, noted they have chosen the City of Dania Beach to be their home, specifically the old Dania Bank Building. Shawn DeRosa, 408 SE 5th Street, asked for help with: uncapped clean-outs behind his house; the City to budget for extermination of rats and vermin; large dirt piles on SE 3rd Avenue; 10' flags on Federal Highway; City follow-up on complaints, including asphalt issues at Sheridan and Dixie Highway; and litigation on faulty flood pumps and whether the City has been reimbursed. He also asked for stop signs on SE 5th Street, in order to create a safe environment. Mayor Duke suggested they contemplate speed humps, as opposed to street signs because the County will not allow the installation of stop signs. Karen Campion,420 SE 5th Street, addressed the issue of stop signs for SE 5th Street. John Hennigan,401 SE 5th Street, addressed the need for stop signs on SE 5th Street. Tamara James, 255 NW Tamara James Avenue, provided information on an upcoming Tamara James Fun Day to be held in the city of Hollywood. She asked the City for $2,500.00 to help make the event happen. Commissioner Jones asked if she would someday consider having the event in Dania Beach. Ms. James responded that Dania Beach does not have a facility to accommodate the event. Commissioner Grace motioned to give the Tamara James Foundation $2,500.00, from Contingency; seconded by Mayor Duke. Commissioner Jones objected to the motion because it sets a precedent by welcoming others to come to the podium to ask for money. The motion carried 2-1,with Commissioner Jones voting no. 6. Public Safety Reports Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,June 24,2014—7:00 p.m. Captain Kevin Granville, BSO Chief of Police, introduced Major Oscar Larena and Lieutenant Manfrey. He spoke of auto burglary conveyances, and asked the residents to lock their vehicles and remove items that encourage this type of activity. Michael Cassano, Assistant Chief Operations, BSO Fire Rescue, reported on the results of the Buckle Up Safety Belt Initiative at the elementary schools. Commissioner Grace asked if the Fire Department was doing a car wash in July for the Relay for Life. Assistant Chief Cassano said he will check with the department. 7. Consent Agenda 7.1 Minutes: Approve Minutes of June 10, 2014 City Commission Meeting 7.2 Travel Requests: None 7.3 Approve annual Business Tax Receipt Renewals for Fortunetellers and Auctioneers; and approve Extended Hours for Dania Beach Grill Resolutions 7.4 RESOLUTION#2014-047 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, IN SUPPORT OF THE CHILDREN'S SERVICES COUNCIL OF BROWARD COUNTY, FLORIDA; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. 7.5 RESOLUTION#2014-048 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH WESTREC MARINA MANAGEMENT, INC. FOR MANAGEMENT OF THE DANIA BEACH FISHING PIER; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Commissioner Grace motioned to adopt the Consent Agenda; seconded by Commissioner Jones. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Marc LaFerrier, Director of Community Development, gave a brief overview and was available to answer questions. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition,he closed the Public Hearing. Commissioner Grace motioned to adopt Ordinance #2014-007, on second reading; seconded by Commissioner Jones. The motion carried unanimously. 9.2 ORDINANCE#2014-005 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, TO AMEND THE LAND DEVELOPMENT CODE BY AMENDING ARTICLE 810 "IMPACT FEES" TO PROVIDE FOR ADOPTION OF A MITIGATION FEE PROGRAM ASSOCIATED WITH THE MITIGATION OF TRAFFIC IMPACTS ASSOCIATED WITH THE MODIFICATION OF PERMITTED USES WITHIN THE AREA DESIGNATED AS THE DANIA BEACH REGIONAL ACTIVITY CENTER("RAC')BY THE FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN, AS OUTLINED IN THE BROWARD COUNTY LONG RANGE TRANSPORTATION PLAN ("LRTP"); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. The motion carried unanimously. 9.3 RESOLUTION#2014-049 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, PROVIDING FOR A FEE SCHEDULE FOR THE MITIGATION FEE PROGRAM ASSOCIATED WITH THE MITIGATION OF TRAFFIC IMPACTS FOR THE AREA WITHIN THE DANIA BEACH REGIONAL ACTIVITY CENTER ('RAC'), DESIGNATED ON THE FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN, AS Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,June 24,2014—7:00 p.m. OUTLINED IN THE BROWARD COUNTY LONG RANGE TRANSPORTATION PLAN ("LRTP"); PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2014-049. Corinne Lajoie, Principal City Planner, noted this item is the fee schedule for Item 9.2. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Commissioner Grace motioned to adopt Resolution #2014-049; seconded by Commissioner Jones. The motion carried unanimously. 9.4 RESOLUTION#2014-050 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-011-14) SUBMITTED BY EVAL LEVY ON BEHALF OF THE PROPERTY OWNER OFER BEN SHOSHAN FOR PROPERTY LOCATED AT 4430 SW 32ND AVENUE IN THE CITY OF DANIA BEACH,FLORIDA;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution #2014-050. He advised this is a quasi-judicial hearing and swore-in those who would speak. He asked the Commission to disclose any communication they had on this matter. Commissioners Grace and Jones noted they had been contacted. Corinne Lajoie, Principal City Planner, provided an overview of the proposed site plan. Susan Delegal, representing the applicant, noted there will be a 41-slip marina associated with the project; however, it is not part of tonight's site plan. Mayor Duke opened the Public Hearing. Mona Thornton, 4665 SW 32°d Avenue, expressed concerns with the stormwater runoff associated with the project, as her home is currently prone to flooding. Commissioner Grace suggested contacting Broward County Vice-Mayor Tim Ryan to see if the County is going to be doing something in this area to help alleviate the problem. William Buckner Wheeler, 4601 SW 30d' Way, noted the dock slips will be infringing upon the underwater property rights of the current owners. He said those rights are deeded out to the middle of the waterway. Attorney Delegal responded that the project will not infringe upon the property rights of the current homeowners. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,June 24,2014—7:00 p.m. Silvio Quaranta, 4531 SW 30"' Way, noted he owns 60' into the canal. He also expressed concern with the look of the proposed buildings. Jay Field, 4501 SW 30t' Way, commented he is concerned with the light pollution from the project;the type of landscaping; and if they will be allowed to install docking poles. Principal City Planner Lajoie addressed the applicant's lighting and landscaping plans, and noted they meet code requirements. Director LaFerrier explained the code only allows a dock or dolphin pile to extend 10% of the width of the canal. He noted Broward County is the permitting agency for the docks; the City would determine the maximum width of the docks. Ed Nater, 3065 SW 45th, spoke against the project. William Buckner Wheeler, 4601 SW 30d' Way, commented this community is made up of homes, and asked the applicant to construct bigger homes, as opposed to concrete buildings. Attorney Delegal noted they are in compliance with all City codes and have not requested any variances or special exceptions. She said they are trying to do everything possible to be good neighbors, and noted the issues with the docks are not part of tonight's site plan. Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public Hearing. Commissioner Grace asked if they would be willing to include speed humps in their development. Attorney Delegal said they would work with the City as this would require the engineer to look into it. Commissioner Jones questioned if the owner was willing to consider parallel docks, as opposed to perpendicular docks. William Buckner Wheeler, 4601 SW 30d' Way, said the pilings, and fill in the waterway caused by the collapsed seawall, need to be addressed tonight before this project goes any farther. Attorney Delegal responded that permits are required for the construction of the docks and seawall, and she has not seen those yet. Commissioner Jones motioned to deny Resolution#2014-050; seconded by Mayor Duke. Mayor Duke suggested the applicant go back and take a look at the issue of the navigable waterway and the marina aspect. Additionally, he would also like to see denser landscaping and less of a concrete block look to the buildings. He suggested deferring this item until the next meeting so that these concerns can be addressed. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,June 24,2014—7:00 p.m. Attorney Delegal pointed out that the site plan presented tonight meets all of the code requirements. Commissioner Jones rescinded his motion to deny, and motioned to continue the item to the July 22,2014 City Commission meeting at 7:00 p.m.; seconded by Mayor Duke. William Buckner Wheeler, 4601 SW 30th Way, commented the applicant needs to clean the canal before they proceed. The motion carried on the following 3-0 Roll Call vote: Commissioner Grace Yes Mayor Duke Yes Commissioner Jones Yes 10. Discussion and Possible Action 10.1 Approve 38th Year CDBG Update to the Solar Lighting Plan Fred Bloetscher, Consultant of Public Utility Management & Planning Services, Inc., spoke of the issues involved with the installation of the solar street lights. Commissioner Jones noted the Commission has a solar lighting policy; the lights for the park should come from the City, not from CDBG funds. City Manager Baldwin concurred that Commissioner Jones was correct, and apologized that the policy was not followed as it should have been. He confirmed that the Commission agrees to the changes that were made in the plan. 11. Commission Comments 11.1 Commissioner Grace Commissioner Grace commented on community and civic events. Commissioner Grace noted solar lighting has been requested for the 200 block of NW 8th Avenue. Commissioner Grace spoke of the Marina Ribbon Cutting ceremony and commended Assistant City Manager Donnelly for the fantastic job in obtaining grant money. Commissioner Grace noted the bus bench at 1st& 1 Oth Court needs a shelter. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,June 24,2014—7:00 p.m. 11.2 Commissioner Jones Commissioner Jones asked what type of plan is in place for flooding at the PATCH, and suggested looking at raising its elevation up to the level of the facilities. He said other cities, as well as the Miami Dolphins, want to be involved with the PATCH. Issues need to be handled as soon as possible and we cannot let this project fail. City Manager Baldwin noted he would be meeting with Director Earle on Friday. Commissioner Jones questioned if there were updates on signage and drainage improvements on Taylor Lane. City Manager Baldwin said the airport has not submitted the plans, and we are waiting on the County at this point. Commissioner Jones asked about signage on SE 4th Avenue and 5th Street. City Manager Baldwin noted the County looked at the locations; staff is looking into other types of signs and Chief Granville was notified of the reported speeding problem. Commissioner Jones thanked staff for the trimming of the trees in College Gardens. Commissioner Jones requested a list of streets scheduled for paving. City Manager Baldwin said street repaving is in this year's budget and there will be some in next year's budget. Commissioner Jones asked if there is a plan coming for maintenance along SW 2nd Avenue, NW 1st Street, and Phippen Waiters Road. City Manager Baldwin noted landscaping improvements to Phippen Waiters Road have been made and they will continue. The Commission will need a discussion and policy on swale maintenance. Commissioner Jones said he would like to have this discussion at the upcoming budget hearings. Commissioner Jones spoke of a letter from State Senator Eleanor Sobel regarding her request that the State look at the southbound ramp from the airport. He said he wants a letter sent from the Commission letting her know that she represents Dania Beach and we want to be part of the discussion. Commissioner Jones provided details of a letter of updates, received by the Commission, on the County's sound insulation program. He noted the FAA agreed to include air conditioning as part of the upgrade. Commissioner Jones remarked that the new Marina is beautiful. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,June 24,2014—'7:00 p.m. I 11.3 Vice-Mayor Brandimarte Vice-Mayor Brandimarte was not present at this meeting. 11.4 Mayor Duke Mayor Duke congratulated Assistant City Manager Colin Donnelly on the fantastic job on the City Marina. 12. Appgintments Commissioner Jones motioned to re-appoint Commissioner Flury's board appointments. The motion died for lack of a second. 13. Administrative Reports 13.1 City Manager City Manager Baldwin advised individual meetings will be scheduled with the Commission regarding the budget, and asked the Commissioners to contact his office to set a date. Unless the Commission provides other direction, staff will continue preparing the budget around the current millage rate. He added an affirmative vote is required when the budget is presented in order to keep the millage at the current rate; otherwise, the rate will go to the rollback and we will lose approximately $400,000.00, making cuts necessary. He noted citywide beautification is incorporated in this year's budget. City Manager Baldwin provided an overview of projects throughout the City: • Oasis V—has to be re-bid due to insufficient bidders • Oasis VI & VII — bids are due this week and are scheduled for award at the July 22nd meeting • Oasis VIII —Melaleuca Gardens favors replacing street signage and posts rather than the kiosk • Oasis I—is getting some program modification, which will apply to the other programs • In concert with Dania Beach Heights, options to improve this neighborhood and others have been looked at • Staff did a walk-around last week and we are looking at new property inventories, alley inventories and maintenance, property maintenance education to the public, and some crime prevention measures • A recommendation will be brought to the July 22nd meeting to use LETF funds to start a Smart Water program, which helps identify stolen property, in the Dania Beach Heights area; Community Development is preparing a report which will be submitted to the Commission and Dania Beach Heights Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,June 24,2014—7:00 p.m. • Ocean Park Revitalization Plan — was approved at the last Commission meeting and the agreement currently being negotiated with EDSA is planned to be brought to the Commission on July 22nd • City Attorney and staff are looking at a PACE program which will allow property owners to borrow money for home and property improvements, and have it paid back on their property taxes; a full analysis of the program will be brought to the Commission • Audio improvements in the Chamber have been made and will be tweaked; a new parliamentary system is being looked at • Entryway signage as part of the airport settlement — working with the architect and we will be using students to assist in the designs • Pier management contract—with tonight's approval, we should have a first class pier • Southeast Stormwater Project, Phase I — is underway; all stumps have been removed and construction should begin this week • Community Garden —there are issues that will be discussed with Director Earle and any possible changes needing to be made would be brought to the Commission Mayor Duke asked for a full accounting of the total cost of the PATCH to date and what it will cost to correct problems, and where the money will come from. City Manager Baldwin continued: • Phippen Waiters Road — Public Services is making changes to the landscaping; because of the set-up, some landscaping is on private swales, which will have to be addressed through a policy decision • The Sabal Palms trunk cutting in College Park has been completed • Taylor Lane improvements — trying to keep Kent George in the loop so he will know what his people are doing • Parking Garage trial — is complete; analysis and recommendations will be brought to the Commission • Hurricane PrepareAthon —thanked everyone who participated, the Commission for their support, and the speakers • Marina— commended Assistant City Manager Donnelly and staff for a great job, and the Commission for standing behind the project to get it done 13.2 City Attorney City Attorney Ansbro asked the Commission for a motion to authorize the sale of surplus property located at 29 NW 501 Avenue, for the entire appraised value. Commissioner Grace motioned to authorize the sale of surplus property located at 29 NW 5"'Avenue; seconded by Mayor Duke. The motion carried unanimously. City Manager Baldwin noted that BSO will be hosting the second Uniting Broward/Protecting Communities gathering on Saturday, June 28th, at Jaco Pastorius Park in Oakland Park. While there is a stop sign Controlling traffic flow north and south at the intersection of 4th Ave and 5th Street, there is no stop sign on the far busier east-west 5th St. On numerous occasions I have observed cars speeding through the intersection with no regard for speed limits or safety. This is of particular concern because this area has children who reside in the homes near this intersection who can be seen skateboarding, playing p Y g basketball, bike riding, dog walking. Previously at 313 SE 4th Terrace, and for the past 13 years at 352 SE 5th Street. Cars and commercial vehicles are using SE 5th Street as a connector from US1 to SE 5th Avenue. They race down our street at all hours of the day and night, and are not cautious of vehicles exiting driveways. The traffic continues i s to increase on this street and it has e become quite dangerous. There is no need for vehicles to use this street to cut through. It is a residential neighborhood and they should be using Dania Beach Blvd or Sheridan Street. I believe that placing a stop sign on each side of SE 5th Street at SE 4th Avenue will slow down the traffic and make it less dangerous, and also reduce the amount of vehicles using this street as a cut through short cut.
