Submitted by Lawrence Kramer on behalf of Village at Dania Beach, LLC, for property at 180 Dania Beach Boulevard RESOLUTION NO. 2014-056 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING A MODIFICATION TO A PREVIOUSLY APPROVED SITE PLAN (SP-69-13 MOD.) SUBMITTED BY LAWRENCE KRAMER ON BEHALF OF VILLAGE AT DANIA BEACH, LLC, FOR PROPERTY LOCATED AT 180 DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA,AS LEGALLY DESCRIBED IN EXHIBIT"A"; ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 28, "Land Development Code", Part 6, "Development Review Procedures and Requirements",Article 635,"Site Plan"of the City Code Of Ordinances(the "Code"),Lawrence Kramer,on behalf of Village at Dania Beach,LLC(the"Applicant")has applied to the City of Dania Beach(the"City"),for approval of a Site Plan Modification for property legally described in Exhibit"A"(Application SP-69-13 Mod.); and WHEREAS, pursuant to Resolution Number 2014-021, the City Commission previously approved the Site Plan(SP-69-13)with conditions for the Property, which remain applicable; and WHEREAS, the Applicant is requesting to modify the previously approved Site Plan to permit the construction of a six (6) foot wall along a portion of the west property line of the Property; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with law; and WHEREAS, the City Commission find that the proposed Site Plan Modification is consistent with the Land Development Code and the City's Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. Recitals. The foregoing"WHEREAS"clauses are ratified and incorporated as the legislative intent of this Resolution. Section 2. Approval of Site Plan Modification. Pursuant to Chapter 28, "Land Development Code", Part 6, "Development Review Procedures and Requirements", Article 635, "Site Plan"of the City Code,the Site Plan Modification(SP-69-13),attached as Exhibit`B",which is made a part of and incorporated into this Resolution by this reference, is approved. Section 3. Conflicts. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. Effective Date.
