Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Chickie Brandimarte Commissioners: Bobbie H. Grace Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Pastor Mario Cinelli, Lighthouse Community Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. Commissioner Jones motioned to excuse the absence of Vice-Mayor Brandimarte from the June 24,2014 City Commission meeting; seconded by Vice-Mayor Brandimarte. Mayor Duke asked Vice-Mayor Brandimarte for a reason why she was out for the month of June. He asked the City Manager if he had previous knowledge of why the Vice-Mayor was out. City Manager Baldwin noted he spoke with Vice-Mayor Brandimarte while he was on vacation, and she asked that he not tell anyone she was in the hospital. Mayor Duke said it was staffs responsibility to let the Commission know. Mayor Duke made an amendment to the motion to include that the City Attorney bring a resolution to the next meeting providing that if a Commissioner is absent,the Commissioner give notice to the City Clerk so the City Clerk can put it on the next agenda. City Attorney Ansbro noted that Vice-Mayor Brandimarte could not vote on the motion to excuse her absence. Commissioner Jones refused the amendment made by Mayor Duke. The motion failed on the following 1-2 Roll Call vote: Commissioner Grace No Mayor Duke No Commissioner Jones Yes Vice-Mayor Brandimarte thanked everyone for their support during her illness. Commissioner Grace felt this was a travesty to the residents of Dania Beach. She said she is happy that Vice-Mayor Brandimarte is on the mend, but does not feel she has an obligation to give an excused absence. Commissioner Jones noted it has never been an issue with excused or unexcused absences;this is mean spirited and inconsiderate. He said we should move forward tonight, and the people will speak on Election Day. Mayor Duke said we have major issues in the City; however, the dominant news story this month has been about the unexcused absence of a Commissioner, which was fueled by the usual political special interests. He remarked we do not have time for this silliness as there are big problems to solve; we must stop this and not work on small-minded issues. 3. Presentations and Special Event Approvals 3.1 Diver's Cove—4th Annual Dania Beach Pier Cleanup—Mayor Duke 3.2 Special event request from the Broward County Natural Resources Planning and Management Division for their annual "Ocean Conservancy International Coastal Cleanup",to be held on Saturday, September 20, 2014 from 9:00 a.m. - 12:00 p.m. Commissioner Grace motioned to approve the Special Event request for the Ocean Conservancy International Coastal Cleanup; seconded by Commissioner Jones. The motion carried unanimously. 3.3 Special event request from Broward Sheriffs Rescue for a 'Relay for Life Charity Car Wash", to be held on August 2, 2014 at the Dania Beach Marina from 10:00 a.m. -3:00 p.m. The applicant is requesting a special event fee waiver for$150.00. Commissioner Grace motioned to approve the Special Event request for the Relay for Life Charity Car Wash, including the special event fee waiver for $150.00; seconded by Commissioner Jones. The motion carried unanimously. 3.4 Special event request from the Humane Society of Broward County for an "Employee Appreciation Day", to be held at the P.J. Meli Recreational Complex on August 10, 2014, from 4:00 p.m. - 6:00 p.m. The applicant is requesting a special event permit waiver for$100.00. Commissioner Jones motioned to approve the Special Event request for the Humane Society of Broward County's Employee Appreciation Day, including special event permit waiver for$100.00; seconded by Commissioner Grace. The motion carried unanimously. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,July 22,2014—7:00 p.m. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Lorraine Rafanello, 121 SE 3rd Avenue#203, spoke of the absence of Vice-Mayor Brandimarte. Mayor Duke said he had no knowledge of the illness of Vice-Mayor Brandimarte. George Jason, 4549 SW 37d' Avenue, expressed his feelings regarding the illness of Vice-Mayor Brandimarte. Jackie Centofande, 321 SE 3rd Street #606, noted the elevator at her condo has been out of service for a month, and asked the City to provide assistance to get it fixed. Richard Walker, 2310 Forrest Street, Hollywood, commended the Commission for their support of the Tamara James Foundation Fun Day, and encouraged them to continue to support the Foundation. Carolyn Jones, 722 SW 3rd Street, asked the Commission to show compassion for their fellow man. Roni Larkins, 211 NW 12d' Avenue, spoke in support of the Tamara James Foundation. She noted there are a lot of children in the NW community who go hungry. Commissioner Jones responded that Tamara James did receive $1,000.00 from the City, and then the Commission also gave her another $2,500.00. He noted the only thing he asked was for her to hold one event in this City, and she responded that she cannot because the basketball courts are near the streets. Betty Sokol, 609 NW loth Street, asked if the Commission violated their donation policy by giving funds to Tamara James Foundation at the last meeting. City Attorney Ansbro noted it is the Commission's policy and they can do with it what they choose to do. Tamara James, 255 NW Tamara James Avenue, explained her vision goes further than the City of Dania Beach. She thanked the City for their support to the Tamara James Foundation. Fay Bartelmes, 214 SW 2nd Terrace,welcomed Vice-Mayor Brandimarte back. Anthony Amos 101 SE 3rd Avenue, noted that what is happening on the Commission is embarrassing. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,July 22,2014—7:00 p.m. Teddy Bohanan, SW 151 Street, said there are thugs in the community. Bob Adams, 330 SE P Terrace, noted the Commission had the opportunity to right the situation tonight,but they did not. Jeffrey Bryant, 136 NW 5th Avenue, spoke on behalf of the Tamara James Foundation. Daphne Henry-Higgs, 1201 NW 2 P nd Street, spoke in favor of the Tamara James Foundation. P Kurt Larsen 5810 SW 36th Terrace addressed a floodingissue in his neighborhood caused b a g Y development in Hollywood. He noted the City of Dania Beach is currently working with the residents to see if there is something that can be done to address the flooding. Terry Chemtov, 5800 SW 36th Terrace, spoke of the flooding issue addressed by Mr. Larsen. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, reported that burglary conveyances are still a problem, and reminded the residents to remove items from their vehicles. He noted National Night Out will be on August 5th at PJ Meli Park, and described Safe Haven, which is a new initiative to provide a safe location for on-line buyers and sellers to meet at BSO district offices to transact business. Commissioner Grace addressed the "Dania Reads" program. She reported on the increase in grades of the Dania Schools, and noted they are going to be working on fundraisers for this program. Commissioner Jones said he would like BSO to utilize the cameras in some of the areas where the burglary conveyances occur. Captain Granville responded he will look into it. Battalion Chief Sean Brown, BSO Fire Rescue, reported Lieutenant Robert Sterner was chosen as the July 2014 employee of the month. He also reported that he found a program for baby sleep safety called the Safe Sleep Campaign, and Fire Rescue will distribute the information to the public. 7. None Resolutions Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,July 22,2014—7:00 p.m. 7.3 RESOLUTION#2014-055 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE APPROPRIATION AND USE OF AVAILABLE CITY FEDERAL LAW ENFORCEMENT TRUST FUNDS IN AN AMOUNT NOT TO EXCEED $7,500.00, FOR THE PURCHASE OF SMARTWATER HOME-CODING INSTANT TRACER KITS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. 7.4 RESOLUTION#2014-057 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH STAFFING CONNECTION, INC. Commissioner Jones motioned to adopt the Consent Agenda; seconded by Commissioner Grace. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,July 22,2014—7:00 p.m. City Attorney Ansbro advised the remaining items were quasi-judicial hearings and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. The Commission disclosed that they had been contacted on Item#9.1 and Item#9.2. 9.1 ORDINANCE#2014-009 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE REQUEST MADE BY DENNIS D. MELE, ESQ., AGENT FOR THE PROPERTY OWNER FLORIDA SILICA SAND COMPANY, TO REZONE PROPERTY LOCATED AT 181 SOUTH BRYAN ROAD IN THE CITY OF DANIA BEACH, FLORIDA, AND LEGALLY DESCRIBED IN EXHIBIT"A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; CHANGING THE CURRENT ZONING CLASSIFICATION OF THE PROPERTY FROM INDUSTRIAL, RESEARCH, OFFICE ("IRO") TO GENERAL COMMERCIAL DISTRICT (C-3), SUBJECT TO CERTAIN RESTRICTIONS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) City Attorney Ansbro read the title of Ordinance #2014-009 and Ordinance #2014-010, because they are related. Corinne Lajoie, Principal City Planner, provided an overview of the two rezoning requests for a potential redevelopment project. Dennis Mele, 200 E Broward Boulevard, Ft. Lauderdale, presented renderings of the proposed development. He noted the remaining parcels are zoned commercial. Mayor Duke opened the Public Hearings. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearings. Commissioner Jones motioned to adopt Ordinance #2014-009, on first reading; seconded by Commissioner Grace. The motion carried unanimously. 9.2 ORDINANCE#2014-010 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE REQUEST MADE BY DENNIS D. MELE, ESQ., AGENT FOR THE PROPERTY OWNER FLORIDA CF&A HILL FAMILY LTD., TO REZONE PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF STIRLING ROAD BETWEEN INTERSTATE 95 AND BRYAN ROAD IN THE CITY OF DANIA BEACH, FLORIDA, AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; CHANGING THE CURRENT ZONING CLASSIFICATION OF THE PROPERTY FROM INDUSTRIAL, RESEARCH, OFFICE, MARINE ("IROM") AND COMMERCIAL BUSINESS DISTRICT (C-2) TO GENERAL COMMERCIAL DISTRICT (C-3), SUBJECT TO CERTAIN RESTRICTIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. The motion carried unanimously. 9.3 RESOLUTION#2014-050 Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,July 22,2014—7:00 p.m. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-011-14) SUBMITTED BY EVAL LEVY ON BEHALF OF THE PROPERTY OWNER OFER BEN SHOSHAN FOR PROPERTY LOCATED AT 4430 SW 32ND AVENUE IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Continued from June 24,2014) City Attorney Ansbro read the title of Resolution #2014-050 and noted that the applicant requested a continuance until the August 26, 2014 City Commission meeting in order to address the concerns expressed by the Commission and residents at the June 24, 2014 meeting. Mayor ayo Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition,he closed the Public Hearing. Commissioner Jones motioned to continue Resolution #2014-050 until the August 26, 2014 City Commission meeting at 7:00 p.m.; seconded by Commissioner Grace. The motion carried unanimously. 9.4 RESOLUTION#2014-056 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA, APPROVING A MODIFICATION TO A PREVIOUSLY APPROVED SITE PLAN (SP-69-13 MOD.) SUBMITTED BY LAWRENCE KRAMER ON BEHALF OF VILLAGE AT DANIA BEACH, LLC, FOR PROPERTY LOCATED AT 180 DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A"; ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Discussion and Possible Action ADDENDUM 10.1 Dania Beach 110 Year Celebration in December—Commissioner Grace 10.2 Donation for"Dania Beach Reads"—Commissioner Grace 10.3 Additional funding for the Dania Beach Bears—Commissioner Grace Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,July 22,2014—7:00 p.m. Commissioner Grace advised she was removing the three items from the agenda; however, she wanted to address each matter. She said the City Manager explained to her that these matters should not come before the Commission until after the budget hearings in September. She felt some funds should be programmed in the upcoming budget for the 110 Year Celebration and asked staff to work on projects for this event. City Manager Baldwin noted a group is looking at it, and recommendations will be brought to the Commission. He said staff is looking at holding the event in January after the holidays. Commissioner Jones asked the City Manager to look at what time of year the City had their prior celebrations. Commissioner Jones spoke on the donation policy, and suggested a workshop be held to talk about policies and protocol. Commissioner Jones said he supports funding the Dania Bears and he would like to discuss giving them additional funding. He noted an educational component will be brought into the Dania Bears, and he would support giving additional funds. Commissioner Grace withdrew her withdrawal and motioned to give $10,000.00 to the Dania Bears and $3,000.00 to Dania Beach Reads, from contingency for this fiscal year; seconded by Commissioner Jones. The motion carried unanimously. 11. Commission Comments 11.1 Commissioner Grace Commissioner Grace's comments included: • Thanked Tamara James and Robert Chunn Foundations, Dania Economic Development Corporation, J.R., and Minister Carter for helping paint an elderly woman's house • Thanked Tamara James Foundation for feeding the homeless last Saturday • Recent and upcoming church, community, and social events • Thanked the five candidates running in the November election • She is living her life for the Almighty; she will not be bullied, and wants to be surrounded by positive people,not negative people 11.2 Commissioner Jones Commissioner Jones read a letter he received regarding the absence of Vice-Mayor Brandimarte. He noted the Mayor and Commissioner Grace had an opportunity to right the situation tonight, but chose not to. Commissioner Jones reported that a portion of Ocean Drive to John U. Lloyd Park will be called Dr. Vaughn Mizell Drive. Minutes of Regular Meeting g Dania Beach City Commission Tuesday,July 22,2014—7:00 p.m. 11.3 Vice-Mayor Brandimarte Vice-Mayor Brandimarte expressed her concern with rainwater collecting in a hole associated with the southeast drainage project construction. Vice-Mayor Brandimarte commented Meadowbrook, Phase 5, has only one elevator and it has been out of order for one month. She noted this is a serious health concern for the residents because the stairwell is not in compliance with today's codes. She asked if the City could do something to make the condominium association fix the elevator. City Attorney Ansbro noted that the repair can be done in a week, and if the funds are available, the board lawyer should be called and the repair made. The Commission consensus was to do whatever the City can legally do. 11.4 Mayor Duke Mayor Duke had no comments. 12. Appointments Commissioner Jones motioned to re-appoint Commissioner Flury's board appointments; seconded by Vice-Mayor Brandimarte. The motion failed on the following 2-2 vote: Commissioner Grace No Vice-Mayor Brandimarte Yes Commissioner Jones Yes Mayor Duke No 13. Administrative Reports 13.1 City Manager City Manager Baldwin noted he was on vacation when Vice-Mayor Brandimarte became ill; she asked him not to discuss it with anyone, which he did. He said the Mayor and Commissioner Jones misunderstood and he did not discuss this with anyone until he got back from vacation. He noted he has been steadfast not to discuss the Vice-Mayor's medical condition. Vice-Mayor Brandimarte clarified she did not want anyone to know why she was in the hospital because it took three days to get a diagnosis. City Manager Baldwin noted he had provided written reports to the Commission, which included reports on parking and Oasis and Dania Beach Heights. 13.2 City Attorney Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,July 22,2014—7:00 p.m. City Attorney Ansbro expressed his condolences to Helen Hargedon's family. 13.3 City Clerk- Reminders Tuesday, August 26, 2014—7:00 p.m. City Commission Meeting 14.
