HomeMy WebLinkAboutR-2014-065 - Increased a Purchase Order by $15,000.00 for Manpower Employment Services, Inc. to provide Beach Custodian Staffing Services not to exceed $65,000.00 for FY 2013/14 RESOLUTION NO. 2014-065 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING CITY ADMINISTRATION TO INCREASE AN AMOUNT OF A PURCHASE ORDER BY $15,000.00, FOR MANPOWER EMPLOYMENT SERVICES, INC. D/B/A MANPOWER, A FLORIDA CORPORATION, TO PROVIDE BEACH CUSTODIAN STAFFING SERVICES; WAIVING COMPETITIVE BIDDING AND PROCEEDING WITHOUT ADVERTISEMENT FOR BIDS, IN AN AMOUNT NOT TO EXCEED $65,000.00 FOR FISCAL YEAR 2013-2014; AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN EXTENSION OF THE AGREEMENT DATED FEBRUARY 12, 2014, PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids if he is authorized to do so in advance by a resolution adopted by the City Commission;and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", Subsection(a), sets the monetary threshold or limitation at$25,000.00; and WHEREAS, the Director of Parks and Recreation has determined that it is necessary to provide continued temporary staffing services for Beach Custodians for an additional two (2)year Extension period to the Agreement dated February 12, 2014, a copy of the Extension Agreement is attached as Exhibit "A", which is made a part of and incorporated into this Resolution by this reference; and WHEREAS, a purchase order was issued for $50,000.00 as authorized by the City Commission via Resolution 2014-033 of which$48,100.00 has already been expended; and WHEREAS, written quotes were obtained and an Agreement dated February 12, 2014 was approved by the City Manager and has since expired; and WHEREAS, City Administration recommends that the City Commission authorize a $15,000.00 purchase order increase for the continued temporary staffing services provided from Manpower Employment Services d/b/a Manpower, and for the City Commission to further authorize the City Administration to pay an amount not to exceed $65,000.00 for Fiscal Year 2013-2014, and for the proper City officials to execute an Extension to the Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the above "Whereas" clauses are ratified, made a part of and incorporated into this Resolution by this reference. Section 2. That the City Administration is authorized to increase the amount of the purchase order for Manpower Employment Services, Inc. d/b/a Manpower, to provide beach custodian staffing services, and to also pay an amount not to exceed Sixty Five Thousand Dollars ($65,000.00) for fiscal year 2013-2014. Section 3. That the proper City officials are authorized to execute an Extension of the Agreement, and that the Extension to it is to be retroactive to February 12,2014. Section 4. That the City Manager and City Attorney are authorized to make minor revisions to the Extension Agreement as are deemed necessary and proper and in the best interests of the City. Section 5. That the funding is available from planned appropriations in the Pier Enterprise Fund, Contract Services Account, Account No.405-72-15-572-34-10. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7. AN B CITY ATTO Y 2 RESOLUTION#2014-065 EXTENSION OF AGREEMENT BETWEEN THE CITY OF DANIA BEACH, FLORIDA,AND MANPOWER STAFFING SERVICES,INC. D/B/A MANPOWER This is an Extension of an Agreement (the "Extension"), which Agreement dated February 12, 2014, (the "Agreement") existed between the City of Dania Beach, Florida, a Florida municipal corporation (the "City") and Manpower Staffing Services, Inc. d/b/a Manpower, a Florida corporation(the "Contractor") for beach custodian staffing services. The initial Agreement was dated February 12, 2014 and had a term of ninety(90) days, as it was to be a temporary Agreement. A copy is attached as Exhibit "A", which is made a part of and incorporated into this Extension by this reference. The Parties wish to extend the Agreement. In consideration of the mutual covenants, terms and conditions contained in the Agreement and in this Extension of it, and for other good and valuable consideration, the adequacy and receipt of which are acknowledged and agreed upon, the Parties agree to the following: 1. That this Extension to the initial Agreement that was executed on February 12, 2014, shall be retroactive to February 12, 2014, and shall remain in force and effect up to and including September 30,2014. 2. That the terms and conditions of the initial Agreement dated February 12, 2014 shall remain the same throughout the term of this Extension of it. 3. That in all other respects, the Agreement is ratified and reaffirmed and remains in full force and effect. IN WITNESS OF THE FOREGOING, the parties have executed this Extension of Agreement on 92014.
