Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Chickie Brandimarte Commissioners: Bobbie H. Grace Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Reverend A.J. Davis, Greater Mt. Zion AME Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. Commissioner Grace spoke of the 1051' anniversary celebration planned for the church and requested the City work with them on the historical marker. 3. Presentations and Special Event Approvals 3.1 Diver's Cove—4t'Annual Dania Beach Pier Cleanup—Mayor Duke Mayor Duke presented a YouTube video of the 4t' Annual Dania Beach Pier Cleanup. 4. Proclamations There were no proclamations at this meeting. 9.4 RESOLUTION#2014-072 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE THE SECOND AMENDED AND RESTATED DEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY OF DANIA BEACH, FLORIDA AND DANIA ENTERTAINMENT CENTER, LLC; AUTHORIZING THE CITY MANAGER TO EXECUTE THE SECOND AMENDED AND RESTATED DEVELOPMENT AGREEMENT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro noted this is not a quasi-judicial hearing, but a hearing in accordance with Ch. 163 of the Florida Statutes. Attorney Susan Delegal, Billing Cochran Lyles Mauro & Ramsey P.A., 515 E. Las Olas Boulevard, Ft. Lauderdale, representing Dania Entertainment Center, LLC, introduced members of their team. She noted this is the second amended development agreement and gave a brief background leading up to tonight's public hearing. Louis Birdman, DEC, presented an overview of the project, which plans were included in the agenda packet. He addressed the financial aspects of the project, noting the Argentinians own 80% interest in the project and he and his local partners own 20%. He added the overall investment in all phases of the project would be approximately $275 million and a couple thousand jobs would be created over a period of years. Commissioner Grace questioned the closing of the facility and the loss of jobs. Mr. Birdman explained the approval process has taken longer than anticipated, and keeping the facility open during construction would put people at risk and add time to the project's completion. He addressed employment numbers during construction and after project completion, and noted by not keeping it open, construction will speed up and the hiring process can be undertaken sooner. Commissioner Jones questioned re-employment of those who will lose their jobs and how the decision to let them go was made. Mr. Birdman noted the decision was made recently and notification requirements had to be met. He said these people will have the same opportunity to be hired as anyone else and may have an advantage if they have experience and training. He added they are obligated by their agreement to have job fairs, as they have had previously, and intend on doing so. Vice-Mayor Brandimarte requested that the people who lose their jobs should be re-hired. Eric Lipp, Lambert Advisory, reviewed the financial and economic impacts to Broward County and the City. Commissioner Jones said he would like to see what the losses will be to the City during the 18- month shut down period. Mr. Birdman noted the completion date is targeted for November/December 2015. John Lockwood, 106 E. College Avenue, Tallahassee, casino gaming lawyer, addressed the tax issue reported by the newspapers. He explained how the tax payments were calculated and paid, and how the problem was addressed and resolved. Mayor Duke opened the Public Hearing. Y P g Herbert Simpson, 415 SE 11'' Terrace, 4301, noted he is one of the plaintiffs in the lawsuit. He said he is concerned with traffic and is against gambling. Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public Hearing. City Attorney Ansbro read the title of Resolution 42014-072. Commissioner Grace motioned to approve the request; seconded by Vice-Mayor Brandimarte. Eric Coburn, 336 NE 2nd Court, commented he lives near the facility, and questioned what impact it would have on the waterfront and traffic in and out. Mayor Duke noted the plans are available in Community Development and on the website. Commissioner Grace said we have been waiting for a long time for a quality product that will benefit everyone. If we make a proposal to make this the best facility in Florida, it will be a win- win situation. She noted the traffic issues have been addressed. Commissioner Jones questioned if we could add a condition that they hire the employees who were terminated. Commissioner Jones amended the motion to include that employees are hired back and proof be provided of who was hired originally and laid off, so they would have first preference; seconded by Commissioner Grace. Mayor Duke provided an overview of the Boyd development and the lawsuit, and how we got to where we are today. He felt the lawsuit is disingenuous and noted one of the plaintiffs on the lawsuit is Brenda Chalifour. He added feedback about the project from residents has been positive, and he provided a copy of the flier that was distributed throughout the community by Citizens for Responsible Development. Citizen Comments Linda Wilson, 1547 Adams Street, Hollywood, and Kristin Dridge, 227 SE 80' Street, Friends of the Dania Beach Library, introduced themselves and their purpose, and asked the Commission to continue its support. Mayra Quintero, 1432 NW 9d' Street, Nautilus Isle, addressed issues regarding her home since she participated in the airport noise mitigation program. Mayor Duke suggested the building official and Director LaFerrier look into the issue and report at the next meeting. Tamara James, 255 NW Tamara James Avenue, thanked everyone who supported Tamara James Day. Anthony Amos, 101 SE 3rd Avenue, addressed Commissioner Grace calling him stupid at the last meeting, and said she owed him an apology. Randy Wright, 4391 SW 34d' Lane, spoke of the lack of construction on the sound mitigation program. He asked the Mayor to provide an update on the project, and noted the County is scheduled to provide an update at the Airport Advisory Board meeting in October. James Silvernale, President Dania Lions Club, thanked the Commission for their donation to Dania Beach Reads. Henriette Arnold, 101 SE 3rd Avenue, #504, Dania Beach, commented on the arts display that is in the atrium at City Hall. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, noted a possible water scam in the City, and encouraged residents to contact BSO if someone contacts them. He spoke of burglary conveyances and the Smart Water Program, which will roll out on September 6, 2014. Commissioner Jones requested the cameras be utilized and publicized in the areas of high crime. Sean Brown, Battalion Chief, BSO Fire Rescue, reported on the ALS competition team and his volunteering to work with CERT. The motion carried unanimously. 7.7 RESOLUTION#2014-064 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A RENEWAL OF AN AGREEMENT EXISTING BETWEEN THE CITY OF DANIA BEACH, FLORIDA, AND LAWN WIZARD USA, INC.; AUTHORIZING THE CITY ADMINISTRATION TO INCREASE THE ANNUAL MAXIMUM CONTRACTUAL SERVICES AMOUNT FROM$242,240.00 TO$270,240.00, RESULTING IN AN INCREASE OF $28,000.00, FOR LANDSCAPING SERVICES TO BE PERFORMED THROUGHOUT THE CITY; AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A SECOND AMENDMENT TO THE AGREEMENT RELATING TO THE INCREASE OF AN AMOUNT NOT TO EXCEED $28,000.00 FOR THE INCREASE IN THE SCOPE OF SERVICES TO LAWN WIZARD USA, INC.;PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2014-064. Commissioner Grace commented she is concerned with the $28,000.00 increase and Dania Beach Boulevard, Phippen Waiters and NW 1 sc Street are not kept up. Director Orlando noted the increase includes additional work on US-1 from Griffm Road to Sheridan, Route 84, hedge trimming at the beach, and trash cleanup from storm events. He added the contract is based on a scope of work and a certain frequency to do that work; the renewal is at the same rate as it was two years ago, except for the additional work. Vice-Mayor Brandimarte also expressed her dissatisfaction with the service. Commissioner Jones said he is concerned that we are extending the contract for two years. He felt they need to negotiate with us or we should go out to bid. Director Orlando clarified the additional work was requested by the City, and reiterated the base price is the same price from two years ago. Commissioner Jones motioned to adopt Resolution #2014-064, with a one-year renewal; seconded by Commissioner Grace. The motion carried on the following 4-0 Roll Call vote: Commissioner Grace Yes Vice-Mayor Brandimarte Yes Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,August 26,2014—7:00 p.m. Commissioner Jones Yes Mayor Duke Yes 7.9 RESOLUTION#2014-066 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH FLORIDA RATIFYING AND APPROVING THE CITY MANAGER'S EMERGENCY APPROVAL TO PURCHASE SERVICES FROM SIMON ROOFING, INC., RELATING TO ROOFING REPAIRS NEEDED AT THE DANIA BEACH GRILL RESTAURANT, WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS, IN AN AMOUNT NOT TO EXCEED FORTY-FIVE THOUSAND DOLLARS ($45,000.00); PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2014-066. Mayor Duke wondered if the roof should be replaced if we are going to move the building in Phase II of the Waterfront Revitalization Plan. He questioned whether we should get a second opinion from a local company. Vice-Mayor Brandimarte questioned if there could be a minor repair made so the tenant can acquire insurance coverage. City Attorney Ansbro noted the operators do not qualify for windstorm insurance because of the condition of the roof. He emphasized that the roof must be replaced. Director Orlando said we do not need three quotes because this company was on a competitive bid, and explained the work is based on unit cost for work done. Commissioner Jones commented he would prefer local competitive bids. Director Orlando noted the advantage of this contract is that it can be used when there is an emergency like this and we do not have to go through the lengthy bid process. Mayor Duke asked if we could self insure. City Attorney Ansbro responded he did not know; however, we are obligated to fix the roof. Director Orlando noted he would get quotes from local companies. Commissioner Jones motioned to continue Resolution #2014-066 until the September 9, 2014 City Commission meeting; seconded by Commissioner Grace. The motion carried unanimously. 7.10 RESOLUTION#2014-067 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN INTERLOCAL AGREEMENT WITH BROWARD COUNTY FOR "GUARANTEED PARTIAL SERVICE BUILDING CODE SERVICES" TO BE PERFORMED BY THE BROWARD COUNTY PERMITTING, LICENSING AND CONSUMER PROTECTION DIVISION OF THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT; Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,August 26,2014—7:00 p.m. WAIVING COMPETITIVE BIDDING AND PROCEEDING WITHOUT ADVERTISEMENT FOR BIDS; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Commissioner Grace suggested a two-year contract, as opposed to a five-year contract, since she cannot see us going out to 2019 with it when there could be an entire new Commission. Commissioner Grace motioned for a two-year agreement. The motion died for lack of a second. Director LaFerrier noted the agreement is for five years, which is the standard agreement with most jurisdictions; however, we can cancel with a 90-day notice. Commissioner Jones remarked Broward Countycould do a better job of helping the process J P g along when they know our ordinances may not comply with the County. Commissioner Grace motioned to adopt Resolution #2014-067, for a two-year term; seconded by Vice-Mayor Brandimarte. The motion carried unanimously. 8. Bids and Requests for Proposals 8.1 RESOLUTION#2014-068 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING AN AWARD OF BID AND AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT AS A RESULT OF THE AWARD WITH DP DEVELOPMENT OF THE TREASURE COAST, LLC, A FLORIDA LIMITED LIABILITY COMPANY, RELATING TO THE OASIS VI NEIGHBORHOOD IMPROVEMENT PROJECT, IN AN AMOUNT NOT TO EXCEED $140,395.00; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2014-068. Commissioner Grace motioned to adopt Resolution #2014-068; seconded by Commissioner Jones. The motion carried unanimously. 8.2 RESOLUTION#2014-069 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING AN AWARD OF BID AND AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT AS A RESULT OF THE AWARD WITH DP DEVELOPMENT OF THE TREASURE COAST, LLC, A FLORIDA LIMITED LIABILITY COMPANY, RELATING TO THE OASIS VII NEIGHBORHOOD IMPROVEMENT PROJECT,IN AN AMOUNT NOT TO EXCEED$75,340.00;PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2014-069. James Ridgely, 880 SE 2nd Avenue, questioned the project's fiscal year and the warranty issue with trees. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,August 26,2014—7:00 p.m. City Manager Baldwin responded this is within the current budgetary year. He noted Oasis projects are minimalist projects, and there is no issue with maintenance. Commissioner Grace motioned to adopt Resolution #2014-069; seconded by Commissioner Jones. The motion carried unanimously. 8.3 RESOLUTION#2014-070 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING A BID AWARD TO BE GRANTED TO EDSA, INC., RELATING TO THE DANIA BEACH OCEAN PARK REVITALIZATION PLAN-PHASE I PROJECT; AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH EDSA, INC., FOR A TOTAL AMOUNT NOT TO EXCEED$293,000.00;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2014-070. Director LaFerrier gave a brief overview of the contract. Commissioner Jones questioned the contingency in this phase of the project. Director LaFerrier explained the only contingency would be the time and materials part of the contract, which will be billed on an hourly basis. Any monies left over could be rolled into a subsequent phase if the Commission so desires. Commissioner Jones motioned to adopt Resolution #2014-070; seconded by Commissioner Grace. The motion carried unanimously. 9. Public Hearings and Site Plans 9.1 ORDINANCE#2014-011 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, TO AMEND CHAPTER 28,PART 3, OF THE "LAND DEVELOPMENT CODE" OF THE CITY'S CODE OF ORDINANCES BY AMENDING ARTICLE 303, "DISTRICT DEVELOPMENT STANDARDS", CONCERNING DENSITY IN THE CITY CENTER(CC) DISTRICT AND BEACH GATEWAY MIXED-USE (GTWY-MU)DISTRICT AND AMENDING ARTICLE 305,"INCENTIVES",ESTABLISHING DEVELOPMENT INCENTIVES RELATED TO PUBLIC PARKS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE.(FIRST READING) City Attorney Ansbro read the title of Ordinance#2014-011. Corinne Lajoie, Principal City Planner, noted the applicant requested a continuance until the September 9, 2014 City Commission meeting. Mayor Duke opened the Public Hearing. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,August 26,2014—7:00 p.m. Commissioner Grace motioned to continue Ordinance #2014-011, on first reading until the September 9, 2014 City Commission meeting at 7:00 p.m.; seconded by Commissioner Jones. The motion carried unanimously. 9.2 RESOLUTION#2014-050 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING THE SITE PLAN (SP-0I1-14) SUBMITTED BY EVAL LEVY ON BEHALF OF THE PROPERTY OWNER OFER BEN SHOSHAN FOR PROPERTY LOCATED AT 4430 SW 32ND AVENUE IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Continued from June 24,2014 and July 22,2014) City Attorney Ansbro read the title of Resolution #2014-050 and noted it was a quasi-judicial hearing and swore-in those who would speak. He asked the Commission to disclose any communication they had on this matter. Corinne Lajoie, Principal City Planner, noted the applicant requested a continuance possibly until the September 23, 2014 City Commission meeting. Mayor Duke opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Commissioner Grace motioned to continue Resolution #2014-050; seconded by Commissioner Jones. The motion carried unanimously. 9.3 RESOLUTION#2014-071 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,ADOPTING A RECREATION AND OPEN SPACE IMPACT FEE SCHEDULE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2014-071. Corinne Lajoie, Principal City Planner, provided an overview, and noted the fees are 10% lower than recommended by the study. He said Public Services evaluated the area, and as indicated in the agenda backup,found two possible locations for traffic calming and have identified a funding source. He added he was reappointed to the Economic Development and Growth Management Committee for the FLC, and reviewed bills from the last legislative session. Commissioner Jones noted he was appointed by Broward League of Cities President Patty Asseff to the Broward County Planning Council Steering Committee for the upcoming Comprehensive and Land Use Plan Review Process.
