HomeMy WebLinkAboutR-2014-097 - Approved Request by Skyland Plaza, LLC for for Site Plan Approval with Associated Design Variations for Property at 118 North Federal Highway RESOLUTION NO. 2014-097 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST MADE BY GILLES GRENIER ON BEHALF OF SKYLAND PLAZA, LLC, FOR SITE PLAN APPROVAL WITH ASSOCIATED DESIGN VARIATIONS FOR PROPERTY LOCATED AT 118 NORTH FEDERAL HIGHWAY IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Part 6,"Development Review Procedures and Requirements,"Article 635 of the City of Dania Beach,Florida Land Development Code("Code")states that the City Commission may grant a site plan extension if the applicant can demonstrate good cause for the delay; and WHEREAS,on March 27,2012,the City Commission approved a variance request(VA-08- 12) to allow no landscape island in a row of parking, where required by Chapter 28, Section 275- 100(C)(1)by Resolution Number 2012-034, which expired on March 26, 2013; and WHEREAS,on March 27,2012,the City Commission approved a request for a site plan and associated design variation (SP-40-11) to allow for the construction of two (2) buildings totaling approximately 11,000 square feet of commercial space and eight (8) residential units for property located at 118 N. Federal Highway,by Resolution Number 2012-035,which expired on March 26, 2013; and WHEREAS, on May 14, 2013 the City Commission approved a request to extend the previously approved variance and site plan by Resolution Number 2013-053 to September 26,2013; and WHEREAS, Gilles Grenier, on behalf of Skyland Plaza, LLC, is requesting site plan and design variation reducing the development to approximately 8,500 square feet of commercial and two (2) residential units; and WHEREAS, Gilles Grenier, on behalf of Skyland Plaza, LLC, is requesting a variance approved for the following: 1. To allow no gallery roof, awning or arcade as part of the modified shop frontage as required by Chapter 28, Section 303-40(N) and 311-20(4); 2. To allow no landscape island in a row of parking where required by Chapter 28, Section 275-100(C)(1); and 3. To allow mechanical equipment along the street frontage,where none is allowed,per Section 301-50(D); NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the request to modify the previously approved site plan and associated design variation, is approved with the following conditions: 1. PLATTING: Provide letter from Broward County identifying whether this property needs to be platted or replatted. 3Td time requested. (Planning) 2. Per BCAD letter of 7-3-14 the following is required, 2nd time requested. • Must obtain FAA approval letter, Per BCAD letter of 7-3-14 • Must obtain FDOT approval letter, Per BCAD letter of 7-3-14 3. SCHOOLS: Obtain letter from school board regarding school impact fees prior to issuance of a building permit, per City Commission Resolution No. 2012-035. 3Td time requested. 4. RIGHTS-OF-WAY: Provide recorded 5' r-o-w dedication as required prior to issuance of a certificate of occupancy, per City Commission Resolution No. 2012-035. 3rd time requested(Planning). 5. Please re-label the eastern parking lot to show the correct proposed use,and provide the number of parking stalls. (Landscape Consultant). Section 2. That such application must be reviewed by Broward County Aviation Department. That such approval is also subject to the conditions previously approved by the City Commission. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5.
