A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH,FLORIDA,APPROVING THE SITE PLAN MODIFICATION REQUEST
(SP-85-14) SUBMITTED BY BERMELLO AJAMIL & PARTNERS, INC.,
REPRESENTING THE PROPERTY OWNER,DANIA BEACH DEVELOPMENT,
LLC,FOR PROPERTY LOCATED AT 480 EAST DANIA BEACH BOULEVARD
IN THE CITY OF DANIA BEACH;PROVIDING FOR CONFLICTS;FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 28 of the Code of Ordinances of the City of Dania Beach, which
chapter contains the City Land Development Code, pursuant to Part 6, "Development Review
Procedures and Requirements",Section 635,states that site plan approval is required as a condition
to the issuance of a building permit; and
WHEREAS,on August 28,2012,the City Commission approved a variance(VA-35-12)to
allow a zero foot setback between the east property line and the vehicle use area and to provide no
trees between the east property line and the vehicle use area,where required by Chapter 28, Section
275-90(2)by Resolution Number 2012-095, which expired twelve months after approval; and
WHEREAS,on August 28,2012,the City Commission approved a request for site plan(SP-
34-11) approval to allow for the construction of a 181 unit, 12-story residential development and
associated parking structure,by Resolution Number 2012-096,which expired twelve months after
approval; and
WHEREAS, on February 18,2013 staff issued an extension to site plan number SP-34-11
(Reso. No. 2012-096) and variance number VA-35-12 (Reso. No. 2013-095) per Florida Statutes
Executive Order to January 24, 2017; and
WHEREAS, the applicant, Bermello Ajamil and Partners, Inc., representing the property
owner Dania Beach Development, LCC, is requesting site plan modification approval for the
proposed construction of a 237 unit, 14-story residential development and associated parking
structure to be located at 480 East Dania Beach Boulevard, in the City of Dania Beach; and
WHEREAS,the applicant is participating in the Sustainable Building Practices Incentive,
the Public Parking Incentive, and the Public Park Incentive as described in Part 3 "Special Zoning
Districts", Article 305, of Chapter 28 "Land Development Code" to increase the allowable height
and density to the maximum allowed in the Gateway-Mixed Use zoning district as identified in
Section 303-70; and

WHEREAS,the Applicant, in a letter sent to the City dated October 28,2014 (attached as
Exhibit `B", and incorporated into this Resolution by this reference), has agreed and proferred to
commence construction of the development which is the subject of this Resolution within sixty(60)
days after receipt of a building permit;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application(SP-85-14)for site plan modification approval,a
copy of which is attached and made a part of this Resolution as Exhibit "A" is approved with the
following conditions:
1. Payment in lieu of park land dedication equals $99,000.47,which must be paid prior to the
issuance of a building permit, if accepted by the City Commission(Planning).
2. Per Section 805-110(F)(2),provide written agreements and documents acceptable to the City
Attorney identifying that the private ownership and maintenance of the open space is
adequately provided. Must be provided prior to issuance of a building permit(Planning).
3. Per Section 805-110(F)(3), provide a covenant for the City Attorney to approve which
restricts such private open space to parks, open space and recreational purposes to be
recorded in the Broward County Public Records prior to issuance of a building permit.Must
be provided prior to issuance of a building permit(Planning).
4. Utilization of Sustainable Building Practices Incentive:per Section 305-50(F)(6),project site
and engineering plans that clearly detail all green building measures which are intended to
qualify for incentives. Must be provided prior to issuance of a building permit(Planning).
5. Payment of the Park Incentive fee,in the amount of$116,006.00 is due prior to issuance of a
building permit (Planning).
6. Payment of the Public Parking Incentive fee, in the amount of$65,000.00, is due prior to
issuance of a building permit(Planning).
7. Applicant in a letter to the City dated October 28, 2014 (attached as Exhibit `B") has
voluntarily agreed to submit to commence construction of the development approved in this
Resolution within sixty(60) days after receipt of a building permit.
It is further noted that the original site plan is maintained in the office of the Community
Development Department of the City of Dania Beach.

Section 2. That such application must be reviewed by Broward County Aviation
Department. The point of contact is William Castillo,Airport Planner located at 220 S.W.45 Street,
Suite 101, Dania Beach, Florida, 33312, (954) 359-6100.
Section 3. That such approval is also subject to the conditions previously approved by the
City Commission.
Section 4. Issuance of a development permit by a municipality does not in any way create
any right on the part of an applicant to obtain a permit from a state or federal agency and does not
create any liability on the part of the municipality for issuance of the permit if the applicant fails to
obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes
actions that result in a violation of state or federal law.
Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 6. That this Resolution shall be in force and take effect immediately upon its
passage and adoption and remain valid for eighteen(18)months,per Section 635 of the Dania Beach
Land Development Code.

The Broward County Aviation Department (BCAD) has reviewed the proposed Paw Mare
development located:directly south of Fort Lauderdale-Hollywood International.Airport (FLL).
Since.the proposed project is.within 20,000 feet of FLL, its4evelopment and operation is subject
to Federal.Aviation Regulation (FAR):Part 77, and Chapter 333, Florida Statutes, and the
Broward County Land Development Code. These standards seek to ensure that any proposed
construction, use of high lift equipment, such as cranes, or other potential hazards will not
negatively impact the safe and efficient use of the airport and surrounding airspace. Taking into
consideration the proximity of this project to FLL, BCAD provides the following .comments
regarding.the proposed development:
• Based on thel location of the proposed project,,FAR Part 77, Subpart B and Section 57
182(n)(2) of the Broward.County. Land Development.Code, require the applicant. to
obtain a "Determination of No Hazard to Air:Navigation" from the Federal:Aviation
Administration(FAA).: The applicant has previously obtained a favorable determination i
for its proposed critical.building points and temporary construction cranes (Aeronautical
Studies 2014-ASO-6159-OE thru 2012-ASO-6164-OE,dated 8/6/2014). E
• The applicant: should also obtain "airspace obstruction permits" from the Florida i
Department of Transportation:(FDOT). This documentation is necessary to determine if
The project will adversely affectpublic health or safety. These permits should be obtained:

• No building, structure or vegetation on the site. may exceed.one hundred sixty seven
(167)feet above Mean:Sea Level(MSL)based on North American:Vertical Datum 1988
(NAVD `88), as shown on the site plan:and architectural plans, unless submitted to
BCAD for additional review. At this location, a.structure exceeding this height would
impact critical airspace surfaces,some of which are not monitored by.the.FAA or FDOT,
but are of critical safety importance to operations at FLL. I
• It is critical that the: FLL Airside, Operations.Manager, John Pokryfke, be notified 72
hours.prior to the. construction crane going up. John can be reached at 954-359-1214
(office), or 954-336 2734 (mobile),. Additionally, it is critical that the crane operator
follow the marking/lighting requirements as well as lowering instructions issued by the
FAA determination.
• The proposed development must not generate light, glare, smoke or other emissions that
could be disorienting to pilots operating in the vicinity of the airfield.

• The proposed development must not attract wildlife that.would .be a potential safety
hazard to aircraft operations,
We request that:the above conditions be included in any site plan approval issued by the City of
Dana Beach.
