Call to Order/Roll Call Mayor Duke called the meeting to order at 7:00 p.m. Present: Mayor: Walter B. Duke, III Vice-Mayor: Chickie Brandimarte Commissioners: Bobbie H. Grace Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Alle ig ance Father Roger Holoubek, St. Maurice at Resurrection Catholic Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. Mayor Duke clarified his statement from the last meeting regarding former Mayor Robert Chunn, Jr., noting the misunderstanding stemmed from a recommendation he was asked to give on behalf of former Mayor Chunn, which was for a gun permit and not for getting his rights restored. Mayor Duke apologized for the confusion and said he is a big believer in second chances; former Mayor Chunn is a shining example of a second chance that has done well. 3. Presentations and Special Event Approvals 3.1 Special Event Request from the Dania Lions Club for the "Quarterdeck Moonlight Classic Car Show", to be held on November 15, 2014, from 5:00 p.m. to 10:00 p.m., in the N.W. area of the beach parking lot. The applicant is requesting a fee waiver for all parking fees, a special event permit fee waiver for $150.00, and road closure for the N.W. beach parking lot. Commissioner Grace motioned to approve the Special Event request for the Quarterdeck Moonlight Classic Car Show, including fee waivers and road closure; seconded by Commissioner Jones. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments James Silvernale, President of Dania Lions Club, thanked the Commission and residents for their support. Bruce Hannover, 617 NE 2nd Place, noted he has recorded decibel levels of 93 in his yard as a result of the new runway, and said the County noise mitigation program is moving very slowly. Henry Graham, 3220 N 24d` Avenue, Hollywood, Director of the Food Bank in Hollywood (LES), noted they also provide services to Dania Beach residents, and requested financial assistance in order to continue the Food Pantry. Mayor Duke noted that 2,800 heads of households in Dania Beach go to the pantry for assistance. Commissioner Jones noted Mr. Graham has come before the Commission several times, and has never received any funding from the City. He said he supports LES and they should receive dollars, even if the Commission has to go against their policy. Commissioner Grace spoke of her involvement with the Food Pantry for the benefit of Dania Beach residents. Vice-Mayor Brandimarte commented that Mr. Graham is welcome to bring donation boxes to the Seniors Club again this year. Commissioner Jones motioned for the City Manager to find funds, from contingency, to assist the Food Pantry; seconded by Commissioner Grace. After a brief discussion, Commissioner Jones withdrew the motion, and the consensus was to wait until after the donation committee meets. George Jason, 4549 SW 37d' Avenue, addressed the Sun Sentinel's endorsement for the upcoming election, and encouraged everyone to read it. Christine Douglas, 4665 SW 38`" Terrace, President of the Homeowner's Association, thanked BSO for catching burglars in their neighborhood. She added the Griffin Civic Association will hold a meeting with the representatives of Family Dollar. Jackie Plybon, 7080 Nova Drive, Davie, read a letter from former Mayor McElyea to the Broward County Historical Society regarding nominations for Pioneer from the Dania Beach Historical Society. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,October 28,2014—7:00 p.m. Commissioner Grace noted the Broward County event was not for the Pioneers of the City; it was for every cities' first, and she was the first African American woman mayor of Dania Beach. Commissioner Jones commented that Mayor Duke had a right to nominate. He also noted he is the first African American male appointed to the Hospital District, and the first African American Broward County Commissioner, from Dania Beach. Joseph Ronga, 244 SW P Terrace, spoke of concerns with the All Aboard Florida proposed expansion, and the vibration experienced since the wood ties were replaced with concrete ties on the track running along SW 4 h Avenue. He provided a handout to Mayor Duke, which is attached to these minutes, and said that he has been requesting a wall for 20 years. Mayor Duke requested Mr. Ronga schedule a meeting with Assistant City Manager Colin Donnelly, and Marc LaFerrier, Director of Community Development. Tamara James, 255 NW Tamara James Avenue, commended Mayor Duke on the extraordinary job he has done. Charlotte Sloboda, 2905 Lakeshore Drive, thanked Mayor Duke for his service. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, reported on incidents within the city. He noted another driveway initiative will be held on October 30t'. Sean Brown, Battalion Chief, BSO Fire Rescue, recommended everyone change the batteries in their smoke alarms. He then presented a brief report on their preparedness to deal with the Ebola virus. 7. (SECOND READING) 7.8 RESOLUTION#2014-103 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, ADOPTING FEES RELATED TO APPLICATION, PROCESSING AND PERMITTING OF MEDICAL MARIJUANA RETAIL CENTERS;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Ordinance #2014-016 and Ordinance #2014-015, and Resolution#2014-103 because they relate to the same subject. Kathryn Mehaffey, Weiss Serota Helflnan, Special Counsel, presented a Powerpoint overview of the proposed legislation and revisions that were made since first reading, which is attached to these minutes. Additionally, she recommended changing 30 days to 20 days in paragraph a on page 9 of the land use ordinance, to be consistent with the action plan requirement. She clarified for Mayor Duke that all comments and concerns of the Commission have been incorporated into the current ordinances. She further recommended changing the term to 20 days in paragraph 5 on page 10 of the business regulations ordinance, to match the recommendation above; and deleting the extra word "on" in subsection 7 on page 12. Ms. Mehaffey confirmed that procedures are built in to revoke licenses. Mayor Duke opened the Public Hearings. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearings. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,October 28,2014—7:00 p.m. Commissioner Grace motioned to adopt Ordinance #2014-016, on second reading, as revised; seconded by Commissioner Jones. He asked the Commission to disclose any communication they had on these matters. Members of the City Commission noted they had been contacted by CRA Executive Director Earle regarding Item #9.3. Mayor Duke also noted he had been contacted by Dennis Mele regarding this same item. 9.3 RESOLUTION#2014-104 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN MODIFICATION REQUEST (SP-85-14) SUBMITTED BY BERMELLO AJAMIL & PARTNERS,INC.,REPRESENTING THE PROPERTY OWNER,DANIA BEACH DEVELOPMENT,LLC,FOR PROPERTY LOCATED AT 480 EAST DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2014-104. Corinne Lajoie, Principal City Planner, provided an overview of the previously approved site plan and the proposed revisions. She noted staff recommends approval provided all of the staff comments are addressed prior to the issuance of the permit. Vice-Mayor Brandimarte noted the project began in 2012, and questioned when construction would actually commence. Minutes of Regular Meeting Dania Beach City Commission Tuesday,October 28,2014—7:00 p.m. Steve Wherry, Greenspoon Marder, on behalf of the developer, concurred with the presentation and agreed with the recommendations. He said they are proposing to get their documents and begin construction within 60 days of building permit receipt. Mayor Duke opened the Public Hearing. Joe Ronga, 244 SW 3`d Terrace, commented that Dania Beach Boulevard will be packed. Bruce Hannover, 617 NE 2nd Place, questioned if the infrastructure is in place to handle this development. Seeing as there was no one else to speak in favor or opposition, Mayor Duke closed the Public Hearing. Vice-Mayor Brandimarte motioned to adopt Resolution #2014-104; seconded by Commissioner Jones. Mayor Duke commented he shares the desire to get things done in the City, but wants to be careful about the message we send to property owners/developers with imposing our will on their property rights. The motion carried on the following 4-0 Roll Call vote: Commissioner Grace Yes Vice-Mayor Brandimarte Yes Commissioner Jones Yes Mayor Duke Yes 9.4 RESOLUTION#2014-105 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-76-14) AND VARIANCE REQUESTS (VA-86-14 AND VA-87-14) SUBMITTED BY VANDER PLOEG AND ASSOCIATES, INC., REPRESENTING THE PROPERTY OWNER, PROJECT USA, INC., FOR PROPERTY LOCATED AT 150 BRYAN ROAD, IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2014-105. Corinne Lajoie, Principal City Planner, reviewed the two variances requested as well as the site plan. Derek Vander Ploeg, representing the property owner, provided additional details of the project, noting they are working with SFWMD and will construct a continuous seawall, for which the owner will be responsible for the maintenance. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,October 28,2014—7:00 p.m. Commissioner Jones motioned to adopt Resolution #2014-105; seconded by Vice-Mayor Brandimarte. Commissioner Jones questioned if there would be a drainage problem. Mr. Vander Ploeg responded 100% of their water will be contained on their property. Discussion and Possible Action There were no discussion items on this agenda. 11. Commission Comments 11.1 Commissioner Grace Commissioner Grace spoke of recent and upcoming civic and community events. Commissioner Grace commented she served on the Historical Society of Broward County, and their rules state a person can only be inducted into the Pioneers one time; she was inducted and former Mayor McElyea was her sponsor. Commissioner Grace encouraged everyone to vote on November 4th 11.2 Commissioner Jones Commissioner Jones asked the City Manager to reach out to the Green Advisory Board to see if they could focus on global warming and climate change. He suggested perhaps they could contact the County committee for information and guidance. He felt the Vice-Mayor would probably be interested in this matter since she serves on the FLC Energy, Environment and Natural Resources committee. Commissioner Jones questioned the status of speed zones on Stirling Road. City Manager Baldwin responded it was to have taken one year, and he will provide an update to the Commission. Commissioner Jones spoke of a picture he had taken of an asphalt truck taking water from City fire hydrants, and noted we need to be on top of this situation. Commissioner Jones complimented the City Manager on the Oasis projects. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,October 28,2014—7:00 p.m. Commissioner Jones spoke about recent social events and happenings. Commissioner Jones said everybody deserves a second chance, especially someone like Robert Chunn. He felt the Mayor needs to apologize to the Commission, as well as to Mr. Chunn's family. Commissioner Grace defended herself, and said she is delighted to be with Robert Chunn on all of the projects that he does in the City. 11.3 Vice-Mayor Brandimarte Vice-Mayor Brandimarte noted she admires the Mayor for starting the meeting with his letter. She questioned where her second chance was when she was ill. Vice-Mayor Brandimarte thanked everyone who attended the Seniors' luncheon today. Vice-Mayor Brandimarte said she attended a training session that recommended Commissioners not address comments made by residents at the podium. Vice-Mayor Brandimarte spoke of a meeting she attended in Fort Lauderdale regarding medical marijuana, and felt Dania Beach is doing a good job on this issue. 11.4 Mayor Duke Mayor Duke complimented Commissioner Grace on the Mayor's Gala. 12. Appointments Commissioner Jones motioned to re-appoint Commissioner Flury's board appointments; seconded by Vice-Mayor Brandimarte. He added he looks forward to working with whoever sits in the Mayor's seat, and felt that the seat itself should be respected, regardless of any disagreement with the person sitting in it. 14.
