Home My WebLink AboutR-2014-117 Authorized purchase of 1 new unit industrial backhoe loader from Trekker Group under Florida State Contract for $87,402.61 RESOLUTION NO. 2014-117 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO PURCHASE ONE (1) NEW UNIT INDUSTRIAL BACKHOE LOADER FROM TREKKER GROUP BY USING THE PRICING UNDER THE FLORIDA STATE CONTRACT, WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS, IN THE AMOUNT OF EIGHTY SEVEN THOUSAND FOUR HUNDRED TWO DOLLARS AND 61 CENTS ($87,402.61); DECLARING CERTAIN EQUIPMENT OBSOLETE, SURPLUS, AND OF NO FURTHER USE TO THE CITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids if he is authorized to do so in advance by a resolution adopted by the City Commission and if such purchases are made pursuant to a competitive bid obtained within the last eighteen (18) months by other government agencies such as the Federal Government, State of Florida or a Florida municipality or county; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", Subsection(a), sets the monetary threshold or limitation at$25,000.00; and WHEREAS, the Dania Beach Public Services Department currently owns a 1996 Case 580L backhoe loader which requires extensive maintenance repair and is no longer economically viable to maintain; and WHEREAS, the Dania Beach Public Services Department recommends replacement of the existing backhoe loader and recommends declaring such equipment to be obsolete, surplus, and of no further use to the City; and WHEREAS, the City Commission approved in the FY-2015 budget the purchase of one new industrial backhoe loader from the Stormwater Utility Fund; and WHEREAS, the Director of the Public Services Department has determined that such vehicle can be purchased at the least cost to the City from Trekker Group without competitive bidding and without advertisements for bids using current available pricing and terms obtained under the Florida State Contract No. 760-000-10-1, a copy of which is attached, made a part of and is incorporated into this Resolution by this reference; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "Whereas" clauses are ratified and confirmed as being true and correct and they are made a specific part of and incorporated into this Resolution by this reference. Section 2. That the proper City officials are authorized to execute a purchase order with Trekker Group for the purchase of a new industrial backhoe loader in the amount of Eighty Seven Thousand Four Hundred Two Dollars and 61 cents ($87,402.61). Section 3. That the funding was planned and is available from appropriations in the Stormwater Fund- Capital Equipment Account, Account No. 403-38-01-538-64-30. Section 4. That upon delivery of the new backhoe loader to the City, the existing Case backhoe loader shall be declared surplus and the City Manager is authorized by the City Commission to dispose of such obsolete and surplus equipment in a manner or method which is determined will generate the most revenue to the City; further, the Case backhoe loader shall be immediately removed from service and stored at the City's Public Services compound until such disposition occurs. Section 5. That the City Manager and City Attorney are authorized to make minor revisions to the documents associated with the purchase, if any, that are deemed necessary and proper and in the best interests of the City. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7.
