HomeMy WebLinkAboutR-2014-113 Purchase of 1 Vac-Con Sewer Combination Cleaner Body on a 2015 Freightliner Truck from Southern Sewer Equipment Sales & Service not to exceed $374,686.70 using Florida Sheriff's Contract RESOLUTION NO. 2014-113 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO PURCHASE ONE (1) NEW VAC-CON SEWER COMBINATION CLEANER BODY, MODEL NO. V312LHAE/1300 ON A 2015 FREIGHTLINER TRUCK CHASSIS FROM SOUTHERN SEWER EQUIPMENT SALES AND SERVICE, INC. IN AN AMOUNT NOT TO EXCEED THREE HUNDRED SEVENTY FOUR THOUSAND SIX HUNDRED EIGHTY SIX DOLLARS AND 70 CENTS ($374,686.70), USING THE CURRENT AVAILABLE PRICING UNDER THE FLORIDA SHERIFF'S OFFICE CONTRACT NO. 14-12-0904, SPECIFICATION NO. 47, WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids if he is authorized to do so in advance by a resolution adopted by the City Commission, and if such purchases are made pursuant to a competitive bid obtained within the last eighteen (18) months by other government agencies such as the Federal Government, State of Florida or a Florida municipality or county; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", Subsection(a), sets the monetary threshold or limitation at $25,000.00; and WHEREAS, the Commission approved in the 2014/2015 Fiscal Year budget the purchase of a Vac-Con Sewer Combination Cleaner and a Freightliner Truck in the amount of Three Hundred Seventy Five Thousand Dollars ($375,000.00), with fifty percent (50%) to be funded from the Sewer fund, Sewer Utility-Collection Division, Capital Equipment Account, and fifty percent (50%) from the Stormwater Fund-Capital Equipment Account; the new Vac-Con Sewer Combination Cleaner body on a 2015 Freightliner Truck chassis is intended to replace an existing "blue" Vac-Con Sewer Combination Cleaner and Freightliner Truck, which has been owned and operated by the City and is over twelve (12) years old, and such equipment is to be declared as surplus equipment; and WHEREAS, the Director of the Public Services Department has determined that such items can be purchased at the least cost to the City from Southern Sewer Equipment Sales and Service, Inc. using current available pricing and terms under the Florida Sheriff's Bid No. 14-12- 0904, Specification No. 47, and in accordance with the written proposal from the above- referenced corporation, a copy of which is attached as Exhibit"A", and it is made a part of and is incorporated into this Resolution by this reference; and WHEREAS, the City desires to enter into an Agreement with Southern Sewer Equipment Sales and Service, Inc. to utilize the same available pricing under the Florida Sheriff's Office Bid No. 14-12-0904, which is too voluminous to be attached as Exhibit `B" to this Resolution, but has been provided to the City Clerk via e-mail for entry into the Clerk's computer file, such Agreement is made a part of and is incorporated into this Resolution by this reference; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "Whereas" clauses are ratified and confirmed as being true and correct, and they are made a specific part of and incorporated into this Resolution by this reference. Section 2. That the City administration is authorized to open a purchase order with Southern Sewer Equipment Sales and Service, Inc. for the purchase of a new Vac-Con Sewer Combination Cleaner Body, Model No. V312LHAE/1300, on a 2015 Freightliner Truck chassis for the amount of Three Hundred Seventy Four Thousand Six Hundred Eighty Six Dollars and 70 cents ($374,686.70). Section 3. That the funding was planned and is available with fifty percent (50%) of the purchase price of One Hundred Eighty Seven Thousand Five Hundred Dollars ($187,500.00) from Sewer Fund, Sewer Utility-Collection Division, Capital Equipment Account, Account No. 402-35-02-535-64-30 and fifty percent (50%) of the purchase price of One Hundred Eighty Seven Thousand Five Hundred Dollars ($187,500.00) from the Stormwater Fund-Capital Equipment Account, Account No. 403-38-01-538-64-30. Section 4. That upon delivery to the City of the new Vac-Con Sewer Combination Cleaner Body on a 2015 Freightliner Truck chassis,the existing"blue"Vac-Con(City Truck No. 515) shall be declared surplus and sold as surplus material at the next City public auction; 2 RESOLUTION#2014-113 further, truck No. 515 shall be immediately removed from service and stored at the City's Public Services Department compound until the next City public auction. Section 5. That the City Commission approves that the City enter into an Agreement with Southern Sewer Equipment Sales and Service, Inc. to utilize the same available pricing and terms under the Florida Sheriff's Office Contract No. 14-12-0904, which is too voluminous to be attached as Exhibit "B" to this Resolution, but has been provided to the City Clerk for entry into the Clerk's file, and such Agreement is made a part of and incorporated into this Resolution by this reference. Section 6. That the City Manager and City Attorney are authorized to make minor revisions to the Agreement that is deemed necessary and proper and in the best interests of the City. Section 7. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 8.
