RESOLUTION NO. 2015-002 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, ACCEPTING A RIGHT-OF-WAY DEED, PROPOSED TO BE CONVEYED TO THE CITY BY 36TH STREET ACQUISITION, INC., A FLORIDA CORPORATION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proper City officials are authorized to accept a Right-of-Way Deed from 36th Street Acquisition, Inc., a Florida corporation. A copy of the Deed is attached as Exhibit"A", and it is made a part of and incorporated into this Resolution by this reference. Section 2. The City Manager and City Attorney are authorized to make minor revisions to the Deed as are deemed necessary and proper for the best interests of the City. Section 3. That the Right-of-Way Deed shall be recorded in the Public Records of Broward County, Florida. The cost of recording the Deed shall be paid for by the grantor, and the actual recording of it shall be done by the City. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. The Project has already been approved and construction is complete. During construction,it was discovered that the County Property Appraiser's office shows two(2) small parcels in the middle of the existing 36"' Street right-of-way as being privately owned (Owner is shown as 36`' Street Acquisitions). It is believed that these parcels were dedicated as public right-of-way by previously recorded plats,and the parcels are, in fact,currently being used for right-of-way purposes (they are in the middle of an existing roadway that's been used as right-of-way for over 50 years). However, the title company and the Property Appraiser's office concluded that in order to correct this,they need 36 h Street Acquisitions convey the parcels to the City of Dania Beach. I've attached the print-outs from the Property Appraiser's office showing the remnant parcels in question. In this regard, 36"' Street Acquisitions has executed a Right-of-Way Deed conveying the two remnant parcels to the City(a copy of the executed Right-of-Way Deed is enclosed with this letter). We are prepared to record the deed when you provide us with confirmation that is acceptable to do so.
