HomeMy WebLinkAboutR-2015-019 Approves Temporary Use (OT-01-15) request submitted by Joseph Denis on behalf of Dania Live 1748, LLC, for property at the northwest corner of Dania Beach Boulevard & Bryan Road RESOLUTION NO. 2015-019 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE TEMPORARY USE (OT-01-15) SUBMITTED BY JOSEPH DENIS ON BEHALF OF DANIA LIVE 1748, LLC, PROPERTY OWNER, FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF DANIA BEACH BOULEVARD AND BRYAN ROAD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 28 of the Code of Ordinances of the City of Dania Beach, which chapter contains the City Land Development Code(the"LDC"),pursuant to Part 6, "Development Review Procedures and Requirements", Section 610, states that all public hearings required by the LDC shall be noticed according to that Code and in accordance with Florida state statutes and the Florida Administrative Code; and WHEREAS,Article 675 of Chapter 28 of the LDC sets the requirements for temporary use regulations in the City of Dania Beach; and WHEREAS, Section 675-20(E) of the LDC permits construction material storage and processing with City Commission approval; and WHEREAS, Joseph Denis, on behalf of Dania Live 1748, LLC, the property owner, is requesting a temporary use approval(OT-01-15)to allow soil storage on the subject property for the future development of a mixed use project known as"Dania Live"; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application(OT-01-15) is approved for a period of twenty- four(24) months. Section 2. Issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4.
