Call to Order/Roll Call Mayor Salvino called the meeting to order at 7:00 p.m. Present: Mayor: Marco A. Salvino, Sr. Vice-Mayor: Bobbie H. Grace Commissioners: Chickie Brandimarte Walter B. Duke, III Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Commissioner Jones gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event request from the Marine Industries Association of South Florida for the "19th Annual Plywood Regatta", to be held on April 11-12, 2015, at the North end of the Marina parking lot. The applicant is also requesting a special event fee waiver of $150.00, as well as waiver of parking fees for volunteers. Commissioner Duke motioned to approve the Special Event request for the 19th Annual Plywood Regatta, including waiver of special event fee and parking fees; seconded by Commissioner Jones. The motion carried unanimously. 3.2 Mayor's State of the City Video The 2015 State of the City video was presented at this time. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Jeremy Earle, CRA Executive Director, thanked the Commission, City staff, BSO, and the residents for their support and participation in the Arts & Seafood Celebration that was held over the weekend. Andrew Beninati, 4461 SW 24d` Avenue, spoke of the Dania Cove Park, and questioned if something could be done along the hedge line on the east side. Jeff Guzowski, 238 SE 2►,d Street, commented that he received a courtesy code violation, along with six of his neighbors, for a dirty roof. He noted his roof is five years old and it is not dirty. He said the City needs to enforce codes city-wide, not just in one neighborhood. He also noted that three of the new drains on SE 2"d Street do not work. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, reported on recent criminal activity in the City. Sean Brown, Battalion Chief, BSO Fire Rescue, reported that their employees who were involved in the recent accident are out of the hospital, and some are back to work. 7. Vice-Mayor Grace motioned to adopt the Consent Agenda,with the exception of Item #7.3; seconded by Commissioner Duke. The motion carried unanimously. 7.3 RESOLUTION#2015-024 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,REQUESTING ADVANCE APPROVAL FROM THE CITY COMMISSION FOR ADVERTISEMENT OF THE CAPITAL PROJECT KNOWN AS THE LIME SOFTENING PLANT REHABILITATION FILTER UPGRADE PROJECT IN AN AMOUNT NOT TO EXCEED SEVEN HUNDRED THOUSAND DOLLARS($700,000.00);PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2015-024. Commissioner Jones said he pulled this item for additional information. Dominic Orlando, Director of Public Services, noted this is the last component of the upgrade, and provided the entire history of the bidding process and upgrades that began several years ago. Commissioner Jones motioned to adopt Resolution #2015-024; seconded by Commissioner Duke. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans 9.1 ORDINANCE#2015-007 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 18, ENTITLED "PENSIONS AND RETIREMENT" OF THE CITY CODE OF ORDINANCES RELATING TO THE POLICE AND FIREFIGHTERS'RETIREMENT SYSTEM TO PROVIDE FOR INTERNAL REVENUE CODE COMPLIANCE; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) City Attorney Ansbro read the title of Ordinance #2015-007, and noted this is required to conform to IRS Regulations. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,March 24,2015—7:00 p.m. Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or opposition,he closed the Public Hearing. Vice-Mayor Grace motioned to adopt Ordinance #2015-007, on second reading; seconded by Commissioner Jones. The motion carried unanimously. 9.2 ORDINANCE#2015-008 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 12, ENTITLED, "FLOOD DAMAGE PREVENTION' OF THE CITY CODE OF ORDINANCES TO PROVIDE FOR REVISIONS PERTAINING TO THE ACCUMULATION OF COSTS OF IMPROVEMENTS AND REPAIRS OF BUILDINGS BASED UPON ISSUED BUILDING PERMITS OVER A ONE (1) YEAR PERIOD INSTEAD OF A FIVE (5) YEAR PERIOD, AND FOR OTHER PURPOSES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) City Attorney Ansbro read the title of Ordinance#2015-008. Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Vice-Mayor Grace motioned to adopt Ordinance #2015-008, on first reading; seconded by Commissioner Jones. The motion carried unanimously. 9.3 RESOLUTION#2015-022 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING VARIANCE REQUESTS (VA-58-14 and VA-33-15) SUBMITTED BY CLMIA, LLC, FOR PROPERTY LOCATED AT 4470 RAVENSWOOD ROAD IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. 9.4 RESOLUTION#2015-023 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST (SP-09-12 MOD) SUBMITTED BY CLMIA, LLC, FOR PROPERTY LOCATED AT 4470 RAVENSWOOD ROAD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution #2015-022 and Resolution #2015-023 because they related to the same property, and noted the applicant has requested a two-week continuance. Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or opposition,he closed the Public Hearing. Commissioner Jones motioned to continue Resolution #2015-022 and Resolution #2015-023 until the April 10 City Commission meeting at 7:00 p.m.; seconded by Vice-Mayor'Grace. The motion carried unanimously. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,March 24,2015—7:00 p.m. 10. Discussion and Possible Action 10.1 Dania Beach Leadership & Career Skills University—Commissioner Jones Commissioner Jones reviewed the presentation that was included in the agenda packet. Commissioner Jones requested approval to apply for a grant from the Department of Juvenile Justice in order to fund the university, and noted the City would not be required to use any of its funds. He also requested that the Commission allow him to go back to Washington, D.C. and look for other grants. Commissioner Brandimarte questioned if we were limited to 20 students. Commissioner Jones stated the intention is to start small, become good at what we are doing, and then perhaps expand the program. Additionally, parents' involvement and buy-in is needed. Vice-Mayor Grace commented she is concerned with limiting the program to ages 16-18, and not including younger students. Commissioner Jones explained that there is liability because of employment regulations concerning 14 and 15 year olds. Commissioner Duke motioned to approve the application for grant funding for the Dania Beach Leadership & Career Skills University, and to include travel to Washington, D.C.; seconded by Vice-Mayor Grace. The motion carried unanimously. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte provided positive comments on the Arts and Seafood Celebration. 11.2 Commissioner Duke Commissioner Duke complimented Mayor Salvino on the State of the City video. 11.3 Commissioner Jones Commissioner Jones provided an update on meetings he attended during the past few weeks. Commissioner Jones also provided positive comments on the Arts and Seafood Celebration. Commissioner Jones suggested limiting budget workshop agendas to 15 items, which would be more productive, and having workshops more than once or twice per year. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,March 24,2015—7:00 p.m. 11.4 Vice-Mayor Grace Vice-Mayor Grace also complimented Mayor Salvino on the State of the City video. Vice-Mayor Grace spoke of civic and community events she attended. Vice-Mayor Grace provided positive comments on the Arts and Seafood Celebration. 11.5 Mayor Salvino Mayor Salvino provided positive comments on the Arts and Seafood Celebration. 12. Appointments Charter Review Board Commissioner Jones asked if the board could move forward without the alternates; the Commission consensus was that it should proceed. Mayor Salvino appointed Bruce Hannover as an alternate member. Vice-Mayor Grace motioned to approve the Charter Review Board appointment; seconded by Commissioner Brandimarte. The motion carried unanimously. Police and Fire Pension Board Confirm appointment of Carolyn Jones as the 9th member of the board, as chosen by a majority of the members Commissioner Brandimarte motioned to confirm the appointment of Carolyn Jones as the 9th member of the Police and Fire Pension Board; seconded by Commissioner Jones. Administrative Reports 13.1 City Manager City Manager Baldwin thanked the Commission,for the productive workshop on March 12th. City Manager Baldwin invited everyone to the Easter egg celebration at Frost Park on April 4th. 13.2 City Attorney Minutes of Regular Meeting Dania Beach City Commission Tuesday,March 24,2015—7:00 p.m. City Attorney Ansbro reported City staff has been working with an environmental engineer to begin testing in the Melaleuca neighborhood for asbestos contained materials. The more extensive review will require more money and time, and staff will come back to the Commission for approval. City Attorney Ansbro advised legislation to regulate Sober Homes is making its way through the legislature.
