Call to Order/Roll Call Mayor Salvino called the meeting to order at 7:00 p.m. Present: Mayor: Marco A. Salvino, Sr. Vice-Mayor: Bobbie H. Grace Commissioners: Chickie Brandimarte Walter B. Duke, III Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Vice-Mayor Grace gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Presentation from Dunlap & Associates, Inc. — GO Bond 2005D — Refinance Opportunity Request to RFP Kelly Ryman, Dunlap & Associates, Inc., noted they are recommending the City refinance the 2005D Bonds,which would save the City$610,000.00 over the life of the bond. Commissioner Jones motioned to proceed with the bond refinancing; seconded by Commissioner Duke. The motion carried unanimously. 3.2 Presentation of FY 2014 CAFR by HCT Certified Public Accounts & Consultants, LLC Roderick Harvey, CPA, Managing Partner, HCT Certified Public Accountants and Consultants, reviewed the results of the FY 2014 Audit, a copy of which is attached to these minutes. 3.3 Approve the Parks, Recreation and Community Affairs Advisory Board recommendation for a full fee waiver of$600.00 for the Dania Lions Club to utilize the I.T. Parker Community Center for their "District Meeting", on June 6, 2015. The Parks, Recreation and Community Affairs Advisory Board unanimously approved the request for a full fee waiver and recommend Commission approval. Commissioner Jones motioned to approve the fee waiver for the Dania Lions Club; seconded by Vice-Mayor Grace. The motion carried unanimously. 3.4 Approve the Parks, Recreation and Community Affairs Advisory Board recommendation for a full fee waiver of $1,200.00 for the Dania Bears Football Organization to utilize the I. T. Parker Community Center for their "Football and Cheerleading Coaches Certification" on June 7 & July 12, 2015. The Parks, Recreation and Community Affairs Advisory Board unanimously approved the request for a full fee waiver and recommend Commission approval. Vice-Mayor Grace motioned to approve the fee waiver for the Dania Bears Football Organization; seconded by Commissioner Jones. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Betty Sokol, 609 NW 10th Street, spoke of a $150.00 Beach Parking Permit charged to her Church when they held their Sunrise Service, and noted that the trash containers were overflowing. Commissioner Jones commented that the trash should be picked up earlier when there are Sunrise Services. Teddy Bohanan, 312 SW 15t` Street, addressed the drug activity in her neighborhood, and asked for more police patrol. Commissioner Brandimarte requested cooperation from BSO and an explanation at the next meeting on how many officers are patrolling the neighborhood. Antonio Arcieri, 2601 SW 58a' Manor, had questions about the Broward County water improvement project for UAZ 310, and asked if the City was providing assistance to the property owners whose properties are affected. Terry Hale-Hicks, 331 SW 2nd Avenue, requested funding in the amount of$20,000.00 for Aging & Disability Resource Center, and spoke of upcoming senior events. Kristen Dridge, President of the Friends of the Library, 227 SE 8t' Street, advised the Walk for the Library will be held this Saturday,April 18, 2015. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,April 14,2015—7:00 p.m. Tamara James, 255 NW Tamara James Avenue, presented gifts from the Holy Land to the members at the dais. She also presented the Commission with a plaque for their support of her foundation, and asked for an increase in funding from the City. Bob Adams, 330 SE 3`d Terrace, commented that Florida law should be changed to allow convicted felons, who have served their time, to have their rights automatically restored and be eligible to vote: He wondered if someone should start a petition for a constitutional amendment. Mark LaRocca, 4511 SW 59a'Avenue, commented on several airport issues. Shirley Jones, 130 SW 5d' Court, expressed her concerns about drug dealing in her neighborhood, dirty alleyways, and lack of lighting. She requested speed humps on SW 5d' Court and that a police car be parked on the street to help control drug dealing and speeding. Vice-Mayor Grace recommended solar lighting be installed. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, introduced Lt. Anthony DeMarco, as the new BSO Executive Officer for Dania Beach, and members of Explorer Post#5539. Chief Granville noted that he and his officers often patrol the neighborhoods, including the Dania Beach Heights area. Vice-Mayor Grace spoke of phone calls she received while on vacation, and of having given Chief Granville a list of trouble spots in the City. She told Chief Granville that he is a contract employee, and if she does not get a resolution from him, she will go to the City Manager to address the problems. Sean Brown, Battalion Chief, BSO Fire Rescue, noted they will be setting up the EOC tomorrow to test the functionality of the system. 7. (Estimated cost $1,026.80) Approve travel request from Nicki Satterfield, Finance Director, to attend the Government Finance Officers' Association (GFOA) Conference in Philadelphia, Pennsylvania, on May 31, 2015 - June 3, 2015, for licensure requirements. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Grace Yes Commissioner Duke Yes Mayor Salvino Yes Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,April 14,2015—7:00 p.m. Commissioner Jones Yes 7.4 RESOLUTION#2015-028 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO APPLY FOR THE 41" YEAR COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM IN THE APPROXIMATE AMOUNT OF $149,326.00, TO PROVIDE FUNDING FOR SOLAR LIGHTING PROJECT AREAS LOCATED WITHIN THE DANIA BEACH COMMUNITY REDEVELOPMENT AGENCY BOUNDARIES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2015-028. Vice-Mayor Grace asked about the location of the solar lights. City Manager Baldwin responded the solar lights will be in the 41" year CDBG program, and this resolution is for authorization to apply for the grant. An actual plan indicating the location of the streetlights will be brought back to the Commission. Vice-Mayor Grace motioned to adopt Resolution #2015-028; seconded by Commissioner Jones. The motion carried unanimously. 7.5 RESOLUTION#2015-029 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING SPECIAL COUNSEL FUNDING FOR THE WHITE & CASE LAW FIRM, RELATED TO COSTS AND EXPENSES ASSOCIATED WITH THE FORT LAUDERDALE-HOLLYWOOD AIRPORT; PROVIDING FOR APPROPRIATION OF FUNDS IN AN AMOUNT NOT TO EXCEED FORTY THOUSAND DOLLARS ($40,000.00) FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 2015; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2015-029 and noted he requested this funding, in case it is needed. Mayor Salvino distributed an email from Judy Paul, the Mayor of Davie, which noted that they are retaining the services of Anne Castro, and requested that the City also retain her services for being the liaison concerning the airport issues. City Manager Baldwin clarified that the manager has authority to enter into an agreement up to $25,000.00, but the Commission needs to appropriate the funds. Commissioner Brandimarte felt this should be an agenda item for the next meeting. Mayor Salvino noted the other cities will be appropriating $10,000.00-$15,000.00 each. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,April 14,2015—7:00 p.m. Commissioner Jones questioned how much money we had left in the airport litigation fund. City Attorney Ansbro said currently there are no funds available and they would have to be appropriated. Mayor Salvino explained what Anne Castro has done in the past concerning the airport, and what she would do in the future, if retained as the liaison. The consensus was to place this matter on the next agenda for Commission discussion. Commissioner Jones motioned to adopt Resolution #2015-029; seconded by Commissioner Brandimarte. The motion carried unanimously. City Attorney Ansbro noted the Commission did not pull item #7.8, so he explained its background and what we are trying to accomplish with it. 7.6 RESOLUTION#2015-030 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE CITY ADMINISTRATION TO APPROPRIATE AN AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY-FIVE THOUSAND DOLLARS ($125,000.00) IN AVAILABLE FUNDS FROM THE GENERAL FUND - UNASSIGNED FUND BALANCE ACCOUNT, TO BE USED FOR THE DEFENSE OF THE CITY AND CITY OFFICIALS BY THE LAW FIRM OF ROBERTS, REYNOLDS, BEDARD & TUZZO, PLLC, RELATING TO TWO SEPARATE BROWARD COUNTY CIRCUIT COURT CASES ENTITLED "CITIZENS FOR RESPONSIBLE DEVELOPMENT, INC. VS. CITY OF DANIA BEACH, FLORIDA", AND "CITIZENS FOR RESPONSIBLE DEVELOPMENT, INC. VS. THE CITY OF DANIA BEACH AND WALTER B. DUKE, III", RESPECTIVELY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution #2015-030. He explained that our insurance has been exhausted because of this lawsuit, and additional funds are required. He noted he requested that the Jai-Alai people pay half of the costs, and he has a written commitment from them. Lastly, he stressed that this case needs to be settled reasonably. Commissioner Jones motioned to adopt Resolution #2015-030; seconded by Vice-Mayor Grace. The motion carried unanimously. 7.7 RESOLUTION#2015-031 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO PROVIDE FUNDING FOR AN ENTRANCE SIGN AT NEW GRIFFIN ROAD AND U.S. HIGHWAY 1, IN AN AMOUNT NOT TO EXCEED TWO HUNDRED AND FIFTY THOUSAND DOLLARS($250,000.00); PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution #2015-031. He noted this is a commitment from Broward County as part of the airport settlement agreement. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,April 14,2015—7:00 p.m. Commissioner Jones said he wants the Commission to have input on the design of the sign, and it should be something more than simply bricks and mortar. He suggested perhaps a remote controlled LED sign. City Attorney Ansbro noted three designs will be presented to the Commission, and the architect will be meeting with each Commissioner individually prior to that time. Commissioner Jones motioned to adopt Resolution #2015-031; seconded by Vice-Mayor Grace. The motion carried unanimously. 8. Bids and Requests for Proposals 8.1 RESOLUTION#2015-033 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AWARDING A BID TO, AND AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH, LIMOUSINES OF SOUTH FLORIDA, INC., FOR COMMUNITY BUS TRANSPORTATION SERVICES WITHIN THE CITY, WHICH SERVICES SHALL NOT EXCEED AN ANNUAL AMOUNT OF $222,500.00; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2015-033. Responding to Commissioner Jones, Mark Felicetty, Director of Parks & Recreation, addressed the cost of this contract compared to the previous contract, and confirmed this was the low bid. Commissioner Jones motioned to adopt Resolution #2015-033; seconded by Commissioner Brandimarte. The motion carried unanimously. 9. Public Hearings and Site Plans 9.1 ORDINANCE#2015-008 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 12, ENTITLED, "FLOOD DAMAGE PREVENTION" OF THE CITY CODE OF ORDINANCES TO PROVIDE FOR REVISIONS PERTAINING TO THE ACCUMULATION OF COSTS OF IMPROVEMENTS AND REPAIRS OF BUILDINGS BASED UPON ISSUED BUILDING PERMITS OVER A ONE (1) YEAR PERIOD INSTEAD OF A FIVE (5) YEAR PERIOD, AND FOR OTHER PURPOSES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) City Attorney Ansbro read the title of Ordinance#2015-008. Marc LaFerrier, Director of Community Development; explained the changes to the code, and noted this modification would be better for our residents and would not affect the 5% discount they currently receive. HALLIDAY, III, ON BEHALF OF GRIFFIN POINTE PARTNERS, LLP, TO REZONE PROPERTY LOCATED AT 2301 GRIFFIN ROAD IN THE CITY OF DANIA BEACH,FLORIDA, AND LEGALLY DESCRIBED IN EXHIBIT"A",A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; CHANGING THE CURRENT ZONING CLASSIFICATION OF THE PROPERTY FROM NEIGHBORHOOD OFFICE AND BANKING DISTRICT (C-1) TO COMMUNITY BUSINESS DISTRICT (C-2) AND GENERAL BUSINESS DISTRICT (C-3), SUBJECT TO CERTAIN RESTRICTIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) City Attorney Ansbro read the title of Ordinance#2015-010. Corinne Lajoie, Principal City Planner, provided an overview of the rezoning request. Dick Coker, representing the applicant,provided a brief overview of the request. Mayor Salvino opened the Public Hearing. Fred Elson, 2295 SW 45t' Street, commented he is concerned with the resulting traffic when the property is developed, and noted that there are a lot of people who walk on the street as there are no sidewalks in the area. He requested traffic calming devices be installed, and an increase in traffic enforcement. Rick Zapatta, 2331 SW 45 h Street, who is the owner of two other properties in the area, complained of traffic, especially coming from SW 25 h Avenue, and speeding on SW 45t' Street. He questioned what other uses were allowed in C-3 zoning, and added he does not want fast- food restaurants in his neighborhood. Seeing as there was no one else to speak in favor or opposition, Mayor Salvino closed the Public Hearing. Commissioner Duke motioned to adopt Ordinance #2015-010, on first reading; seconded by Vice-Mayor Grace. John Halliday, III, applicant, noted he met with all adjacent property owners, including those in the Habitat for Humanity and on the east side of the property. He discussed the proposed development, as well as the design of the ingress/egress. Commissioner Jones asked if we could request speed humps. City Attorney Ansbro responded not as part of the rezoning, but perhaps in the site plan, if the applicant agrees. Mr. Halliday suggested traffic control should be discussed with all the businesses in the area. Commissioner Brandimarte felt the City needs to somehow get a consensus of the homeowners in the area as to whether or not they want speed humps. (Continued from March 24,2015) 9.5 RESOLUTION#2015-023 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST (SP-09-12 MOD) SUBMITTED BY CLMIA, LLC, FOR PROPERTY LOCATED AT 4470 RAVENSWOOD ROAD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (Continued from March 24,2015) City Attorney Ansbro read the title of Resolution #2015-022 and Resolution #2015-023 because they relate to the same property. He noted the applicant is requesting a continuance until June 23, 2015. Mayor Salvino opened the Public Hearings. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearings. Commissioner Jones motioned to continue Resolution #2015-022 and Resolution #2015-023 until the June 23, 2015 City Commission meeting at 7:00 p.m.; seconded by Commissioner Brandimarte. The motion carried unanimously. 10. Discussion and Possible Action 10.1 Town Hall Meetings out West—Commissioner Jones Commissioner Jones commented he wants the Commission to have three to four meetings out west because we owe it to the people who live there. At Town Hall meetings we can invite representatives from Broward County who could address issues such as the drainage matter raised earlier by a resident in the west. He said he wants Commission action to have a Town Hall meeting at Meli Park; in particular, he would like the Mayor to have the Town Hall meeting. Commissioner Brandimarte noted the amount of1people who attended the previous Town Hall meeting shows there is support for them. The consensus was to hold Town Hall meetings on a voluntary basis to be coordinated by the City Manager. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,April 14,2015—7:00 p.m. 10.2 Solid Waste Contract—Colin Donnelly, Assistant City Manager City Manager Baldwin said he has been working with Waste Management, and noted there is a provision for a 5-year extension. Waste Management felt if we only had curbside pickup it could help reduce costs, but after an evaluation, they suggested that we go out for bid because there would be a substantial increase in price associated with extending their contract. He said the other issue is sole source commercial pickup, which does not make sense because there is a 3- year grace period for those currently providing the service and you cannot get a savings on the residential. However, if we bid the residential, we should also see what the impact would be of also bidding for sole source commercial. Staff is recommending required mandatory curbside pickup, an expanded recycling program, and tying the time period of the next agreement to the Reuters agreement so they expire at the same time, as well as a sole source commercial bid that would include residential. Tony Spadacea, Waste Management, noted they have tried to maintain the costs in Dania Beach, but changes are needed to reduce the costs. One cost factor is alleyway pickup, which requires extra personnel and different equipment; another is the heavy volume of bulk pickup throughout the City. These factors combined do not allow them to maintain the current pricing. He said they look forward to continuing to provide services to the City of Dania Beach, and will participate in the bidding process. Mayor Salvino questioned the volume of bulk pickup and the recycling process. Mr. Spadacea explained averages and quantities per household for bulk waste, and how enhancement of residential recycling through the use of carts reduces the cost of garbage collection. Commissioner Jones questioned who pays for the carts, and said he agrees to going out to bid. Vice-Mayor Grace noted alleyway garbage makes the City look horrible, and we want to keep our City clean and green. Commissioner Brandimarte noted the alleyways are also a safety issue with the garbage there, and questioned the percentage of alleyway pickup. Mr. Spadacea responded 25-30%of the City. Mark LaRocca, 4511 SW 34 h Avenue, agreed with Mr. Spadacea on the bulk pickup; secondly, alleyways are a huge liability for the hauler and the City. He noted he does not agree with sole source commercial for the City and spoke of franchise fees. He added he would like to see a level playing field for the RFP. Commissioner Duke motioned to proceed with option A, as recommended by staff; seconded by Vice-Mayor Grace. The motion carried unanimously. 11. Commission Comments 11.1 Commissioner Brandimarte Minutes of Regular Meeting 11 Dania Beach City Commission Tuesday,April 14,2015—7:00 p.m. Commissioner Brandimarte thanked Cahoots for the article on the Senior Citizens Club, and noted she is happy the summer feeding program for children was approved. 11.2 Commissioner Duke Commissioner Duke had no comments. 11.3 Commissioner Jones Commissioner Jones reported on community events. Commissioner Jones noted he asked the Broward League of Cities to do a white paper on law enforcement in light of various incidents in nearby cities. Commissioner Jones advised that the ribbon cutting for the fitness equipment in the SE 5 h Avenue linear park will be May 15, 2015. 11.4 Vice-Mayor Grace Vice-Mayor Grace spoke of community events. Vice-Mayor Grace commented she would like the City Manager and City Attorney to get with St. Ruth Missionary Baptist Church about a tree at 240 NW 12th Avenue that needs to be cut back. Commissioner Jones noted he will also pursue the matter. Vice-Mayor Grace noted she was elated to hear comments tonight about restoring rights because of the election next year and the upcoming voter registration drive. 11.5 Mayor Salvino Mayor Salvino spoke of upcoming community events. 12. Appointments Airport Advisory Board Commissioner Jones appointed Micheline Peacock. Charter Review Board Commissioner Duke appointed Luis Rimoli as an alternate member. Vice-Mayor Grace motioned to approve the appointments; seconded by Commissioner Jones. The motion carried unanimously. Marc LaFerrier, Director of Community Development, commented on the Oasis cleanup scheduled for this Saturday. At the session,the airport impacts were discussed and the Council directed Mr.Lemack to formalize the relationship with Ms. Castro by bringing back a scope of services to engage her assistance. Furthermore,we will be presented with a resolution at the Council meeting on April 15,2015 to send to the County Commission seeking assistance with the FAA for our common goal of quiet skies/quiet neighborhoods. In addition,we have approved the Town Administrator to appropriate funds in the 2016 budget to further assist in the efforts should our short term attempts be unsuccessful. As our communities have again been reunited on this initiative, I would like to ask that you formally seek support from your Commission to follow suit at a level you deem appropriate to engage the services of Ms.Castro. She has certainly demonstrated her knowledge, relationships,professionalism and skills to assist. We feel the momentum she has achieved is important to build upon. As this issue is again in the forefront,we felt it important for our constituents to know that not just staff is seeking mitigation,but that the elected body is directly involved.
