HomeMy WebLinkAboutR-2015-035 - Approved variance requests VA-32-15 & VA-42-15 on behalf of Griffin Pointe Partners, LLP for property located at 2301 Griffin Road RESOLUTION NO. 2015-035 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE VARIANCE REQUESTS (VA-32-15 & VA-42-15) SUBMITTED BY JOHN C. HALLIDAY, III, ON BEHALF OF GRIFFIN POINTE PARTNERS, LLP, FOR PROPERTY LOCATED AT 2301 GRIFFIN ROAD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Chapter 28 of the Code of Ordinances,Part 6,Article 625 of the City of Dania Beach Land Development Code (the "LDC") states that a variance approval can be granted if the request is consistent with criteria identified in Section 625-40 of the LDC; and WHEREAS, John C. Halliday, III, on behalf of Griffin Pointe Partners, LLP (the "Applicant"),is requesting a variance to provide no double row of trees;the LDC requires a double row of trees if a wall is located on the west property line,per Section 275-110(D) of the LDC; and WHEREAS,the Applicant is requesting a variance to provide category two(2)and three(3) trees; Code requires category one(1)trees for terminal islands and head-to-head parking areas,per Section 275-100(D); and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the Land Development Code; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That that certain application for variances (VA-32-15 and VA-42-15) are approved. It is further noted that the original site plan is maintained in the office of the Community Development Department of the City of Dania Beach. Section 2. That that certain application must be reviewed by the FAA and the Broward County Aviation Department. The contact person is William Castillo,Airport Planner located at 220 S.W. 45 Street, Suite 101, Dania Beach, Florida, 33312, (954) 359-6100. Section 3. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 4. That based upon the criteria set forth in Section 635 of the Dania Beach Land Development Code, all site plan approvals shall automatically expire and become null and void unless the applicant files a complete building permit application with construction drawings for all improvements shown on the site plan,within eighteen(18)months from the date of this Resolution. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6.
