HomeMy WebLinkAboutR-2015-038 - Approved variances VA-103-14 & VA-28-15 on behalf of American Maritime Officers Building of Dania Beach, LLC for property located at 2 Dixie Highway RESOLUTION NO. 2015-038 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING VARIANCES (VA-103-14 & VA-28-15) TO WAIVE PARKING REQUIREMENTS PURSUANT TO A REQUEST SUBMITTED BY HOPE W. CALHOUN, ESQUIRE, ON BEHALF OF AMERICAN MARITIME OFFICERS BUILDING OF DANIA BEACH,LLC,FOR PROPERTY LOCATED AT 2 DIXIE HIGHWAY IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Chapter 28, Part 6 of the Land Development Code(the"LDC"),Article 625, entitled"Variances", states that variances may be approved by the City Commission; and WHEREAS, Hope W. Calhoun, Esquire, on behalf of the Applicant, American Maritime Officers Building of Dania Beach, LLC, is requesting a variance to provide two hundred twenty (220) parking spaces on site, and sixty-six (66) parking spaces off-site as shared parking; Code requires five hundred forty-eight(548)parking spaces,per Section 265-50 of the LDC; and WHEREAS,the Applicant is requesting to provide no on-street parking;Code requires on- street parking,per Section 309-10 of the LDC; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing"Whereas"clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That variance Applications(VA-103-14 and VA-28-15)are approved and are consistent with the site plan provided with the following conditions: 1. The Applicant must provide a copy of the Off-site Parking Agreement recorded in the Broward County Public Records,prior to the issuance of a building permit. Section 3. Issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5.
