HomeMy WebLinkAboutR-2015-039 - Approved design variations OT-26-15 & site plan SP-102-14 on behalf of American Maritime Officers Building of Dania Beach, LLC for property located at 2 Dixie Highway RESOLUTION NO. 2015-039 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE SITE PLAN(SP-102-14)AND DESIGN VARIATIONS (OT-26-15) SUBMITTED BY HOPE W. CALHOUN, ESQUIRE, ON BEHALF OF AMERICAN MARITIME OFFICERS BUILDING OF DANIA BEACH, LLC, FOR PROPERTY LOCATED AT 2 DIXIE HIGHWAY IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Chapter 28,Part 6 of the Dania Beach Land Development Code(the"LDC"), Article 635, entitled "Development Review Procedures and Requirements", states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS,Hope W.Calhoun,Esquire,on behalf of American Maritime Officers Building of Dania Beach, LLC, is requesting site plan approval to allow the construction of a new 28,000 square foot building to be located at 2 Dixie Highway in the City of Dania Beach; and WHEREAS,Chapter 28,Part 3 of the Dania Beach LDC,Article 301,entitled"Legal and Administrative Provisions", Section 301-50 states that the City may waive design-based requirements as part of a site plan application; and WHEREAS,the Applicant has requested to provide no street furniture plantings or street scape elements as required by the LDC,per Section 307-20; and WHEREAS,the Applicant has requested to provide an eight(8)to twenty-seven(27)foot front setback;Code requires a zero(0)to twelve(12)foot building placement,per Section 303-80(k) of the LDC; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; NOW, THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the Site Plan(SP-12-14)and design variations(OT-26-15)application are approved consistent with the site plan provided on record with the following conditions: 1. RIGHTS-OF-WAY: Identify if r-o-w dedication is required. Federal Highway ROW width is identified on the Broward County Traffic-way Map showing an ultimate width of 92'. Show current width of ROW to centerline to determine if dedication is required (Community Development). 2. Per Section 265-80(all references to Sections are to those in the LDC),off-site parking is proposed as identified in narrative prepared by Chen Moore. Therefore, provide the following information: A. (A)(2) landscape/survey showing perimeter landscaping is provided. Show landscaping of off-site parking location (Church property). 2nd time requested. B. (C) Provide written agreement approved by the City Attorney, which must include the following: 1. (1) Proof of cross access, ingress and egress and reservation for off- street parking use for the duration of the agreement. 2. (2)Permissible hours of operation. 3. (3) Enforcement. 4. (4) Document must be recorded in Broward County Public Record prior to issuance of a building permit(Community Development). 3. RAC Traffic Impact Fee of$212.60 will be required at time of permitting(Community Development). 4. Per Section 275-100(D)terminal landscape peninsulas shall be ten feet wide and as long as the required length of the parking stall in that aisle, exclusive of curb dimensions. Each peninsula shall have a minimum of two category 1 trees. Please adjust the size of the peninsulas, and the number of species of trees provided as needed (Landscape Consultant). 5. Math error noted on C4.02 tabulation; average sewage flow is erroneous (Public Services). 6. Notes on all sheets with"Datum Information"should be corrected to reflect the official conversion factor for Broward County, for reference check the following link: http://www.broward.or ertnittingAndLicensin icensing/En ing eering/FloodZoneMap s/Pa.„es/Requirements.aspx(Public Services). 2 RESOLUTION#2015-039 7. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD83). This should be addressed as part of the final submittal (Public Services). Section 2. That such application must be reviewed by Broward County Aviation Department. The point of contact is William Castillo,Airport Planner located at 220 S.W.45 Street, Suite 101, Dania Beach, Florida, 33312, (954) 359-6100. Section 3. Expiration of Site Plan. Pursuant to Section 635.100 "Expiration of Site Plans"of the Land Development Code,the Site Plan(SP-102-14)and design variations(OT-26-15), approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen(18)months from the date of this Resolution. Section 4. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 5. Conflicts. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. Effective Date. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on April 28, 2015.
