DANIA BEACH CITY COMMISSION
TUESDAY, APRIL 28, 2015 - 7:00 P.M.
1. Call to Order/Roll Call
Mayor Salvino called the meeting to order at 7:00 p.m.

2. Invocation and Pledgee of Alleiziance
Vice-Mayor Grace gave the invocation followed by the Pledge of Allegiance to the United States
Flag.
3. Presentations and Special Event Approvals
3.1 Recognition of Dania Beach Schools Teacher of the Year and Employee of the Year
Bettie Ellis, Vice-Chair, Dania Beach Education Advisory Board, Crady Baker, Education
Advisory Board, Principal Lincoln Pasteur, Collins Elementary School, Principal Lewis Jackson,
Dania Beach Elementary School, and Principal Valerie Harris, Olsen Middle School, recognized
the Teacher of the Year, and Employee of the Year, from Olsen Middle School, Dania Beach
Elementary, and Collins Elementary.
3.2 Special Event request from the American Cancer Society to have their annual "Relay
for Life" event at Frost Park on May 9, 2015 from 4:00 p.m. — 10:00 p.m. The
applicant is requesting the use of Frost Park Recreation Facility, chairs, tables, tents,
assistance from Public Services for field preparation and use of Public Services
80KW generator. The applicant is also requesting a special event fee waiver of
$150.00.
Vice-Mayor Grace motioned to approve the Special Event request for the American
Cancer Society Relay for Life; seconded by Commissioner Jones. The motion carried
unanimously.
4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
Linda Wilson & Carole Morris, Friends of the Dania Beach Library, thanked the Commission,
City staff, BSO, sponsors, and residents for participating in the Walk for the Library. She
suggested the City host a consolidated calendar for all events in the City, so there would be no
conflicts for events.
Christine Douglas, 4665 SW 38d' Terrace, complimented BSO for their support in her
neighborhood.
Veronica Larkins, 211 NW 12d` Avenue, spoke in favor of the City continuing with the BSO
Police agreement.
Joe Van Eron, 1500 SW 2nd Avenue, Chair of the Charter Review Board, encouraged the
residents to attend the Charter Review Board meetings, and provide their opinions and input.
Fred Elson, 2295 SW 45d' Street, spoke of speeding on SW 45t" Street and asked the
Commission to consider installing signs along the street.
Pat Wright, 4391 SW 34d` Lane, addressed the agreement between Anne Castro and the City for
airport related matters. She felt that Ms. Castro should not represent other cities if she works for
Dania Beach because their interests would conflict with our needs.
Charles Camacho, 121 NE 3`d Street, spoke of the Dania Beach Relay for Life event to be held
on May 9, 2015.
Teddy Bohanan, 312 SW 15d` Street, noted there has been an improvement of police presence in
her neighborhood.
Carolyn Jones, 722 SW 3`d Street, thanked CRA Director Jeremy Earle for his contributions to
the City of Dania Beach.
Mark LaRocca, 4511 SW 34d' Avenue, said he would like to see Anne Castro be the liaison with
the airport to help the residents of Dania Beach.
6. Public Safety Reports

Dania Beach City Commission
Tuesday,April 28,2015—7:00 p.m.
Captain Kevin Granville, BSO Chief of Police, reported on the Beach Blitz which took place on
Sunday, and noted it will continue for the remainder of the month. He also reported on criminal
activity in the City.
Commissioner Duke mentioned that BSO eliminated a marine patrol unit and he suggested that
the City Manager get with BSO to put together a budget to fund the position, and bring it to the
Commission for discussion during the budget process.
Commissioner Jones spoke of the vacant lot off of NW 51' Avenue and noted he wanted to be on
record that he has some ideas of what needs to be done to prevent loitering and other problems.
Lieutenant DeMarco, BSO, reported that an informational meeting will be held in the
Commission Chamber on Thursday, May 21, 2015 at 6:00 p.m. to discuss "flakka", the new and
dangerous synthetic street drug.

Vice-Mayor Grace motioned to adopt the Consent Agenda,with the exception of Items #7.4
and#7.5; seconded by Commissioner Jones. The motion carried unanimously.
7.4 RESOLUTION#2015-042
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING THE PROPER CITY OFFICIALS TO ENTER INTO AND EXECUTE A CONSULTING
SERVICES AGREEMENT WITH ANNE CASTRO STRATEGIES, P.A., PERTAINING TO MATTERS
ASSOCIATED WITH THE FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT, IN AN
AMOUNT NOT TO EXCEED TWENTY THOUSAND DOLLARS ($20,000.00); PROVIDING FOR
CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2015-042.
Vice-Mayor Grace questioned if Neal McAliley was still our airport counsel, and if he is, why
we should contract with someone else.
Attorney Ansbro responded that Attorney McAliley only works on legal matters; Anne Castro
would deal with the FAA in Orlando, Atlanta, and Washington, D.C., BCAD and the County
Commission relative to the noise problems, conveyance and release issues, and other
implementation types of things.
Mayor Salvino explained that funding for legal matters is appropriated but may not necessarily
be spent and it pertains to the asbestos problem at Trails End, not to the noise mitigation and
sound insulation program issues. He noted Ms. Castro has been at the forefront fighting for the
residents of Dania Beach; without contracting with her to do this work, we have nobody who has
the contacts she has and would put in the effort and hours that she has put in.
Vice-Mayor Grace questioned if Hollywood or Davie would pay some of the costs for Ms.
Castro.
Mayor Salvino responded Hollywood is not participating, but Davie is entering into an
agreement and will pay a lesser amount because the biggest problems are in Dania Beach. He
described the extent to which Ms. Castro would work for the City and the residents.
City Attorney Ansbro explained the Part 150 Study that will be done at the request of the
County, and noted no one in the City is in a rush for the study nor are they trying to deprive
anyone of eligibility and benefits.
Commissioner Duke noted he does not support this agreement as proposed, but acknowledged
the airport matter has been an epic failure by federal and county government to follow through
on promised benefits. He said Ms. Castro is the obvious choice for us, but we should consider
having her work with a powerful lobbyist, such as Ron Book. He noted he would be willing to
spend money to hire a super lobbyist to work with Ms. Castro, who he prefers to pay on an
hourly basis, not yearly. If this is the route we want to take, we should consider an RFP in order
to be transparent. Additionally,he does not care what Hollywood and Davie do.

Commissioner Brandimarte echoed the comments of Commissioner Duke, and noted she wants
the lobbyist to work closely with Ms. Castro.
Anne Castro, 838 NW 10t` Avenue, noted the Commission needs to think about their strategy;
there are ways to do this to try to get everybody what they want. She said City staff is doing the
best they can under the time constraints they have, and suggested we need to look at our process
as there is no communication. She also noted the FAA is shocked that the sound insulation and
conveyance in the CAR program have not been done. Lastly, the other cities are willing to work
with us now, and to let us take the lead.
Commissioner Jones asked Ms. Castro her thoughts on a lobbyist.
Ms. Castro responded a lobbyist would be a big help; also, it is imperative to have an alliance
with the other cities to build a coalition and communicate it very effectively. She noted the City
also needs to build a communications system because the residents are lost when dealing with
program eligibility requirements. Lastly, she said the Commission would not want her to bill by
the hour because it would be expensive.
Commissioner Jones spoke in support of Ms. Castro and of hiring a lobbyist. He also addressed
going out for RFP.
Ms. Castro recommended that if the Commission chooses to do an RFP, they need to expedite
the process because benefits are being lost every day.
Mayor Salvino said he thinks a lobbyist is a good idea.
City Attorney Ansbro advised an RFP is not necessary for hiring a lobbyist.
A brief discussion ensued and Commissioner Duke clarified he simply wanted to obtain quotes
from a couple of lobbyists.
Commissioner Brandimarte suggested language be added to the contract to provide for Ms.
Castro's input in choosing a lobbyist.
City Attorney Ansbro clarified that Ms. Castro worked hard with City staff and Neal McAliley to
negotiate the settlement agreement to get the very best that we could. He recommended adding a
clause to Ms. Castro's contract that she will assist City staff to find the best lobbyist, and the
choices and costs would be brought to the Commission for them to select one.
Commissioner Jones motioned to adopt Resolution #2015-042, with modification to the
contract as recommended by City Attorney Ansbro; seconded by Commissioner
Brandimarte. The motion carried on the following 5-0 Roll Call vote:

THAT A PORTION OF NW 5" AVENUE SHALL BE CO-DESIGNATED AS REV. W.C. EDCAR AVENUE,
SUCH PORTION BEING LOCATED NORTH OF SW 0 STREET AND SOUTH OF OLD GRIFFIN ROAD IN

Commissioner Jones said he wanted to discuss the process and timeline for getting this done.
Colin Donnelly, Assistant City Manager, explained the co-designation process, noting the
Commission approved the application in January and a public hearing will be held on second
reading of the ordinance on May 12. The co-designation will become effective once the
ordinance is adopted, and Public Services will order and install the new signs, which costs are to
be paid by the applicant.

Corinne Lajoie, Principal City Planner, provided an overview of the proposed text amendments.
Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition,he closed the Public Hearing.
Commissioner Duke motioned to adopt Ordinance #2015-009, on second reading; seconded
by Vice-Mayor Grace. The motion carried on the following 5-0 Roll Call vote:

City Attorney Ansbro read the title of Ordinance #2015-010, Resolution #2015-035, and
Resolution#2015-036, as they all relate to the same property.
Corinne Lajoie, Principal City Planner, provided an overview of the rezoning, variances and site
plan requests.
Vice-Mayor Grace questioned if the applicant spoke to the resident about speed humps.
Ms. Lajoie responded she is unsure, but staff has had discussions with the developer, and they
have been thinking of ideas and ways to work with the residents.
Dick Coker, representing the applicant, said Mr. Halliday spoke with the resident after the last
meeting and this has been discussed with their traffic engineer.
John Halliday, applicant, commented he spoke with the resident; however, he did not speak with
the adjacent commercial property owner on the east side. He noted that he and the developer of
Dania Bay have agreed that they would like to move forward with an evaluation of what needs to
be done on SW 45u` Street.
Mr. Coker addressed the reason for the variances.
Mayor Salvino opened the Public Hearings.
Fred Elson, 2295 SW 45 h Street, noted he spoke with Mr. Halliday today to address his concerns
with the traffic on SW 45"' Street, and asked him to install the sidewalk in the early phase of the
construction.
Commissioner Duke spoke in favor of the development.

Dania Beach City Commission
Tuesday,April 28,2015—7:00 p.m.
Corinne Lajoie, Principal City Planner,provided an overview of the rezoning and plat requests.
Cathy Donn, Craven Thompson and Associates, was available to answer questions.
Commissioner Duke questioned if the proposal is consistent with the West Side Master Plan and
Ms. Lajoie responded in the affirmative.
Mayor Salvino opened the Public Hearings.
Bill Berg, 4885 SW 26t' Avenue, questioned how he could protect himself from noise from the
shopping center and from the dumpster being right next to his property.
Ms. Lajoie noted the site plan will come before the Commission on May 12t', for which public
notification will be mailed, and invited Mr. Berg to contact her to review the plans.
Sue Delegal, representing the applicant, noted they will contact Mr. Berg to answer any
questions.
Seeing as there was no one else to speak in favor or opposition, Mayor Salvino closed the Public
Hearings.

City Attorney Ansbro read the title of Resolution#2015-040.
Corinne Lajoie, Principal City Planner, provided an overview of the proposed site plan.
Vice-Mayor Grace commented the property seems to be a tight squeeze, and questioned if staff
spoke to surrounding business owners.
Ms. Lajoie responded the usual notices were sent to surrounding property owners and that until
today, no one had contacted staff.
Jose Gordele, Architect, addressed the architecture, setback, and landscaping of the hotel, and
noted they intend to proceed quickly with the project upon approval.
Mayor Salvino opened the Public Hearing.
Rob Granado and Ken Smith, 148 N. Federal Highway, representing Jimmie's Chocolates and
Cafe, stated this hotel does not fit in the downtown area plan. They voiced concern with what
will happen to their business at their present location during and after construction of this project.
Charles Camacho, 121 NE P Street, expressed his concerns for the NE section.
Seeing as there was no one else to speak in favor or opposition, Mayor Salvino closed the Public
Hearing.
Mayor Salvino noted he has received several calls on this development; a few were opposed, but
the majority was in favor. He added it is difficult to turn away a development that meets all the
code requirements, and if we are too restrictive on small lots,there will be no development along
US-1.
Commissioner Jones commented we will have this problem with all the properties along Federal
Highway because they are all small lots. He felt additional discussion was needed to address
concerns raised at tonight's meeting.
Commissioner Jones motioned to defer Resolution #2015-040 until May 26, 2015 at 7:00 p.m.,
to allow time for further discussions. Motion died for lack of a second.
Commissioner Brandimarte motioned to adopt Resolution #2015-040; seconded by Mayor
Salvino. The motion carried on the following 4-1 Roll Call vote:

Commissioner Jones said he would like for us to create a calendar with a marine theme, using
elementary kids to do pictures for it, for distribution to the community.

City Manager Baldwin noted the Hurricane Preparathon will be held on June 2 from 4:30 p.m. —
6:30 p.m. at City Hall.
City Manager Baldwin advised that we are connecting sidewalks on Bryan Road, which should
be completed in about 30 days, and FPL will install street lights within the next 6-7 months.
13.2 City Attorney
City Attorney Ansbro noted he and the City Manager met with Magic City Casino and they are
committed to opening by December 15, 2015. He added they are also committed to helping with
the Seafood Festival.

persons who address the City Commission in those minutes,the City requests that this form be completed
and provided to the City Clerk,before the meeting begins. `
