HomeMy WebLinkAboutR-2015-053 - Adopted Public Services & Engineering Related Fees, Pursuant to Section 22-14, Permit Fees of Chapter 22, Streets & Sidewalks of the City Code of Ordinances RESOLUTION NO. 2015-053 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, ADOPTING PUBLIC SERVICES AND ENGINEERING RELATED FEES, PURSUANT TO SECTION 22-14, "PERMIT FEES" OF CHAPTER 22, "STREETS AND SIDEWALKS" OF THE CITY CODE OF ORDINANCES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach, Florida, is authorized by state law to enact user fees commensurate with the cost to the City of providing services, in such amounts as are necessary for the conduct of municipal government and affairs; and WHEREAS, the City's Public Services Department provides plan review, permitting, inspection services, interdepartmental coordination and advisory services to citizens and contractors in accordance with Chapter 22 of the City of Dania Beach Code of Ordinances; and WHEREAS, the City of Dania Beach Code of Ordinances, pursuant to Section 22-14, "Permit Fees" of Chapter 22, "Streets and Sidewalks", establishes a permit application fee of fifty dollars ($50.00); and WHEREAS, right-of-way improvements typically constructed under a right-of-way use permit include, but are not limited to, driveway aprons, public sidewalks, curbs and gutters, drainage and swale improvements, water and wastewater facilities and other related roadway improvements; and WHEREAS,the cost of providing these services is a significant expense to the City; and WHEREAS, the cost of review and inspection services should be borne by the users benefiting from the services; and WHEREAS, the City wishes to update its fee schedules to keep pace with the costs of providing such services; and WHEREAS, right-of-way use and engineering permit fees are typically based upon the estimated value of the work of a Project, as supported by calculations to be furnished by the permit applicant; and, WHEREAS, a fee will be required for all applicants, except for Florida Power & Light (due to a franchise agreement provision) and communication companies (due to state law), or any contractor which has a franchise agreement with Florida Power& Light or a communication company, and City-owned and City-funded projects; and, WHEREAS,permit applicants will need to submit proof of insurance and a construction bond among other permit requirements as specified in Section 22-15 of the City Code of Ordinances; and, WHEREAS, the fees contained in this Resolution have been developed to properly reflect the cost for providing plan review, permitting, inspection services, interdepartmental coordination and advisory services to citizens and contractors; and WHEREAS, if any conflict arises between the Director of the Community Development Department and the Director of the Public Services Department pertaining to the fee schedule, then such conflict shall be resolved between the Directors of these Departments; and WHEREAS, the Director of Public Services believes that it is in the best interest of the citizens and residents of the City of Dania Beach to approve the recommended fee schedule; NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That a fee schedule is adopted as follows: a. Site work and Construction Permits (rights-of-way work including water and sewer work and road easements): based upon the cost of construction as verified and submitted by the construction documents of the permit applicant: b. Fee: Three and four tenths of a percent(3.4%)of the cost of construction. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 2 RESOLUTION#2015-053 Section 4.
