Call to Order Mayor Salvino called the meeting to order at 5:00 p.m. 2. Roll Call Present: Mayor: Marco A. Salvino, Sr. Vice-Mayor: Bobbie H. Grace Commissioners: Chickie Brandimarte City Manager: Robert Baldwin City Attorney: Thomas J. Ansbro City Clerk: Louise Stilson Code Attorney: Tim Ryan Absent: Commissioners: Walter B. Duke, III Albert C. Jones Vice-Mayor Grace motioned to excuse the absence of Commissioner Jones and Commissioner Duke; seconded by Commissioner Brandimarte. The motion passed unanimously. 3. Abatement Requests 3.1 Abatement Request from Myra Thea Davis, 29 NW 4 Avenue, Case #07-0008 and Case#11-1429 (Folio #0234-01-2120) Attorney Ryan noted the first case involved 15 violations. The fine ran for 2,421 days for a total of $484,426.00, including recording/admin fees of $226.00. The property was purchased by Live Cheap LLC at a Tax Deed Sale. The Special Magistrate recommended an abatement of $1,000.00. Attorney Ryan noted the second case involved 1 violation. The fine ran for 1,077 days for a total of $107,929.00, including recording/admin fees of $229.00. The Special Magistrate recommended an abatement of$1,000.00. Myra Davis was present to answer questions. Vice-Mayor Grace motioned to abate the lien to $2,000.00, as recommended by the Special Magistrate, to be paid in 90 days; seconded by Commissioner Brandimarte. The motion carried unanimously. 3.2 Abatement Request from DDRM Sheridan Square LLC, 401 E. Sheridan Street, Case #11-1427 (Folio#1203-60-0010) Attorney Ryan noted this case involved 1 violation. The fine ran for 244 days for a total of $36,854.00, including recording/admin fees of$254.00. The Special Magistrate recommended an abatement of$3,685.00. Trevor Joseph, property manager, noted the sign was placed by a tenant without a permit. He commented they will be investing a lot of money on the property when WalMart moves in. Vice-Mayor Grace motioned to abate the lien to $3,685.00, as recommended by the Special Magistrate, to be paid in 60 days; seconded by Commissioner Brandimarte. The motion carried unanimously. 3.3 Abatement Request from BGDJ Capital LLC (formerly Elaine Law property), 250 SW 7 Street, Case #12-0133 (Folio #1203-06-0660) Attorney Ryan noted this case involved 9 violations. The fine ran for 790 days for a total of $158,216.00, including recording/admin fees of$216.00. The Special Magistrate recommended an abatement of$15,800.00. Denzel Jaglyle and Brian Giftin, 250 SW 7t' Street, noted they got the property at auction, and that they have put $90,000.00 in repairs, and still have more repairs to make. They recommended the Commission abate the lien to $2,000.00. Vice-Mayor Grace motioned to abate the lien to $7,500.00, to be paid in 60 days; seconded by Commissioner Brandimarte. The motion carried 2-1,with Mayor Salvino voting no. 3.4 Abatement Request from Arnaud Gavet and Alice Gavet, 4440 SW 34 Drive, Case #2013-1052 (Folio#0230-08-0260) Attorney Ryan noted this case involved 7 violations. The fine ran for 394 days for a total of $69,204.00, including recording/admin fees of$254.00. The Special Magistrate recommended an abatement of$6,920.40. Arnaud Gavet provided a history of the property and what happened to it. Vice-Mayor Grace motioned to abate the lien to $1,200.00, to be paid in 30 days; seconded by Commissioner Brandimarte. The motion carried unanimously. Minutes of Abatement Hearing 2 Dania Beach City Commission Wednesday,June 3,2015—5:00 p.m. 3.5 Abatement Request from HLNP Holding Inc., 4670 SW 25 Avenue, Case #2013- 1822 (Folio #0229-05-0670) Attorney Ryan noted this case involved 6 violations. The fine ran for 247 days for a total of $24,954.00, including recording/admin fees of$254.00. The Special Magistrate recommended an abatement of$2,495.00. Ms. Garcia, Attorney for HLNP Holding, noted the tenant is responsible for the payment of the lien and requested a reduction of the lien. Romero Garcia, tenant who has been leasing the property for 2 years and is in the process of purchasing the property,provided the history of what happened to the property. Vice-Mayor Grace motioned to abate the lien to $700.00,to be paid in 30 days; seconded by Mayor Salvino. The motion carried unanimously. 3.6 Abatement Request from Kalros Holding Corp., 708 SW 8 Street, Case #2014-0257 (Folio #1203-34-0510) Attorney Ryan noted this case involved 6 violations. The fine ran for 253 days for a total of $38,204.00, including recording/admin fees of$254.00. The Special Magistrate recommended an abatement of$3,820.00. Mayor Salvino motioned to abate the lien to $3,820.00, as recommended by the Special Magistrate, to be paid in 30 days; seconded by Vice-Mayor Grace. The motion carried unanimously. 3.7 Request from Live Cheap LLC (a/k/a Lehman Properties) for Commission to consider revising motion from March 4, 2015 Abatement Hearing. Original motion was for abated lien amount of$7,100.00 to be paid within 30 days. Live Cheap LLC is requesting payments of$1,183.33 per month for six months. Joseph, President of Live Cheap, LLC, was present at the meeting. Mayor Salvino motioned to approve the payment plan of $1,183.33 per month for six months, or it reverts back to the original amount, with payments due on the first of the month; seconded by Vice-Mayor Grace. The motion carried unanimously. 3.8 Request from 800 Marine Technical Center Inc. for an 18-month extension to the Agreement dated June 24, 2014 between 800 Marine Technical Center Inc. and the City of Dania Beach. This Agreement originated from Abatement Hearing of October 10, 2013. Vice-Mayor Grace motioned to approve the 18 month extension; seconded by Mayor Salvino. The motion carried unanimously. Minutes of Abatement Hearing 3 Dania Beach City Commission Wednesday,June 3,2015—5:00 p.m. 3.9 Approval of the Settlement received for: Natalya S. Esaulenko (formerly Marcus & Eunice Santoni property), 25 SW 12 Street, Case #09-1189 for $1,500.00 due to sale of property Vice-Mayor Grace motioned to approve the settlement agreement; seconded by Commissioner Brandimarte. The motion carried unanimously. 3.10 Approval of the Settlement request for: William Diaz, 911 NW 7 Street, Case #10- 1769 and Case#11-1104 for$7,500.00 due to short sale Vice-Mayor Grace motioned to approve the settlement agreement; seconded by Mayor Salvino. The motion carried unanimously. 3.11 Approval of the Settlement received for: Sandra Cuomo Est, 2210 SW 46 Court, Case #11-0362 and Case#2013-1053 for$3,000.00 due to sale of property Commissioner Brandimarte motioned to approve the settlement agreement; seconded by Vice-Mayor Grace. The motion carried unanimously. 3.12 Approval of Settlement received for: Salome Murphy, 2764 SW 47 Street, Case #2014-0595 for$1,706.22 due to short sale Vice-Mayor Grace motioned to approve the settlement agreement; seconded by Commissioner Brandimarte. The motion carried unanimously. 3.13 Approval of Surplus Proceeds from Tax Deed Sale: Cookies & Crackers, Case #11- 1606 and Case#2012-1075 in the amount of$30,879.92 Vice-Mayor Grace motioned to approve the settlement; seconded by Commissioner Brandimarte. The motion carried unanimously. 3.14 Approval of Surplus Proceeds from Tax Deed Sale: Sylvia Mack Est, Case #09-1538 in the amount of$25,695.89 Vice-Mayor Grace motioned to approve the settlement; seconded by Commissioner Brandimarte. The motion carried unanimously. Minutes of Abatement Hearing 4 Dania Beach City Commission Wednesday,June 3,2015—5:00 p.m. 4.
