Call to Order/Roll Call Mayor Salvino called the meeting to order at 7:00 p.m. Present: Mayor: Marco A. Salvino, Sr. Vice-Mayor: Bobbie H. Grace Commissioners: Chickie Brandimarte Walter B. Duke, III Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Commissioner Jones gave the invocation followed by the Pledge of Allegiance to the United States Flag. 4. Proclamations 4.1 Pastor Joseph Maurice Louissaint—Vice-Mayor Grace Vice-Mayor Grace presented the proclamation to Pastor Israel of the South Florida First Haitian Evangelical Baptist Church of Dania. 3. Presentations and Special Event Approvals 3.1 Representative Evan Jenne—Legislative Update Representative Evan Jenne provided an overview of the 2015 Legislative Session. He advised there will be two more special sessions to redraw the Congressional and State Senate boundaries. 3.2 Request from Mr. Jackie Ford to waive rental fees in the amount of$540.00, plus a $500.00 security/damage deposit, for the use of I. T. Parker Community Center on August 2, 2015. The requested event fee waiver is for a "1001h Birthday Celebration" for Evelyn Dixon Williams. Please be advised that the Parks, Recreation and Community Affairs Advisory Board is on summer break and was not presented with this request. Vice-Mayor Grace said she kept this on the agenda even though the event will not be held on August 2nd. She would like the Commission to approve this because her two children have done great things for the City, and the event will be held on another date. Vice-Mayor Grace motioned to waive the $540.00 I.T. Parker rental fees, and the $500.00 security/damage deposit, for the 100th Birthday Celebration for Evelyn Dixon Williams, to be held at a later date; seconded by Commissioner Duke. The motion carried unanimously. 5. Citizen Comments Zachary McKinney, 4137 SW 48th Court, noted he is the scholarship recipient of the Martin Luther King Scholarship for the second year in a row, and thanked the Commission for their support. Carolyn Jones, 722 SW 3`d Street, Director of the MLK Committee, noted that Zachary will have a concert in the atrium at a future date. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, noted Deputy O'Keefe passed away in early July. He provided to the Commission a placard that reads "This car is LOCKED" and noted placards will be distributed to the residents at community meetings and events. Captain Granville reported on recent criminal activity in the City; he encouraged citizens to lock their car doors and not leave anything in sight. He presented a commendation to two gentlemen for intervening and assisting a young girl who was attacked. He added National Night Out on Crime will be August 4th at PJ Meli Park. 7. SHAINA MILLER FOR THE SPECIFIC USE AT THE FROST PARK SKATE PARK; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Vice-Mayor Grace motioned to adopt the Consent Agenda,with the exception of Item #7.2; seconded by Commissioner Jones. The motion carried unanimously. 7.2 Travel Requests: Request of Commissioner Chickie Brandimarte to attend the 2015 FLC 89th Annual Conference in Orlando, Florida on August 12-16, 2015 (Estimated cost$1,673.78) Request of Commissioner Albert C. Jones to attend the 2015 FLC 89th Annual Conference in Orlando, Florida on August 12-16, 2015 (Estimated cost$1,665.38) Request of Vice-Mayor Bobbie H. Grace to attend the 2015 FLC 89th Annual Conference in Orlando, Florida on August 12-16, 2015 (Estimated cost $1,681.40) Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,July 28,2015—7:00 p.m. Mayor Salvino requested that he also be included in the travel requests, and noted he will make his own arrangements. Commissioner Grace motioned to approve the four Travel Requests; seconded by Commissioner Duke. The motion carried unanimously. 8. Bids and Requests for Proposals 8.1 RESOLUTION#2015-073 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO AWARD A BID TO CLOSE CONSTRUCTION, LLC, FOR LIME SOFTENING PLANT - CHLORINE SYSTEM UPGRADES IN AN AMOUNT NOT TO EXCEED TWO HUNDRED SIXTY SIX THOUSAND FOUR HUNDRED NINETY THREE DOLLARS ($266,493.00); PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2015-073. Commissioner Jones motioned to adopt Resolution #2015-073; seconded by Commissioner Brandimarte. The motion carried unanimously. 9. Public Hearings and Site Plans City Attorney Ansbro advised the remaining items were quasi-judicial hearings and swore-in those who would speak. (FIRST READING) City Attorney Ansbro read the title of Ordinance #2015-017, and noted first reading would be continued to the August 25, 2015 City Commission meeting to allow the developer and the neighborhood to meet and discuss the project. Mayor Salvino opened the Public Hearing. Bruce Hannover, 617 NE 2nd Place, noted the neighbors in the area attended a meeting with the developers, and their concern is NE 4d' Court, which has not been developed, and traffic accessing NE 5d`Avenue during and after development of the marina. They are suggesting that the Commission not vacate the right-of-way of NE 4 h Court on the west side of the Church property, and insist that the developer construct NE 4d, Court to handle the marina traffic. Seeing as there was no one else to speak in favor or opposition, Mayor Salvino closed the Public Hearing. Vice-Mayor Grace motioned to continue Ordinance #2015-017, on first reading, until the August 25, 2015 City Commission meeting at 7:00 p.m.; seconded by Commissioner Jones. The motion carried unanimously. 9.3 RESOLUTION#2015-022 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING VARIANCE REQUESTS (VA-58-14 and VA-33-15) SUBMITTED BY CLMIA, LLC, FOR PROPERTY LOCATED AT 4470 RAVENSWOOD ROAD IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Grace Yes Commissioner Duke Yes Mayor Salvino Yes Commissioner Jones Yes 9.8 RESOLUTION#2015-077 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, CONSIDERING A SIGN VARIANCE (VA-021-15) SUBMITTED BY TRIPP SCOTT, PA, ON BEHALF OF THE PROPERTY OWNER PARK 'N GO OF FORT LAUDERDALE LLC, FOR PROPERTY LOCATED AT 1101 ELLER DRIVE IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT A;PROVIDING FOR CONFLICTS;AND FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2015-077. All members of the Commission noted they spoke to the petitioner. Corinne Lajoie, Principal City Planner, reviewed the variance request and noted that staff recommends denial of this request. Commissioner Brandimarte commented on the presentation and noted this is, in essence, a pole sign, which is prohibited; the business is successful and is not being hurt; and setting a precedent would be the worst of all. Mayor Salvino felt this area is designed for storage; although the proposed sign is quite large, we cannot judge how good a business may be doing. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,July 28,2015—7:00 p.m. Vice-Mayor Grace questioned the difference between this sign and the one for Spring Hill Suites. Principal City Planner Lajoie explained the hotel sign is a landmark for tourists who are not familiar with the City; customers of Park `N Go are local and familiar with the area. Matthew Scott, representing the applicant, gave a presentation and made numerous points countering those in the presentation given by Principal City Planner Lajoie. He noted staff s analysis of how well the business was doing was done before the overpass was built, and nearby competitors have huge signs. Commissioner Jones questioned the length of ownership of the business. The Park `N Go property owner responded they began as a tenant in 2008 and have owned the property since 2010. Commissioner Duke commented we talk about being business friendly and this is a Dania Beach business that pays taxes. He added, for the applicant to go through the time and expense to get a sign,they probably need a sign; no one has complained or called him about it. Commissioner Duke motioned to adopt Resolution #2015-077; seconded by Vice-Mayor Grace. Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Discussion and Possible Action 10.1 Sports Programs at Frost Park—Mayor Salvino Mayor Salvino advised of the Optimist Club sports clinics that are being held at Frost Park. He said information is available on the City website, and they are looking for coaches, sponsorships and volunteers. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte asked the Commission to adopt a resolution to oppose oil drilling in the Everglades,to be drafted for the next agenda. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,July 28,2015—7:00 p.m. Commissioner Brandimarte spoke in support of Uber drivers in Broward County. She questioned if we could override the Broward County Commission decision to discontinue service. City Attorney Ansbro advised we should wait another six weeks to see what the Broward County Commission does; they are going to reconsider the matter. 11.2 Commissioner Duke Commissioner Duke spoke of, and expressed his happiness with, the Mayor working on recreational activities in the City. 11.3 Commissioner Jones Commissioner Jones said he would also like Flag Football to be included in the sports program. Commissioner Jones spoke of community events, summer programs, the South Broward Hospital District lowering its taxes, Florida League of Cities committee issues (public/private partnerships and transportation right-of-way impact fees), and recent deaths in the community. 11.4 Vice-Mayor Grace Vice-Mayor Grace commented she wants to bring baseball back to Dania Beach. Vice-Mayor Grace spoke of community and church events. 11.5 Mayor Salvino Mayor Salvino further addressed the sports programs and noted they will be difficult to start. Mayor Salvino spoke of My Brother's Keeper, and noted Dania Beach is the only city that is participating. 12. Appointments There were no appointments at this meeting. 13. Administrative Reports 13.1 City Manager City Manager Baldwin introduced Dr. Frank Schnidman, who will be evaluating the Oasis projects. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,July 28,2015—7:00 p.m. City Manager Baldwin noted the City Auction was successful and brought in$86,027.00. City Manager Baldwin advised that the Bryan Road sidewalks were completed today and the street lighting should be completed by the end of August. City Manager Baldwin noted once the County goes over a punch list for Taylor Lane, we will go into redesign, which will take about three months, followed by construction. City Manager Baldwin announced that tonight is Public Services Director Orlando's last meeting, as he is retiring in early August, and said he will be missed. 13.2 City Attorney City Attorney Ansbro thanked Public Services Director Orlando for his service to the City. 13.3 City Clerk -Reminders Wednesday, August 5, 2015 —5:00 p.m. Executive Session(Labor Negotiation) Wednesday, August 5, 2015 —6:00 p.m. CRA Board Meeting Tuesday, August 25, 2015— 7:00 p.m. City Commission Meeting 14.
