HomeMy WebLinkAboutO-2015-016 Alexandra Daiagi Plat (PL-37-15) ORDINANCE NO. 2015-016 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST MADE BY LEIGH ROBINSON KERR& ASSOCIATES, INC., ON BEHALF OF THE PROPERTY OWNERS, DS REALTY, INC., TO CREATE A PLAT (PL-37-15) TO BE KNOWN AS THE "ALEXANDRA DAIAGI" PLAT, FOR PROPERTY LOCATED AT 2800 SOUTH FEDERAL HIGHWAY IN THE CITY OF DANIA BEACH; ACCEPTING THE DEDICATION FOR PUBLIC USE OF ALL STREETS, HIGHWAYS, ALLEYS AND EASEMENTS AS SHOWN ON SUCH PLAT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the "Alexandra Daiagi" plat (PL-37-15), for property located at 2800 South Federal Highway in the City of Dania Beach, and legally described in Exhibit "A", a copy of which is made a part of and incorporated into this Ordinance by this reference, is accepted and approved. The City of Dania Beach consents and agrees that such plat may be recorded in the Public Records of Broward County, Florida, upon further approval of all agencies of Broward County, Florida,having jurisdiction in the matter. Section 2. That the dedication for public use of all streets, highways, alleys and easements as shown on the "Alexandra Daiagi" plat, is accepted and approved by the City of Dania Beach. Section 3. That the plat application was heard by the City Development Review committee and there are remaining outstanding comments that must be addressed prior to recordation of the plat: 1. Per Section 640-20 of the LDC, provide location of off-site water and sewer lines, proposed connection locations and routes that the lines will take. 2°d time requested. Section 4. That on July 15, 2015, the Planning and Zoning Board, acting as the Local Planning Agency, reviewed the application for the perimeter plat and forwarded a recommendation of approval to the City Commission. Section 5. That if any section, clause, sentence or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 6. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with the provisions of this Ordinance are repealed. Section 7. That this Ordinance shall take effect immediately at the time of its passage and adoption. PASSED on first reading on July 28, 2015. PASSED AND ADOPTED on second reading on August 25, 2015.
