MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, SEPTEMBER 8, 2015 - 7:00 P.M. 1. Call to Order/Roll Call Mayor Salvino called the meeting to order at 7:00 p.m. Present: Mayor: Marco A. Salvino, Sr. Vice-Mayor: Bobbie H. Grace Commissioners: Chickie Brandimarte Walter B. Duke, III Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Vice-Mayor Grace gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event request from Family in Distress to have a "Farm Share" event on September 19, 2015, from 9:00 a.m. to 1:00 p.m. at the Dania Beach Patch, 1200 N.W. 1st Street. The applicant is requesting a special event fee waiver in the amount of$150.00. Vice-Mayor Grace motioned to approve the Special Event request for the Family in Distress Farm Share, including the $150.00 fee waiver; seconded by Commissioner Jones. The motion carried unanimously. 3.2 Special Event request from Clive Taylor, Clare Frost,the City of Dania Beach and the Dania Lions Club for the "loth Annual Dania Beach Vintage Motorcycle Show", which will be held at Frost Park on Saturday, January 30, 2015, from 10:00 a.m. to 5:00 p.m. The applicant is requesting the following: a special event fee waiver in the amount of $150.00, BSO Fire detail fee waiver, traffic cones and barricades for motorcycle spectator parking, and Frost Park field to be prepped. Vice-Mayor Grace motioned to approve the Special Event request for the loth Annual Dania Beach Vintage Motorcycle Show, including the $150.00 fee waiver, and BSO Fire Detail Fee Waiver; seconded by Commissioner Jones. The motion carried unanimously. 3.3 Special Event request from the City of Dania Beach Parks and Recreation Department, the Dania Beach Chamber of Commerce, and Staged Right Events for the "Founders Day Celebration", to be held on September 12, 2015 from 10:00 a.m. to 4:00 p.m. in the City Hall Nautilus area. The applicants are requesting the following: a Special Event fee waiver in the amount of$150.00, Public Services Staff assistance, and road closures for SW 1st Avenue between Jean Cook Realty and Rexall Drugs. Vice-Mayor Grace motioned to approve the Special Event request for the Founders Day Celebration, including the $150.00 fee waiver and road closure; seconded by Commissioner Jones. The motion carried unanimously. 3.4 Special Event request from St. Maurice Church for their annual "Country Fair" to be held October 29, 2015 -November 1, 2015, located at 441 N.E. 2nd Street. Vice-Mayor Grace motioned to approve the Special Event request for the St. Maurice Church County Fair; seconded by Commissioner Jones. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Terry Hale-Hicks, 331 SW 2nd Avenue, on behalf of the Friends of the Library, noted they will have a table at the Founders Day event, including a raffle and book sale. She also thanked Lee's Locksmith Shop for the donation of 2 bicycles. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, spoke of burglary conveyances throughout the City. He also commented on the fatal shooting that occurred at Winn-Dixie on Monday. Frank Ross, BSO Fire Rescue,was available to answer questions. 7. Consent Agenda Items removed from Consent Agenda: #7.4 Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,September 8,2015—7:00 p.m. 7.1 Minutes: Approve Minutes of August 25, 2015 City Commission Meeting 7.2 Travel Requests: None Resolutions 7.3 RESOLUTION#2015-093 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,REQUESTING CONCEPTUAL APPROVAL FROM THE CITY COMMISSION OF THE CITY OF DANIA BEACH FOR BID ADVERTISEMENT FOR A COMMUNITY DEVELOPMENT BLOCK GRANT ("CDBG")PROJECT KNOWN AS "40TH YEAR OASIS X" WHERE BIDDING IS EXPECTED TO BE SOUGHT BY THE CITY ADMINISTRATION;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Vice-Mayor Grace motioned to adopt the Consent Agenda,with the exception of Item #7.4; seconded by Commissioner Jones. The motion carried unanimously. Ordinances (Titles read by City Attorney) 7.4 ORDINANCE#2015-023 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 18, "PENSIONS AND RETIREMENT", ARTICLE III, "EMPLOYEES' RETIREMENT PLAN AND TRUST" BY SPECIFICALLY AMENDING SECTION 18-1, "PARTICIPATION IN GROUP INSURANCE - RETIREES", TO MODIFY THE CONDITIONS FOR A RETIREE'S PARTICIPATION IN THE CITY GROUP INSURANCE PLAN; AMENDING SECTION 18-29.7, "OPTIONAL FORMS OF BENEFIT PAYMENTS", TO PHASE OUT THE DEFERRED RETIREMENT OPTION PLAN (DROP); PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) Commissioner Duke said he will not support this because 18 employees were hired based on a promise of certain benefits, and this is one of those benefits. This ordinance changes the rules, and we are not in a financial constraint right now; this is something we can afford. Vice- Mayor Grace stated she also will not support this ordinance; it is not a significant amount of money to take care of these employees. Commissioner Jones shared that this was done in collective bargaining and they agreed to it. It did not move forward at the time because there were only four members on the commission, and it was decided to wait until there was a full commission. He felt we should move forward with this now. Mayor Salvino questioned how the DROP program worked. His understanding is that once an employee goes into DROP, their retirement stops, but their pay increases a certain percentage and their pension is then based on their pay plus that percentage over the next five years. City Manager Baldwin said that is essentially how it works. Mayor Salvino noted he would not have Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,September 8,2015—7:00 p.m. a problem with the DROP program if we can stop the pension at the employee's original number before they go into DROP. City Manager Baldwin confirmed the collective bargaining unit agreed to phase out the DROP two years ago. Commissioner Duke added this is a great program and is comparable to what is out there in the rest of the governmental sector. He repeated this is a benefit that was promised to all of our employees, and does not add up to a lot of money. Commissioner Brandimarte said the employees worked for it, they earned it, and the Commission should not take it away. Vice-Mayor Grace agreed and noted major development is coming into the City worth billions of dollars which will increase the tax base tremendously. She does not see doing away with the DROP program. Jim Cherof, Special Labor Counsel for the City of Dania Beach, noted this ordinance completes something that was ratified by the Union and its employees. It is the Commission's prerogative to not adopt the ordinance. Commissioner Duke motioned to deny Ordinance #2015-023, on first reading; seconded by Vice-Mayor Grace. The motion carried 4-1,with Commissioner Jones voting no. After discussion regarding continuation of the DROP program, Commissioner Duke amended the motion to include only the employees who are currently in the program, and after that it is done. Discussion ensued about bringing a new ordinance to the Commission. Attorney Cherof suggested taking no action on the ordinance before the commission tonight. City Attorney Ansbro said the ordinance was withdrawn and there was no motion. 8. Bids and Requests for Proposals 8.1 RESOLUTION#2015-098 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, ESTABLISHING A RANKING OF RESIDENTIAL SOLID WASTE PROVIDERS AND AUTHORIZING THE PROPER CITY OFFICIALS TO NEGOTIATE AND EXECUTE AN ACCEPTABLE FINAL AGREEMENT FOR SERVICES WITH THE TOP RANKED PROVIDER FOR A PERIOD OF SEVEN(7)YEARS;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2015-098. Colin Donnelly, Assistant City Manager, presented a PowerPoint overview of the solid waste collection services bid process, evaluation and recommendation, which is attached to and Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday, September 8,2015—7:00 p.m. incorporated into these minutes. The Proposal Committee recommends the City select Waste Management as the most responsive and responsible bidder. City Manager Baldwin recommended that we only go with residential services since the figures for sole source commercial are not reliable enough to make a good decision. Commissioner Jones said he is not happy with the four responses. He thought sole sourcing would provide better rates, and felt we should re-bid and get competitive responses. City Manager Baldwin responded we may not get better responses if we re-bid, and the garbage rate needs to be decided by the First Budget Public Hearing. Commissioner Jones questioned if we could phase-in the alleyways in a year to allow the residents time to prepare for the change. He would like to go with the Primary Proposal and allow alleyway phase-in. Tony Spadacia, Waste Management, noted they did not come to debate or discuss alternatives; they responded to the City's bid request. He suggested staff s recommendation should go forward. Mayor Salvino stated staff has done their job; it is the Commission's job to make a decision. Michael Adams, Owner and Principal of World Waste Recycling, and Eileen Damaso, Vice President, noted they are the largest provider of residential services in Miami Dade County. He said they will save the residents millions of dollars and they have all of the recommendations. City Attorney Ansbro noted they are disqualified because they do not have two years of trash pickup experience. Commissioner Duke commended Waste Management for their community participation and performance. He spoke of the current contract and service, and noted the taxpayers are paying too much for waste services and the Reuters agreement. He added he will never support sole- source for commercial, and thinks the additional $35.00 per month for alleyways is reasonable. He questioned how we can ignore a company that says they can save our residents $11 million over seven years. He felt this has been pushed through and we only have one option, which is Waste Management. He suggested we set our rate at $420.00 and stick to it, but give the other bidders a chance. Vice-Mayor Grace commented the two qualified proposals were not that far apart in price, so she would make a recommendation to accept staff s recommendation for Waste Management. Vice-Mayor Grace motioned to adopt Resolution #2015-098, awarding the bid to Waste Management for the Primary Proposal; seconded by Commissioner Brandimarte. Commissioner Jones questioned the requirements for a marina during hurricanes and requested that staff look into it. Bonnie Miskel, representing the applicant, provided an overview of the requests. For the record, she corrected that the daily trips for the marina facility is 162, which is significantly less than the 239 trips if it were built as residential. She noted that, relating to the condition requiring a deed restriction, they are restricting their use to the RSA-8000 permitted uses and the marina. Mayor Salvino opened the Public Hearings. Dawn Huckestein, 3901 SW 58d' Street, expressed her concerns with the change in zoning, due to increased traffic and that their property value will decrease. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday, September 8,2015—7:00 p.m. Steve Goldberg, 4010 SW 54t' Court, whose house is adjacent to the property, spoke of the increased traffic on the street, and the loss of privacy on his property. He noted the traffic study has gaps in it, and the proper safety report has not been conducted. Seeing as there was no one else to speak in favor or opposition, Mayor Salvino closed the Public Hearings. Commissioner Jones asked if there were any variances being requested. Principal City Planner Lajoie said no,there is a waiver of the 5-foot setback of the home on the east property line due to right-of-way dedication. Commissioner Jones questioned how they will mitigate traffic. Commissioner Duke clarified they are increasing the density(doubling). Ari Sklar, Architect and Agent for the property, noted they have been working with staff for over two years on the design of this site, and there were no issues during the Planning & Zoning Board meeting. He said Mr. Goldberg approached him after the meeting, and he offered to provide additional landscaping and gave his contact information to him but never heard anything back. He clarified that the land use allows for 32 units; they are doing 24 townhouses and one single family residence. He added the traffic study was done for 40a'Avenue and not 54t`Court. Mayor Salvino suggested they help install speed bumps on 54t' Court. Mr. Goldberg noted speed bumps are not the answer. Mayor Salvino recommended they have a meeting to discuss the issues. Principal City Planner Lajoie suggested that additional landscaping on the north side of the property be included in the conditions for approval. Commissioner Jones motioned to adopt Ordinance#2015-019, on second reading; seconded by Commissioner Brandimarte. Vice-Mayor Grace reminded everyone of the upcoming Founders Day celebration. Vice-Mayor Grace spoke of the Bears program starting on Saturday, and having to call Chief Granville twice to have an officer remove cars that were blocking 2nd and'8d'. She realizes the Bears should have a safety detail and questioned if someone from the City spoke to them about it. Chief Granville responded he has spoken to them and gave them information on how to go about getting a special detail. Vice-Mayor Grace asked about follow-up, and City Manager Baldwin said the Bears will need to step up if a detail is necessary. Vice-Mayor Grace questioned where we go from here, and said to ensure safety, there needs to be some protocol. She asked where our go-to person in the City is if they are not following the guidelines. They are using our park and we give them funding each year. City Manager Baldwin said they should be obligated to have a special detail if they are causing a problem in the neighborhood. Mark Felicetty, Director of Parks & Recreation, noted he spoke to Veronica Larkin, acting President of the Bears, and they do not have the funds to pay for a special detail. Minutes of Regular Meeting 12 Dania Beach City Commission Tuesday, September 8,2015—7:00 p.m. Commissioner Jones said something needs to be done. He questioned what would be the protocol and if the Bears should have to pay for the detail. Director of Parks & Recreation Felicetty responded the Bears should pay the cost, which would be approximately $800 per home game for two detail officers for 10 hours. Commissioner Jones asked if the Bears organization could dedicate people to do the detail. Chief Granville said the issue is the League requires they have two detail officers. Chief Peterson used on-duty personnel, but he does not want to go that route in case the officers need to respond to an emergency, which would leave the park uncovered. He noted CSAs cannot be posted at the park because they do not have enforcement responsibilities. Commissioner Jones asked if the sheriff will work with us in having an officer there until this is worked out. Chief Granville said he will look into it, but he does not want to use an on-duty officer. He repeated that the Bears should budget for it as other programs do. City Manager Baldwin said the City needs to require them to do it, or the City needs to pay for it. Commissioner Brandimarte asked City Manager Baldwin to try to work with them. Commissioner Jones questioned if the money we give as a charitable donation could be used for this. City Manager Baldwin said it could be made a requirement tied to the donation. Administrative Reports 13.1 City Manager Minutes of Regular Meeting 13 Dania Beach City Commission Tuesday, September 8,2015—7:00 p.m. City Manager Baldwin asked the Commission to submit items for discussion at the budget workshop on Thursday. He noted donations will be discussed. City Manager Baldwin reviewed the congratulations letter he sent to Sheriff Israel for the new law enforcement services agreement, which listed a number of things he felt the sheriff should focus on. City Manager Baldwin noted a debriefing was held after the Hurricane Ericka threat, and we will be working on the disaster preparedness plan; additional training may be required per FEMA regulations. A discussion regarding the ongoing panhandling problem ensued, and City Manager Baldwin noted that is why he included the issue in his letter to Sheriff Israel. We are locally owned and headquartered in South Florida. Owners of World Waste Recycling are residents of Broward County and as of recently, resident of the City of Dania Beach. World Waste Recycling is the current service provider for Miami Dade County servicing 228,000 homes with an average of 28,000 homes a day. We are respectfully requesting that you reconsider the rash recommendation of the City Manager for the City's Residential Solid Waste Collection Services. The procedure of this evaluation was not transparent. Notifications were not given for this meeting and less than a business day occurred between the opening of the bids and the Proposal Recommendation meeting. The meeting was not posted on- line and though we showed interest at attending the Proposal Recommendation committee meeting we were never notified of such meeting. All these concerns would have been addressed at the Proposal Recommendation meeting. 1. Leased employees: World Waste Recycling uses a pay roll company to insure for workers comp. None of our employees are temporary or casual labor. Due to the overwhelming increase in workers compensation insurance, payroll companies offer workers comp at lower rate through the payroll. 2. No dedicated supervisor: A dedicated supervisor was named on page 72 of our proposal: Philip Nlttolo. 3. No litigation Page 111 of auditor report conflicts. On page',46 of the Proposal Forms (page 30 on our proposal). The question was whether the Company has been in litigation with the City and Litigation against any other governmental entity in Florida. The lawsuit mentioned in the auditors report is an accident and not with a municipality or other government entity. 4. No MSW experience: Although, World is not currently servicing a MSW account it still services residential 65-96 gallon carts. Irrelevant whether we are picking up recycling or MSW. Prior contracts sold: Contracts sold were half way through their terms. 6. Does not meet 2yr, 7,000 required: World Waste Recycling services 228,000 homes in Miami Dade County, including 11 municipalities. World services an average of 28,000 a day, roughly FOUR TIMES THE SIZE OF DANIA BEACH. 7. Liquidity Cash Flow Issues: World Waste Recycling is an S Corporation. Owners are financially responsible for the company. If World would have been notified of the Proposal Recommendation Committee, it would have been explained. 8. Rollout Recycling $360,000 - cash resources not available: Subjective. Drawn to own conclusion without justification. Financial References were submitted to assist in the determination of borrowing capabilities for the purchase of equipment, but the committee failed to follow up on the references. 9. Total Rev is 5.655 of which 5,631 from Miami-Dade. 15 new trucks - $1.5 million cash resources not available. Subjective, borrowing sources were never questioned. Although financial references were made available the committee never called to confirmed company's financial capability. 10. Ability to perform under pricing proposal sustainability is highly questionable: Subjective, drawn to own conclusion without further confirming financial capabilities. World Waste commenced the Miami Dade County Contract with 23 new trucks and only charging $1.92 per home. Reference letter from Miami Dade County was included but never taken into consideration. 11. Current 30 vehicles aging fleet - as stated 15 new trucks were on order and the RFQ never mentioned that it was necessary to have a new fleet. 12. No dedicated vehicles identified or collection approach: 25 trucks were identified to do the service. Detailed identification was never required. We appreciate the current relationship that the City has with the intended awardee, but please reconsider the savings of more than $6,663378.96 for the first term of the contract that the City could enjoy by awarding the contract to World Waste Recycling. Please remember that the City has a Service Test Period and if not satisfied with the service, the City may opt to discontinue the contract.
