Call to Order/Roll Call Mayor Salvino called the meeting to order at 7:00 p.m. Present: Mayor: Marco A. Salvino, Sr. Vice-Mayor: Bobbie H. Grace Commissioners: Chickie Brandimarte Walter B. Duke, III Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Commissioner Jones gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Pat Chukerman, Green Advisory Board Pat Chukerman, Chair of the Green Advisory Board, was accompanied by the other members of the Green Advisory Board, and provided a list of initiatives and requested a joint workshop with the Commission. The board also asked the Commission to increase the number of members on the board to 20 members, and for $500.00 for collateral materials to be dispensed to the residents. Vice-Mayor Grace noted the board's booth and available information at the Founder's Day celebration was impressive; this board can help us do a lot of positive things in Dania Beach. Commissioner Jones invited them to attend the Resilience Workshop that is being held at City Hall today and tomorrow. He would like to see recycling within City Hall, and he likes the idea of the hazardous waste pickup. Commissioner Brandimarte noted if the boards have a problem with attendance, it should be brought to the attention of the Commission. 3.2 Mike Lally, Manager/Principal, Dania Beach Boat Club—Fire Rescue Assessment City Attorney Ansbro noted this item has been resolved and is removed from the agenda. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Vivek Golikeri, 301 SE 3rd Street, requested that we tighten up rules on trespassing, and that we pass a law dealing with panhandling at a bus stop. Darren Greene, 294 NW 13`" Court, on behalf of the General Employees Union, thanked the Commission for keeping the DROP plan open. 6. Public Safety Reports Captain Kevin Granville, BSO Chief of Police, noted there are three additional motormen patrolling in the City. This week BSO will be conducting their quality of life sweep, which addresses loitering and trespassing, and they are following up on the homeless camps. He also noted a slight increase in residential burglaries in the northeast area. Sean Brown, Battalion Chief, BSO Fire Rescue, noted there will be a road closure on Dania Beach Boulevard at the bridge crossing the Intracoastal Waterway beginning on October 13; traffic will be diverted at 5d` Avenue and routed to Sheridan Street. He spoke of the ISO rating, and said it is now at 1, for the first time in history. The City now has a class one Fire Department, and he thanked everyone involved in this achievement. Commissioner Brandimarte questioned if there would be signage that businesses would still be open for business when the bridge is closed. City Manager Baldwin responded there would be signage and notices would be distributed to homeowners; we will stay on top of the construction schedule and work with the contractor regarding the traffic configuration. 7. City Attorney Ansbro read the title of Resolution#2015-108. Vice-Mayor Grace said she wants NW 6t' and 7th Avenues added. City Manager Baldwin confirmed they are on the list. Vice-Mayor Grace motioned to adopt Resolution #2015-108; seconded by Commissioner Jones. The motion carried unanimously. 7.8 RESOLUTION#2015-111 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A RECIPROCAL USE AGREEMENT WITH THE SCHOOL BOARD OF BROWARD COUNTY, FLORIDA,A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION, RELATING TO THE MUTUAL USE BY THE CITY AND THE BOARD OF CITY AND SCHOOL BOARD FACILITIES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2015-111. Vice-Mayor Grace asked what role the City will play in the demolition of the old school. City Manager Baldwin said school officials asked if we would participate in the project; with Commission approval, it could be an opportunity to work with them to come up with a joint facility that we could use. Vice-Mayor Grace motioned to adopt Resolution #2015-111; seconded by Commissioner Jones. The motion carried unanimously. 8. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Commissioner Jones motioned to continue Ordinance #2015-022, on second reading, until the October 13, 2015 City Commission meeting at 7:00 p.m.; seconded by Commissioner Duke. He asked the Commission to disclose any communication they had on these matters. Minutes of Regular Meeting 5 Dania Beach City Commission Monday, September 21,2015—7:00 p.m. 9.2 RESOLUTION#2015-112 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-64-15) AND VARIANCE (VA-79-15) SUBMITTED BY ARCHBISHOP THOMAS G. WENSKI, ARCHDIOCESE OF MIAMI FOR PROPERTY LOCATED AT 441 NE 2ND STREET IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2015-112. Corinne Lajoie, Principal City Planner, provided an overview of the variance and site plan requests. Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or opposition,he closed the Public Hearing. Commissioner Duke motioned to adopt Resolution #2015-112; seconded by Commissioner Jones. Timothy Pribisco, 4830 SW 51St Street, requested a point of clarification, and asked if a traffic study is required. Principal City Planner Lajoie said there is a traffic study requirement. Mr. Pribisco asked the Commission to consider waiving the requirement for a traffic study and mitigation fee. Charles Buckley, Charles Buckley Consulting Engineering Services, noted they feel the traffic study is moot because there is an abundance of parking that is not going to be used. Commissioner Duke questioned why, based on the number of potential trips per day, we would make them waste the money on a study. Mayor Salvino agreed, and asked why we could not make an exception. Principal City Planner Lajoie noted this is a code requirement and would require a variance request, which is not included in tonight's item. Commissioner Duke amended his motion to waive the traffic study subject to whatever administrative requirements need to be done; seconded by Vice-Mayor Grace. City Attorney Ansbro cautioned this may have to come back for the variance request. Minutes of Regular Meeting 6 Dania Beach City Commission Monday, September 21,2015—7:00 p.m. Mr. Pribisco confirmed they would be able to move forward and get the building permits, but there would be a time delay and additional cost of$2,000.00 associated with a variance request to waive the traffic study requirement. Responding to Mayor Salvino, Principal City Planner Lajoie said, due to the traffic study being a code requirement that the applicant would have to meet, they need to pay the fee for a variance if they are not able to meet the requirement. City Attorney Ansbro noted he is okay with the Commission waiving the fee, although it would be setting a precedent. He would rather see a code amendment to deal with this for the future, than trying to do it ad hoc. Mr. Buckley noted he is not a traffic engineer, but the total trips for the whole site are 323, and this information has been given to staff. Commissioner Duke commented these kinds of things are opportunities to improve our code. He noted the Commission needs to be careful making ad hoc decisions. Mayor Salvino suggested adopting the resolution as presented, and staff can look further into the traffic study issue. Discussion and Possible Action 10.1 December City Commission Meeting Dates Vice-Mayor Grace motioned to cancel the December 22°d City Commission meeting; seconded by Commissioner Jones. The motion carried unanimously. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte complimented the Founder's Day event at City Hall. 11.2 Commissioner Duke Commissioner Duke had no comments. 11.3 Commissioner Jones Minutes of Regular Meeting 8 Dania Beach City Commission Monday, September 21,2015—7:00 p.m. Commissioner Jones commented he is no longer a Commissioner for Memorial Health Care System, and spoke of the importance of the position. Mayor Salvino noted Commissioner Jones did a good job representing the City. 11.4 Vice-Mayor Grace Vice-Mayor Grace had no comments. 11.5 Mayor Salvino Mayor Salvino commented we need to hire a new Public Services Director. He had a couple of problems with the department,which he is sure will be corrected. 12. Appointments Parks, Recreation and Community Affairs Advisory Board Commissioner Duke appointed Tamara James. Commissioner Jones motioned to approve the appointment; seconded by Vice-Mayor Grace. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager City Manager Baldwin noted the problem with the cemetery opening will be corrected and will not happen again. He added we are looking into outsourcing the cemetery, and a recommendation will be brought to the Commission. City Manager Baldwin advised he expects a report on October 5th on the Southeast Stormwater project that will give a final estimate of the cost; he will provide this information to the Commission, along with a recommendation. City Manager Baldwin noted the Waterfront Revitalization project bid is due on October 9th City Manager Baldwin said he has a meeting with Sheriff Israel on September 24t'to discuss law enforcement and fire issues. 13.2 City Attorney City Attorney Ansbro had no additional comments. 13.3 City Clerk- Reminders Minutes of Regular Meeting 9 Dania Beach City Commission Monday, September 21,2015—7:00 p.m. Wednesday, October 7, 2015 - 6:00 p.m. CRA Board Meeting Tuesday, October 13, 2015 - 7:00 p.m. City Commission Meeting Tuesday, October 27, 2015 - 7:00 p.m. City Commission Meeting City Clerk Stilson noted the CRA Board meeting was rescheduled to Wednesday, September 301" at 6:00 p.m. Vice-Mayor Grace said she had told Interim CRA Director Bach that she was not available during that week in September, or on October 7t' due to a conference. The CRA meeting should be scheduled when all of the board members are able to attend. Commissioners Jones and Brandimarte noted they would not be available on October 7th Commissioner Brandimarte added that if other Commissioners would not be at the meeting on September 30t', she will not attend either. 14. CITY CLERK m�o�P� _�rc,�f YOR Approved: October 13, 2015 ATE 1� Minutes of Regular Meeting 10 Dania Beach City Commission Monday, September 21,2015—7:00 p.m. Dear Mayor,Commissioners and Staff, In keeping with our mission,your Green Advisory Board has put together a list of initiatives that we would like the City to undertake to hopefully become a greener, more environmentally friendly city. Please give serious consideration to the following, and let us know if you feel it would be helpful to hold a joint workshop. 1. City Hall and city facilities need to recycle. Everywhere there is a waste basket,trash bin or garbage can, place a recycle bin and/or a paper bin. At all our parks, if you look in the trash bins you will see they are full of cans and bottles. These items should not go into our landfills. All the volumes of paper discarded at City Hall need to be recycled. 2. Require hotels, restaurants,condos and businesses to recycle.Any day,you can go to local restaurants and see cans and bottles discarded with garbage. 3. Investigate credits for residents who recycle. Hollywood is one of several Broward cities that rewards residents with a variety of rewards that residents can earn for recycling including movie tickets, Publix gift cards and more. All based on the amount of their recycled items.Additionally, we need to get all our landlords who have rental properties on board with this Recycling Program so the renters will also buy into the program. 4. Join other cities nationwide in banning"wipes"to keep them from clogging our sewer pipes. 5. Sponsor(perhaps annually, more often if possible)a hazardous waste pickup day with large trucks to cart the waste away. Stuart is one city that does an annual Extreme Hazardous Waste Collection. 6. In order for this Board to be effective and create lasting accomplishments,we need more than the 4 members that we currently have.We would like each commissioner to appoint 4 citizens so that we can make this a viable Board. 7. We are asking for$500 for collateral information to dispense to our residents. REQUEST TO ADDRESS CITY COM MSION AT REGULAR OR SPECIAL MEETINGS The City is required by state law to keep minutes of City Commission meetings. To properly identify persons who address the City Commission in those mines,the City requests that this form be completed and provided to the City Clerk,before the meeting begins.
