HomeMy WebLinkAboutR-2015-116 - Amended a Notation on the Potvin Plat for property located at the SW Corner of SW 30 Avenue RESOLUTION NO. 2015-116 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST MADE BY CHARLES O. BUCKALEW, ON BEHALF OF THE PROPERTY OWNER, CAROL POTVIN TO AMEND A NOTATION ON THE "POTVIN" PLAT (PL-30-13MOD) FOR PROPERTY LOCATED ON THE SOUTHWEST CORNER OF SW 30Tx AVENUE AND THE DANIA BEACH CUT-OFF CANAL IN THE CITY OF DANIA BEACH FLORIDA, AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 28 "Land Development Code," Part 6, "Development Review Procedures And Requirements,"Article 640, "Plats"of the City Code of Ordinances (the "City Code"), Charles O. Buckalew, on behalf of the property owner, Carol Potvin (the "Applicant") has applied to the City of Dania Beach (the "City"), for approval of a Plat Note Amendment attached as Exhibit "B," for property legally described in Exhibit "A" (Application PL-30-13MOD); and WHEREAS, the boundary plat known as the "POTVIN" Plat was previously approved by the City on October 22, 2013 pursuant to Ordinance No. 2013-013; and WHEREAS, the applicant is requesting to amend the Plat Note, as follows: POTVIN PLAT NOTE AMENDMENT: FROM: Four(4) single family dwelling units with five (5) ancillary boat slips TO: Six(6) single family homes and six(6) ancillary boat slips; and WHEREAS, this request was reviewed by the City's Development Review Committee ("DRC") on August 20, 2015 and the applicant has addressed all comments; and WHEREAS, Broward County requires that the City concur with the proposed Plat Note Amendment prior to a review by the Broward County Commission; and WHEREAS, the City Commission finds that the approval of the proposed Plat Note Amendment will serve protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. The foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and are made a specific part of this Resolution. Section 2. That the POTVIN Plat Note Amendment (PL-30-13MOD) to permit six (6) single family homes and six (6) ancillary boat slips as provided in the attached Exhibit"B", a copy of which is made a part of and incorporated into this Resolution by this reference, is accepted and approved. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4.
