DANIA BEACH CITY COMMISSION
TUESDAY, OCTOBER 13, 2015 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor Salvino called the meeting to order at 7:00 p.m.

2. Invocation and Pledge of Alle ig ance
Mayor Salvino asked everyone to stand for the Pledge of Allegiance to the United States Flag.
3. Presentations and Special Event Approvals
3.1 My Brother's Keeper Update—Dan Murphy, Economic Development Manager
Dan Murphy, Economic Development Manager, gave a PowerPoint presentation, which is
attached to and incorporated in these minutes.
Commissioner Jones thanked Mayor Salvino for taking the My Brother's Keeper initiative and
commended Economic Development Manager Murphy for being the point person. He felt this is
a great initiative that should move forward, and the Commission should look at possibly giving
dollars for this endeavor.
Vice-Mayor Grace noted she attended the forum, and spoke of the additional initiative, such as
the reading program from Dania Beach Can, to help some of the My Brother's Keeper programs
move forward.
Commissioner Brandimarte commented that the entire back part of Olsen School would be a
good avenue to look into to be utilized for the program.
4. Proclamations
4.1 Domestic Violence Awareness Month — Kaitlin Teknipp, Grants Specialist, Women
in Distress
Mayor Salvino presented the proclamation to Kaitlin Teknipp, Grants Specialist, for Women in
Distress. Ms. Teknipp gave a brief presentation and thanked the Commission for their support.
5. Citizen Comments
Rodney Collins, 24 SW 5d'Avenue, addressed the co-designation of NW/SW 5d`Avenue as Rev.
W.C. Edgar Avenue, and stated his objection to this being done. He added that neither he nor his
family members living on 5th Avenue were notified of the proposed co-designation.
Doug Dyszer, owner of Santa Cruz Apartments, 4516-18 SW 33`d Avenue, addressed the airport
expansion, Avon Isles cleanup of 33id Avenue, and improvements promised by the City.
6. Public Safety Reports
Lt. Anthony Demarco, BSO Executive Officer, gave an update on criminal activity, noting crime
has decreased in the City, and spoke of the homeless outreach program, increased traffic patrol,
and efforts to combat trespassing. Lt. Demarco introduced Col. Pollock,who introduced Captain
Daniel Marks,the new BSO Police Chief for Dania Beach.
Sean Brown, Division Chief, BSO Fire Rescue, was available for questions.
Commissioner Duke recognized Karen Harrington, new commissioner of the South Broward
Hospital Board. Ms. Harrington introduced herself and said she looks forward to serving the
community.

Commissioner Duke motioned to adopt the Consent Agenda, with the exception of Item
#7.6; seconded by Vice-Mayor Grace. The motion carried unanimously.
City Attorney Ansbro announced Item 7.6 and 9.5 relate to the same project and would be
considered together.
7.6 RESOLUTION #2015-120
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A TEMPORARY USE AGREEMENT AND
ANY ADDITIONAL DOCUMENTS PERTAINING TO AGREEMENT AND TO TAKE ALL ACTIONS
NECESSARY TO IMPLEMENT THE TERMS AND CONDITIONS OF THE AGREEMENT, A COPY OF
WHICH IS ATTACHED, AND MADE A PART OF AND INCORPORATED INTO THIS RESOLUTION BY

9.5 RESOLUTION#2015-117
A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY
OFFICIALS TO EXECUTE AN AMENDMENT TO THE SECOND AMENDED AND RESTATED
DEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY OF DANIA BEACH, FLORIDA AND
DANIA ENTERTAINMENT CENTER, LLC; AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AMENDMENT TO THE SECOND AMENDED AND RESTATED DEVELOPMENT AGREEMENT;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (First Public
Hearing)
City Attorney Ansbro read the title of Resolution #2015-117, and noted this amendment is a
legislative matter. He explained that although not required by law, the City and Dania
Entertainment Center operators have voluntarily followed the notice and procedural requirements
set forth under state law pursuant to the Florida Local Government Development Agreement Act.
He announced the second public hearing for this item would be held at the Commission meeting
on October 27, 2015, at 7:00 p.m., and that tonight's vote would be only to move the proposed
amendment forward to the upcoming meeting, at which time final action on the item will occur.
Janna Lohta, Holland and Knight, 515 E Las Olas, representing Dania Entertainment Center,
reviewed the Capital Improvement Plan that was included in the agenda backup, and gave an
overview of Item 7.6, Temporary Use Agreement.
City Attorney Ansbro noted the temporary use agreement would be amended to expire on March
31, 2016, in case there are delays.
Mayor Salvino asked that a sign be installed directing drivers to the temporary parking lot.
Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, he closed the Public Hearing.
Commissioner Duke motioned to adopt Resolution #2015-120; seconded by Commissioner
Jones. The motion carried unanimously.
Commissioner Duke motioned to approve Resolution #2015-117 on first reading, and set
the second public hearing for the Commission meeting on October 27, 2015 at 7:00 p.m.;
seconded by Commissioner Jones. The motion carried unanimously.

Corinne Lajoie, Principal City Planner, gave an overview of the changes made to the ordinance
since first reading.
Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition,he closed the Public Hearing.
Attorney Denis Mele, on behalf of the applicant,was available for questions.
Commissioner Duke motioned to adopt Ordinance #2015-022, on second reading; seconded

City Attorney Ansbro read the title of Ordinance#2015-024.
Corinne Lajoie, Principal City Planner, provided an overview of the proposed amendments to the
Land Development Code.
Mayor Salvino said he does not agree with allowing bail bonds or pawn shop uses on Federal
Highway since we are trying to change the image of Dania Beach.
Principal City Planner Lajoie responded that there is a great deal of interest from the public for
both uses and staff set parameters in order to avoid a proliferation of these types of uses.
Commissioner Duke agreed with the text amendment changes, except for bail bonds and pawn
shop uses regardless of where they are located in the City.
Vice-Mayor Grace felt any of these uses should be allowed, but not along a main thoroughfare
like Federal Highway.
Commissioner Jones asked if pawn shop and bail bond uses would have to come to the
Commission for approval.
Principal City Planner Lajoie responded a special exception for a pawn shop would come before
the Commission, but the bail bond use would not.
Commissioner Jones said he had no problem with bail bond or pawn shop uses, per se; he might
have some concern along the Federal Highway corridor. He felt a bail bondsman is something
that is needed in the City.
Commissioner Brandimarte commented the Commission represents the people, who asked for
these items to be brought forward. She asked if the bail bond use requests were for Federal
Highway.
Principal City Planner Lajoie noted the one location requested was not fronting on Federal
Highway. She repeated they would be allowed in the City Centre district, which does run along
a portion of Federal Highway; pawn shops would likely be located in the South Federal Highway
mixed-use district.

Vice-Mayor Grace confirmed that these two uses could be allowed on Federal Highway if this
amendment is approved.
Commissioner Duke spoke of all of the pawn shops up and down US-441 where the Seminole
Casino is located, and felt the Dania casino will create a lot of demand for pawn shops and
possibly bail bondsmen. He said he does not want them on Federal Highway; we do not have
them now and we do not need them. He noted no one has approached him in seven years telling
him we need pawn shops and bail bondsmen; one person asked Community Development for a
bail bond use,but he cannot support this amendment the way it is written.
Vice-Mayor Grace repeated she does not object to allowing these uses in locations other than
along Federal Highway.
Mayor Salvino agreed with Commissioner Duke, and noted these uses are always around
gambling. He felt we have too many positive things going on right now in the City, and there is
no reason we need to have this element.
Commissioner Jones asked if the text amendment could be reworked to allow for a specific area
or space these particular uses could be located in.
Principal City Planner Lajoie said yes, provided the Commission gives direction.
City Attorney Ansbro suggested approving the ordinance in its entirety, except for pawn shops
and bail bonds.
Commissioner Duke motioned to adopt Ordinance #2015-024, on first reading, with the
exception of bail bondsmen and pawn shops; seconded by Commissioner Jones.
Commissioner Brandimarte agreed the amendment should be re-worded to allow these uses, but
not along Federal Highway
Commissioner Duke noted the farther you move these uses off Federal Highway, the closer you
get them to neighborhoods and residences; regardless whether they are on Federal or not, he sees
it as either having them or not having them.
Mayor Salvino opened the Public Hearing.
Kenya Peterman, 732 SW 2nd Place, said she agrees with not having a bail bondsman on Federal
Highway. She is looking for a space that is not on Federal Highway, as City Centre is a large
area in which to locate it, and asked the Commission to re-consider passing this tonight so she
can move forward.
John Sanders, 214 NE 5th, spoke in opposition to allowing bail bondmen and pawn shops in the
City.
Betty Sokol, 609 NW IOd' Street, also opposed bail bondsmen in the City.

Bob Adams, 330 SE 3rd Terrace, commented bails bondsman is a legitimate business, but should
not be on Federal Highway, and should be more than 1,000 feet apart from each other. He
opposes pawn shops being located anywhere in the City.
Charlotte Sloboda, 2905 Lakeshore Drive, spoke against pawn shops and bail bondsmen,
especially on the main streets of the City near neighborhoods.
Seeing as there was no one else to speak in favor or opposition, Mayor Salvino closed the Public
Hearing.

9.3 RESOLUTION#2015-115
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, REVISING
AND UPDATING THE SCHEDULE OF BUILDING PERMIT FEES, PURSUANT TO SECTION 8-3,
"BUILDING PERMIT FEES" OF CHAPTER 8, 'BUILDING" OF THE CITY CODE OF ORDINANCES;
PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2015-115.
Marc LaFerrier, Director of Community Development, gave an overview of the proposed
revisions and update, and noted this will make it a lot easier for everyone involved. The new
fees will be implemented January 1, 2016.
Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, he closed the Public Hearing.
Commissioner Duke motioned to adopt Resolution #2015-115; seconded by Commissioner

9.4 RESOLUTION#2015-116

THE REQUEST MADE BY CHARLES O.BUCKALEW,ON BEHALF OF THE PROPERTY OWNER, CAROL
POTVIN TO AMEND A NOTATION ON THE "POTVIN'PLAT(PL-30-13MOD)FOR PROPERTY LOCATED
ON THE SOUTHWEST CORNER OF SW 30TH AVENUE AND THE DANIA BEACH CUT-OFF CANAL IN
THE CITY OF DANIA BEACH FLORIDA, AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF
WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING

City Attorney Ansbro read the title of Resolution #2015-116 and advised this item was a quasi-
judicial hearing and swore-in those who would speak. He asked the Commission to disclose any
communication they had on this matter.
Corinne Lajoie, Principal City Planner, gave an overview of the request.
A representative of the applicant was available for questions.
Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, he closed the Public Hearing.

Commissioner Jones thanked former Chief Granville, and Officer Martin and Fire Rescue for the
invitation to the Chalk for Peace event. He also thanked Dania Beach Seniors Club for
acknowledging his service on the hospital board.
Commissioner Jones spoke of the unveiling and dedication of a Gandhi statue in Davie on
October 3rd
Commissioner Jones also spoke of a community partners meeting held today regarding school
absenteeism and truancy.

11.4 Vice-Mayor Grace
Vice-Mayor Grace spoke of recent and upcoming social and civic events.
11.5 Mayor Salvino
Mayor Salvino spoke of the County Columbus Day Re-dedication Celebration at Port
Everglades,where he met Senator Sachs.
Mayor Salvino noted he went to Chief Granville's fundraiser for NOBLE over the weekend.
Mayor Salvino spoke of the Optimists girls' softball program.
Mayor Salvino commented he has been working with Parks and Recreation; money has been set
aside for holiday decorations, and he would like to have a holiday tree lighting outside of City
Hall, as well as light up other areas of the City for the upcoming season.
12. Appointments
Dania Beach Housing Authority
Mayor Salvino reappointed Bill Winkelholz to a four-year term, and appointed Derrick
Hankerson to replace Craig Urbine.
Commissioner Duke appointed Tamara James to replace Mark LaRocca on the Marine Advisory
Board, and appointed Karen Harrington to replace Mark LaRocca on the Airport Advisory
Board.
Commissioner Jones motioned to approve the appointments; seconded by Commissioner
Duke. The motion carried unanimously.
13. Administrative Reports
13.1 City Manager
City Manager Baldwin thanked Chief Granville and welcomed Chief Marks. He will ask Chief
Marks to speak individually with the Commissioners.
City Manager Baldwin noted bids will be opened on Friday for the Waterfront Revitalization

City Manager Baldwin advised that Commissioner Jones asked him to bring up setting a town
hall meeting to be held out west. He will contact the Commission next week.
13.2 City Attorney
City Attorney Ansbro had no comments.
Commissioner Duke spoke of the issue involving invocations at Commission meetings, and
asked City Attorney Ansbro for direction, as he felt the matter should be discussed.
Mayor Salvino said we could go to a moment of silence and this would be the way to go.
Commissioner Duke wondered whether a vote was needed, and asked how we should proceed.
City Attorney Ansbro said there are rules of procedure for City Commission meetings, and the
invocation could be changed to a moment of silence by resolution. To be fair and all-inclusive to
those who might be made uncomfortable by an invocation, he recommends a moment of silence.
Commissioner Jones felt the moment of silence is a good thing.
Commissioner Brandimarte agreed a moment of silence is the best way to go. The Commission
can control themselves, but cannot control those they represent who might react to an invocation.
