Call to Order/Roll Call Mayor Salvino called the meeting to order at 7:00 p.m. Present: Mayor: Marco A. Salvino, Sr. Vice-Mayor: Bobbie H. Grace Commissioners: Chickie Brandimarte Walter B. Duke, III Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor Salvino called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event request from the Broward Metropolitan Planning Organization and the Dania Beach Community Redevelopment Agency to have a "Broward MPO Transportation Plan Roll-Out". This event will be held on November 6, 2015 at the Dania Beach Tri-Rail Station located at 500 Gulf Stream Way, from 9:30 a.m. - 2:00 p.m. The applicant is requesting assistance with erecting banners. Vice-Mayor Grace motioned to approve the Special Event request for the Broward MPO Transportation Plan Roll-Out, to be held on November 6,2015; seconded by Commissioner Jones. The motion carried unanimously. 3.2 Special Event request from the Dolphins Cycling Challenge Organization to have a "Dolphins Cancer Challenge". The event will be held on February 20, 2016 from 6:00 a.m. to 1:00 p.m. This will be an annual Tri-County bike ride through the City of Dania Beach. Vice-Mayor Grace motioned to approve the Special Event request for the Dolphins Cancer Challenge, to be held on February 20, 2016; seconded by Commissioner Jones. The motion carried unanimously. 3.3 Approve the Parks, Recreation and Community Affairs Board recommendation for a full fee waiver of$600.00 for the Kiwanis Club to utilize the I. T. Parker Community Center for their first annual "Halloween Bash" on October 30, 2015. The Parks, Recreation and Community Affairs Board unanimously approved the request for a full fee waiver and recommend Commission approval. Vice-Mayor Grace motioned to waive the $600.00 I.T. Parker rental fees for the Kiwanis Club Halloween Bash, to be held on October 30, 2015; seconded by Commissioner Jones. The motion carried unanimously. 3.4 Presentation on Olsen Middle School Family Fitness Day - Principal Valerie Harris Principal Valerie Harris provided information on the Olsen Middle School Family Fitness Day. She also noted that the next community meeting on the boundary proposals would be November 20th at 6:30 p.m. at Hollywood Hills High School. 3.5 FDOT Presentation on Dania Beach Boulevard Bridge Rehabilitation Project Casey Liening, FDOT Public Information Officer, provided an update on the project. Phase One of the construction began October 12th; the second phase will include a full bridge closure and will be for 60 days in early 2016. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Teddy Bohanan, 312 SW 15th Street, commented on the professionalism of the Sheriffs Department. Charlotte Sloboda, 2905 Lakeshore Drive, invited everyone to attend the St. Maurice Country Fair. Rodney Collins, 24 SW 5th Avenue, expressed his dissatisfaction on the renaming of NW/SW 5th Street for Reverend W.C. Edcar. He said he has a valid reason to protest the renaming and requested the Commission reverse their decision. Tamara James, 255 NW Tamara James Avenue, commented they do not have the support of the community for the fall festival, and requested citizen participation. 6. Public Safety Reports Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,October 27,2015—7:00 p.m. Captain Daniel Marks, BSO Chief of Police, recapped the arrests made in the last two weeks. He encouraged the residents to continue working with them, and recognized the officers of the month. He also noted that they have rolled out a homeless program and hotline, and he will introduce the deputy working in this unit to the Commission at the next meeting. John Quitoni, Division Chief, BSO Fire Rescue, advised everyone to be careful and watch for children on Halloween. 7. Consent Agenda Items added to Consent Agenda: #7.9 Items removed from Consent Agenda: #7.3, #7.8 7.1 Minutes: Approve Minutes of October 13, 2015 City Commission Meeting 7.2, Travel Requests: Request from Commissioner Albert Jones to attend the Florida League of Cities Legislative Conference in Orlando, Florida, on November 18-20, 2015 (estimated cost $1,133.53) Request from Commissioner Albert Jones to attend the 7th Annual SE Florida Regional Climate Leadership Summit in Key West, Florida, on December 1-4, 2015 (estimated cost$2,113.61) Resolutions 7.4 RESOLUTION#2015-122 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, PROVIDING FOR TRANSFER AND APPROPRIATION OF FUNDS FOR FISCAL YEAR 2015-2016 TO REALLOCATE PROJECT FUNDING WITHIN THE CAPITAL PROJECTS FUND; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. 7.5 RESOLUTION #2015-123 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, SUPPORTING THE BROWARD METROPOLITAN PLANNING ORGANIZATION AND THE CITY OF DANIA BEACH IN THEIR EFFORT TO COORDINATE THE CREATION OF A "QUIET ZONE" ALONG A PORTION OF THE FLORIDA EAST COAST RAILWAY CORRIDOR; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. 7.6 RESOLUTION#2015-124 Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,October 27,2015—7:00 p.m. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A "MEMORANDUM OF UNDERSTANDING" (AGREEMENT) WITH SOUTH FLORIDA DIGITAL ALLIANCE, INC. TO PROVIDE THIRTY-THREE(33)COMPUTERS, HARDWARE AND SOFTWARE, AT NO COST TO THE TO THE CITY OF DANIA BEACH;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. 7.7 RESOLUTION#2015-125 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,REQUESTING CONCEPTUAL APPROVAL FROM THE CITY COMMISSION OF THE CITY OF DANIA BEACH FOR BID ADVERTISEMENT FOR A PROJECT KNOWN AS "OASIS IX", THE DAVIS ISLES PROJECT, WHERE BIDDING IS EXPECTED TO BE SOUGHT BY THE CITY ADMINISTRATION; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Addendum 7.9 RESOLUTION #2015-128 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO PURCHASE HOLIDAY DECORATIONS WITHOUT COMPETITIVE BIDDING FROM STREET DECOR, INC., IN AN AMOUNT NOT TO EXCEED FIFTY THOUSAND DOLLARS ($50,000.00) FOR FISCAL YEAR 2015-2016; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Vice-Mayor Grace motioned to adopt the Consent Agenda, with the exception of Item #7.3 and Item #7.8, and with the addition of Item #7.9; seconded by Commissioner Jones. The motion carried unanimously. 7.3 RESOLUTION#2015-121 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, ACKNOWLEDGING THE HEALTHY COMMUNITY ZONE DESIGNATION AND AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A MEMORANDUM OF UNDERSTANDING WITH THE BROWARD REGIONAL HEALTH PLANNING COUNCIL FOR TECHNICAL ASSISTANCE; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2015-121. Commissioner Jones provided information on the location and purpose of the Healthy Community Zone. Commissioner Jones motioned to adopt Resolution #2015-121; seconded by Vice-Mayor Grace. The motion carried unanimously. Ordinances (Titles read by City Attorney) 7.8 ORDINANCE#2015-025 Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday, October 27,2015—7:00 p.m. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, CREATING ARTICLE VII "ROADSIDE MEMORIALS", OF CHAPTER 22 "STREETS AND SIDEWALKS" OF THE CITY CODE OF ORDINANCES OF THE CITY OF DANIA BEACH,FLORIDA; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Commissioner Jones explained this is being done to meet the requirements of Broward County, and to memorialize those who have lost their lives. Commissioner Jones motioned to adopt Ordinance #2015-025, on first reading; seconded by Vice-Mayor Grace. The motion carried unanimously. 8. Bids and Requests for Proposals 8.1 RESOLUTION#2015-126 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AWARDING A BID TO SAM'S LANDSCAPE MAINTENANCE, INC., IN AN AMOUNT NOT TO EXCEED THREE HUNDRED FIFTY THOUSAND DOLLARS ($350,000.00) FOR GROUNDS AND RIGHT-OF-WAY MAINTENANCE AND AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AGREEMENT WITH THE COMPANY FOR SUCH SERVICES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2015-126. Commissioner Duke motioned to adopt Resolution #2015-126; seconded by Commissioner Jones. The motion carried unanimously. 9. (SECOND READING) City Attorney Ansbro read the title of Ordinance #2015-024. Corinne Lajoie, Principal City Planner, gave an overview of the changes made to the ordinance since first reading, pursuant to the Commission's direction. Bail Bond and Pawn Shop uses have been removed from the amendment and will go before the Planning & Zoning Board at their next meeting. Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Vice-Mayor Grace motioned to adopt Ordinance #2015-024, on second reading; seconded by Commissioner Jones. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Grace Yes Commissioner Duke Yes Mayor Salvino Yes Commissioner Jones Yes 9.2 RESOLUTION#2015-117 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN AMENDMENT TO THE SECOND AMENDED AND RESTATED DEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY OF DANIA BEACH, FLORIDA AND DANIA ENTERTAINMENT CENTER, LLC; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE SECOND AMENDED AND RESTATED DEVELOPMENT AGREEMENT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Second Public Hearing) City Attorney Ansbro read the title of Resolution #2015-117, and explained this is a legislative matter; notice and procedural requirements set forth under state law pursuant to the Florida Local Government Development Agreement Act were followed. Janna Lohta, Holland and Knight, 515 E Las Olas, Fort Lauderdale, representing Dania Entertainment Center, noted she reviewed the Capital Improvement Plan, which was included in the agenda backup, at the first public hearing, and was available to answer questions. Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. City Attorney Ansbro read the title of Resolution #2015-127; he noted this is a quasi-judicial hearing and swore-in those who would speak. He asked the Commission to disclose any communication they had on this matter. Corinne Lajoie, Principal City Planner, gave an overview of the request. Mayor Salvino opened the Public Hearing. Travis Wichman, 3533 Forest View Circle, said he is against having the property become part of their neighborhood, and would prefer it remain public for use by the new developments adjacent to them. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday, October 27,2015—7:00 p.m. City Attorney Ansbro clarified that the parcel was not being used as a City park and had been given back to the developer, at their request; in exchange, they paid the City the value of what would have been required under the landscape ordinance for parks. This item is just a plat note to memorialize action previously taken. Michael Riechel-Sarup, 3525 Forest View Circle, commented the park is not used because there is a chain around it, and the community would like it to remain, as opposed to it being turned into a sales office. Seeing as there was no one else to speak in favor or opposition, Mayor Salvino closed the Public Hearing. Commissioner Brandimarte questioned how the equipment was being used since it was previously said that it had zero value; her understanding is that the developer wants to take the homeowners' park away from them. City Attorney Ansbro repeated that the park was returned to the property owner more than eight months ago and notice was given at the time. Commissioner Jones agreed with Commissioner Duke that this is a matter between the developer and homeowners, and felt this item should be continued in order to allow them time to work it out. Responding to Mayor Salvino, Mark Felicetty, Director of Parks and Recreation, clarified the equipment is not bad; however, it has no resale value. Commissioner Duke felt there are two sides to this story; we want to make the right decision and balance all interests. Commissioner Jones motioned to continue Resolution #2015-127 until the November loth City Commission meeting at 7:00 p.m.; seconded by Commissioner Duke. Jane Storms, Pulice Land Surveyors, representing the applicant, noted she will contact the developer to obtain information and to meet with the homeowners. Discussion and Possible Action There were no discussion items on this agenda. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,October 27,2015—7:00 p.m. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte commented on today's Seniors Halloween Party. 11.2 Commissioner Duke Commissioner Duke commented on the Mayor's Gala on Friday night and noted that Tamara James stood in for him because he was unable to attend. 11.3 Commissioner Jones Commissioner Jones commented that he was recognized by Broward County for his service today, and thanked those who supported him. Commissioner Jones spoke of the recent airport noise information meeting at Meli Park. Commissioner Jones motioned to ask the City Manager to look into the feasibility and cost to perform a sample of the same test BCAD is doing to validate the results; and send a letter to the County Commission requesting a temporary change in the runway use until they are caught-up on the sound insulation. Motion died for lack of a second. Commissioner Duke objected to a motion, and said this should be a discussion item. City Manager Baldwin noted he would like to discuss this with Ron Book. Commissioner Brandimarte objected to another consultant because we already pay Ron Book and Anne Castro. City Manager Baldwin said he and the consultants have periodic meetings; they can discuss this and bring it back to the next Commission meeting. Commissioner Jones motioned for the City Manager to send a letter to the County Commission as outlined in his previous motion. Mayor Salvino noted the City Manager will send a letter without a motion. 11.4 Vice-Mayor Grace Vice-Mayor Grace provided information on the Dania Beach Relay for Life Kickoff meeting on November 5th. 11.5 Mayor Salvino Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,October 27,2015—7:00 p.m. Mayor Salvino noted the Holiday Festival is December 101h at City Hall. He asked the Commission to remember they are here for the people and not to argue with each other. 12. Appointments Selection of Vice-Mayor for term beginning November 10, 2015 Commissioner Brandimarte motioned to appoint Commissioner Jones; seconded by Commissioner Jones. The motion passed on the following 3-2 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Grace No Commissioner Duke No Mayor Salvino Yes Commissioner Jones Yes Green Advisor. Board Commissioner Jones appointed Tbia Augustin. Commissioner Jones motioned to approve the appointment; seconded by Commissioner Brandimarte. The motion carried unanimously. 13.
