HomeMy WebLinkAboutR-2015-134 Approving an amendment of a non-vehicle access line on the Dania Jai Alai Plat (DR-88-15) for Dania Entertainment Center, LLC for property at 301 East Dania Beach Boulevard RESOLUTION NO. 2015-134 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING AN AMENDMENT OF A NON-VEHICLE ACCESS LINE ON THE DANIA JAI ALAI PLAT (DR-88-15) MADE BY CALVIN, GIORDANO AND ASSOCIATES, INC., ON BEHALF OF THE PROPERTY OWNER DANIA ENTERTAINMENT CENTER, LLC, FOR PROPERTY LOCATED AT 301 EAST DANIA BEACH BOULEVARD WITHIN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the boundary plat known as the "Dania Jai-Alai"Plat was approved by the Dania Beach City Commission on May 8, 2007 by Ordinance No. 2007-09; and WHEREAS, pursuant to Chapter 28 "Land Development Code," Part 6, "Development Review Procedures And Requirements,"Article 640, "Plats" of the City Code of Ordinances (the "City Code"), the applicant, Calvin, Giordano and Associated, Inc., representing the property owner Dania Entertainment Center, LLC, is requesting to reduce the Non-Vehicle Access Line (NVAL) along the main Dania Beach Boulevard opening from 100 feet to 75 feet in depth; and WHEREAS, this request was reviewed by the City Development Review Committee (DRC) on August 20, 2015 and the applicant has addressed all comments; and WHEREAS, Broward County requires that the City of Dania Beach concur with the proposed revision prior to a review by the Broward County Commission; and WHEREAS, the City Commission finds that the approval of the proposed Plat Note Amendment will serve protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan. NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and are made a specific part of this Resolution. Section 2. That the City of Dania Beach approves the proposed amendment to the Non-Vehicle Access Line (NVAL) along the main Dania Beach Boulevard opening from 100 feet to 75 feet in depth in connection with the "DANIA JAI-ALAI" Plat(DR-88-15) as provided in Exhibit "A", a copy of which is attached and made a part of and incorporated into this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. AN S RO CITY ATTORNEY 2 RESOLUTION#2015-134 i Dania Jai Alai Vacations and NVAL Amendment Anaust 5,2015 Dania Entertainment Center, LLC, (DEC) in accordance with the developer agreement with the City proposes to vacate the following rights of way and easements that were dedicated by the DANIA JAI ALAI PLAT(Plat Book 177,Pages 170-174): A) RELOCATED NE 2nd STREET north of existing NE 2nd STREET B) TRAFFIC CONTROL DEVICE EASEMENT (TCDE) & CORNER CHORD at NE/SE P AVENUE C) ADA LANDING PAD & BUS SHELTER EASEMENT on DANIA BEACH BOULEVARD In accordance with the review criteria specified in Section 65540(A) the proposed vacations and or relocations (1) will not adversely affect access to neighboring properties, and (2) the platted right of way and easements are not needed for any public purpose as explained below: A) The Relocated NE 2"d Street was never constructed to replace the existing NE 2nd Street. Under terms of the developer agreement, DEC is rededicating the vacated but still existing NE 2nd Street. Traffic has continued to use existing NE 2"d Street without interruption.The rededication will keep this direct route open and not require a circuitous route that the "Relocated NE 2°d Street" would have generated. DEC will retain aerial easement rights for any future crossings. B) Subsequent to plat recordation, the Florida Department of Transportation District 4 (FDOT)required that the full opening shown at the southeast corner of the recorded plat j be completely closed. This opening was generally aligned,but offset with the intersection of 5'j'Avenue. FDOT closed the opening due to they placement of a new mast arm signal that would likely conflict with safe ingress/egress movement at this access location and intersection. Since the mast arm was installed prior to the recordation of the plat within its own separately recorded easement, and now that the access opening is prohibited, there is no need for the TCDE or outbound corner chord. C) Due to site plan and construction conflicts, the location of the platted bus shelter easement is proposed to shift approximately 13 feet to the west. The new location will include dedication of right of way or easement for the landing pad and the shelter in the same proportions and dimensions as previously dedicated. The platted right of way and easement for the facilities are being vacated as a housekeeping measure for clear title. Page 1 of 2 13-5680.28 Vacation Narrative D) DEC received approval from FDOT to amend the Non Vehicular Access Line(NVAL)to reduce the NVAL along the main Dania Beach Boulevard opening from 100 feet to 75 feet in depth due to conflicts with the existing building and proposed fagade improvements. When the plat was recorded,the BOYD GAMING plan was to tear down the existing fronton,which would have left sufficient room for a 100 foot deep NVAL.
