Call to Order/Roll Call Mayor Salvino called the meeting to order at 7:00 p.m. Present: Mayor: Marco A. Salvino, Sr. Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Walter B. Duke, III Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor Salvino called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.2 Healthy Community Zone Presentation—Teina Phillips, Program Director, BRHPC Teina Phillips, Program Director for Broward Regional Health Planning Council (BRHPC), presented a PowerPoint overview of the Healthy Community Zone, which is attached to and incorporated into these minutes. Vice-Mayor Jones commented this is a great opportunity for our community. 3.3 Special Event request from the South Florida Regional Transportation Authority (Tri- Rail)to have a "Rail Fun Day"; to be held at the Dania Beach Tri-Rail Station located at 500 Gulf Stream Way on January 30, 2016, from 11:00 a.m. to 3:00 p.m. Commissioner Grace motioned to approve the Special Event request for the South Florida Regional Transportation Authority (Tri-Rail) Rail Fun Day on January 30, 2016; seconded by Vice-Mayor Jones. The motion carried unanimously. 3.4 Special Event request from the America Diabetes Association to have a "Tour De Cure" event on November 22, 2015, from 7:00 a.m. -3:00 p.m. This will be a cycling event through the City of Dania Beach. Commissioner Grace motioned to approve the Special Event request for the American Diabetes Association Tour de Cure on November 22, 2015; seconded by Vice-Mayor Jones. The motion carried unanimously. 3.5 Special Event request from Blue Ridge Tree Farms for a "Christmas Tree Sale", to be located at 4650 SW 30th Avenue, on November 20 - December 24, 2015, with daily operating hours of 8:00 a.m. - 10:00 p.m. Commissioner Grace motioned to approve the Special Event request for the Blue Ridge Tree Farms Christmas Tree Sale from November 20, 2015 - December 24, 2015; seconded by Vice-Mayor Jones. The motion carried unanimously. 4. Proclamations 4.1 Farm-City Week—Rachel Bach, CRA Executive Director Mayor Salvino presented the proclamation to Rachel Bach, CRA Executive Director, and Dion Taylor, PATCH Community Garden. 5. Citizen Comments Betty Sokol, 609 NW I Od' Street, expressed her condolences on the passing of George Jason. A. Ivie Cure, 209 NW 14t` Court, spoke on the street renaming for Reverend W.C. Edcar, and requested the City remove the designation because he was a pedophile. Patricia Tyra, 2912 SW 54t' Street, addressed the street lighting problem in her neighborhood. She also asked if Public Services and the Fire Department could reassure the residents about how a fire would be handled because the fire hydrants are not working in their neighborhood. Rodney C. Collins, 24 SW 5t' Avenue, addressed the issue of the street co-designation for Reverend W.C. Edcar. He noted the City did not follow the process, and should do background checks on the people they are renaming a street for. Linda Wilson, President, Friends of the Dania Beach Library, invited everyone to attend the Holiday Open House at the Library on December 12t`. She also requested consideration for a charitable donation. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,November 10,2015—7:00 p.m. Veronica Larkins, 211 NW 12d` Avenue, thanked the City and BSO for supporting the Dania Bears. She presented the trophy the girls won over the weekend when they came in second place. Carolyn Jones, 722 SW 3rd Street,presented a tribute to George Jason. Gunnar Magliocca, 317 SE 4d` Terrace, noted he is having a problem with the City, and requested a code change for what is considered a commercial vehicle. He questioned why he is being harassed. Jerry Capodilupo, 645 NE 2nd Place, noted he is also being harassed by the City for his commercial vehicle, and would like to see the code changed. Mayor Salvino noted staff would contact both Mr. Magliocca and Mr. Capodilupo. Commissioner Grace commented that we should be able to find a way to work with the commercial vehicle owners in the City. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, provided an update on recent criminal activity in the City. He also introduced Deputy Jennifer Weir, Homeless Outreach Team, who provided an overview of how the program works and what resources are available to the homeless community. John Quitoni, Division Chief, BSO Fire Rescue, was available to answer questions. 3.1 Update on airport issues presented by Ron Book—Commissioner Brandimarte Ron Book, Lobbyist for the City, arrived at 7:40 p.m. and provided an update on airport issues. Vice-Mayor Jones said he hoped the validation of the sound insulation program was one of the issues addressed, as well as the issue of flight pattern flexibility during the time until the sound insulation program is completed. Mr. Book responded a letter has been sent to the County regarding the second issue; the first issue is already in the pipeline and is being addressed. He spoke of the land issues in the Interlocal Agreement, noting that we are working to get County staff to move the appraisals along. He added the goal is to be the County's partners to resolve the issues and move them forward in a productive fashion. He also noted that on the sound insulation mitigation, he is cautious about putting things forward that may take our eye off the ball and slow us down. His understanding is that Dania Beach's situation is what everyone else around the country is looking at, in that we are the ones with the newest runway who are dealing with sound insulation and Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,November 10,2015—7:00 p.m. sound mitigation issues. If there is something else out there, we need to vet it and discuss it internally, but he would caution not to lose focus and go backwards. Commissioner Duke provided the background of how we got to where we are now, noting that we were told the settlement agreement was the best deal we could possibly get and we should take it or else. He described what was offered under the agreement, and said the problem was that it had no teeth nor did it give a timeframe or provide for penalties for non-performance. The County and FAA have not performed and have been very slow. By the time the runway opened, only 100 homes out of approximately 1,800 had been done. Furthermore, residents are questioning whether the sales assistance program is a benefit when they do not get any benefit from it. He noted that we agreed to never sue the County, and although we have hired the best lobbyist in the state, and we are sending letters and requests, everyone should know that we do not have any leverage. He felt Mr. Book is doing an amazing job considering we have no leverage, but we are not getting any of the benefits any quicker and residents out west are angry. He said this means we forge ahead and keep moving forward, but we should not have any unrealistic expectation that anything will happen anytime soon or fast. Commissioner Brandimarte addressed the comment made about going backwards, and felt those who think they can change flight patterns or hours of operation are doing just that. She noted these things cannot be changed; giving false hope to those who live in the western part of the City betrays this whole deal and sets us backwards. She felt the Commission can only listen to the people on this issue, but they cannot deliver. Mr. Book spoke of the significance of the letters that are sent and requests made, and emphasized he does not create any false hope for anyone. Mayor Salvino commented that we have had months and months of nothing getting done with the sound insulation program. He is confused on where we are with this and felt that all we have is a bunch of conversation going on;there has been no advancement whatsoever. Mr. Book noted he understands why we are frustrated with the process, but believes we are about to see activity. If we do not see movement in 45 days, the Commission should tell him goodbye; perhaps 60 days because of the approaching holidays. He felt the people at the County are committed to moving this forward. Vice-Mayor Jones commented you cannot take away people's hope. People look to their leaders, and although they may not have the answers,they at least need to go and try to bring about hope. Marc LaFerrier, Director of Community Development, commented BCAD is making progress with the sound mitigation program. With the schedule they are on now, they could do 600 homes in the next 12 months. Checks for the CAR program should be written by the beginning of next year, and we are waiting to hear whether homeowners will be allowed to re-test for the sound insulation program. 7. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,November 10,2015—7:00 p.m. Mayor Salvino, Vice-Mayor Jones, Commissioner Duke and Commissioner Grace noted they had been contacted by Scott Backman. Corinne Lajoie, Principal City Planner, provided an overview of the plat note amendment, design variations and site plan. Mayor Salvino opened the Public Hearings. Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Commissioner Duke motioned to adopt Resolution #2015-127; seconded by Vice-Mayor Jones. The motion carried unanimously. 10. Discussion and Possible Action 10.1 Town Hall meetings—Vice-Mayor Jones Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,November 10,2015—7:00 p.m. Vice-Mayor Jones said the people out west comment that there are two separate cities. The last Town Hall meeting out west was in 2010, with only four commissioners attending. He would like to have a commission meeting out west, if not a town hall meeting. Charlotte Slaboda, 2905 Lakeshore Drive, said she does not feel like they are separate out west and does not want a commission meeting out west because it cannot be televised. Vice-Mayor Jones stated a commission meeting can be held at PJ Meli Park, and has been done in the past. Commissioner Grace noted she attends as many events as possible in the City, and we are one City. There is no need for a Town Hall meeting, and she will not attend. Everyone can attend the meetings at City Hall and if not, they can watch on television. Commissioner Duke commented the Town Hall meeting at the Estates of Fort Lauderdale was attended by approximately 20 residents. The meeting at PJ Meli Park was mostly attended by City staff. He does not personally feel the need to have a meeting out west, and it does not need to be sanctioned by the commission if a commissioner wants one. A Town Hall meeting is not needed; if a commissioner wants one,he or she should do it. Commissioner Brandimarte is for a commission meeting out west once in a while. She is not for a Town Hall meeting, especially at this time because it feels too political. Vice-Mayor Jones said he is okay with the response of the Commission. He clarified that he does not want a Town Hall meeting, but rather a Commission meeting. If people living in the west are not coming here, then they are saying something. This would be an opportunity for our citizens. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte commented on Code Enforcement, and praised them for keeping fire lanes open and sidewalks unblocked. Commissioner Brandimarte noted there are no lights on Dania Beach Boulevard from Federal Highway to past Winn Dixie. City Manager Baldwin said they were repaired today. 11.2 Commissioner Duke Commissioner Duke had no comments. 11.3 Commissioner Grace Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,November 10,2015—7:00 p.m. Commissioner Grace said her heart was very compassionate tonight regarding the street renaming that was addressed earlier. We have to set something in place to make sure this never happens again. She felt we have to do a background check on the persons for whom we name a street. 11.4 Vice-Mayor Jones Vice-Mayor Jones spoke of the passing of George Jason and Deacon Wardell Lee. Vice-Mayor Jones gave an update on the Dania Beach Leadership and Career Skills University. 11.5 Mayor Salvino Mayor Salvino reminded everyone of the Holiday Tree Lighting at City Hall on December 10th at 6:00 p.m. Mayor Salvino thanked Parks & Recreation and Public Services for the appearance of the ball fields. 12. Appointments There were no appointments at this meeting. 13. Administrative Reports 13.1 City Manager 13.1.1 Sound Engineer Testing City Manager Baldwin provided the Commission with a list of three firms that have experience with implementation of FAA sound insulation programs and acoustical testing. City Manager Baldwin noted he met with a resident who was so frustrated that a commercial vehicle parked in their neighborhood. He said whatever you do, there will be people on both sides of the issue; the best we can do is enforce the Code. If the Commission feels something in the Code needs to be changed, staff would be happy to recommend the change. Commissioner Duke said he can empathize with the residents who deal with commercial vehicles in their neighborhoods. He deals with it in his own neighborhood, and Code does not do anything about it. He does not know what the City Manager intends to do about it. Commissioner Brandimarte commented that when you do something about it, the people come and complain. She stated she is all for Code,but they need to be fair. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,November 10,2015—7:00 p.m. Commissioner Duke added he is not happy for himself or his neighbors because Code does not do anything to address the problem. He stated he is sick of it; he has 11 months left and he is termed out. Commissioner Grace told the City Manager that she has received several calls about commercial vehicles from residents in the southeast and southwest. She wants us to be conformative and try to figure out something that will help everyone in the City. Commercial vehicles are throughout the City, and the code needs to be upgraded. Commissioner Duke said we are a working class City and he understands work vans, but running a commercial business out of a residential neighborhood is not fair. They should be located in a warehouse area, and paying commercial and industrial taxes. Vice-Mayor Jones commented that what he would say to the City Manager and to Code is, make it fair and make it equitable; there are many violations throughout the City. 13.2 City Attorney City Attorney Ansbro commented on the passing of George Jason. 13.3 City Clerk- Reminders Tuesday,November 24, 2015 - 7:00 p.m. City Commission Meeting Wednesday, December 2, 2015 - 5:00 p.m. Abatement Hearing Wednesday, December 2, 2015 - 6:00 p.m. CRA Board Meeting Tuesday, December 8, 2015 - 7:00 p.m. City Commission Meeting Vice-Mayor Jones noted he will not be attending the December 2nd meetings. 14.
